APPROVAL IN CONCEPT BY THE CITY OF NEWPORT BEACH as required for permit
application to the South Coast Regional Commission pursuant to California
Administrative Code, Sections 13210 and 13211.
General Description of Proposed Development: Reinforcing of the existing
seawall by utilizing helical anchors and dywidag tie -rods.

A copy of any variance, exception, conditional use permit or other issued permit is
attached together with all conditions of approval and all approved plans including
approved tentative tract maps. On the basis of this finding, these plans are approved in
concept and said approval has been written upon said plans, signed and dated.
Should Newport Beach adopt an ordinance deleting, amending or adding to the
Municipal Code or other regulations in any manner that would affect the use of the
property or the design of a project located thereon, this Approval In Concept shall
become null and void as of the effective date of this said ordinance.
In accordance with the California Environmental Quality Act or 1970, and state and local
guidelines adopted thereunder, this development:
Has been determined to be ministerial or categorically exempt.
❑ Has received a final Exemption Declaration or final Negative Declaration (copy
attached).
❑ Hasreceived a Final Environmental Impact Report (copy attached).
All discretionary approvals legally required of Newport Beach prior to issuance of a
harbor permit and a building permit have been given and are final. The development is
not subject to rejection in principal by Newport Beach unless a substantial change is
proposed.
This concept approval in no way excuses the applicant from complying with all
applicable policies, ordinances, codes and regulations of Newport Beach. See attached
Special Conditions.

resporlse to my letter of September 4, 2007, an engineer's assessment prepared by
Wilitarn Simpson & Associates, Inc. was received in this office on October 17, 2007.
Review of the October 17th submittal reveals that previously requested information has not
yet been submitted or raises additional questions. Therefore, the application remains

re -inspection has verified that the pier meets City standards.
The permit will be transferred to Richard L. Cooley once we receive the Transfer
Application Card with the signatures of both the buyer and seller, and the remaining $176

Sirs:
The City of Newport Beach Fire and Marine Department has received a
request to transfer Pier Permit 23838061 for the above-mentioned
property. The facility was inspected on July 20, 1998.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and we have been notified of the corrections:
1. A City approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is enclosed.
This requirement is in accordance with Title 17 of the California
Administrative Code.
2. Replace all broken and missing decking.
3. Repair one piling hanger.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures shall be inspected
For compliance with the City's minimum plumbing, electrical, and
Structural requirements and the conditions of the existing permit.
All deficiencies must be corrected prior to transfer of the permit."
Please advice this department when the above deficiencies has/have
been corrected. Call 714-644-3043 to request a re -inspection.

Dear Property owner:
On December 2, 1986 personnel from the City of Newport Beach
observed sea water flooding coming from your property. it is
presumed that the flooding is the result of inadequate height on
your private bulkhead or caused by the water leaking through your
private bulkhead. Please be advised that it is the property
ownerls responsibility to maintain the bulkheads and to maintain
them at the proper height to protect against flooding.
Please contact the Marine Department immediately and indicate
what measures yuou are taking to solve this problem at your
property.
