Reference is made to your letter dated February 28, 1997 in which you submitted on
behalf of Mr. Sullivan who resides at 4210 River Avenue, a notification for the maintenance
dredging of 50 cubic yards of sand and silt material by hydraulic suction and disposal of the
dredged material on the adjacent beach.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that Mr. Sullivan's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

Dear Mr. Sullivan:
The City of Newport Beach has received a complaint regarding the
pier and float bayward from 4210 River Avenue.
Specifically, the complaint is that a vessel is berthed in
violation of Section 21.A. of the City Harbor Permit Policies,
which states:
21.A. "boats moored at private or public docks shall not
extend beyond the projection of the property lines of the
property to which the dock facility is connected... 11.
A field inspection conducted By the orange County Sheriff's Harbor
Department has revealed that a vessel is berthed in a position that
has it extending across the property line into the city street end,
and in that position is blocking on -shore mooring W-41. This is in
violation of the above stated code. A recent follow up inspection
has confirmed that the vessel is still encroaching across the
property line and blocking mooring W-41.

Harbor Permit Policies within 10 working days from the date on this

Gentlemen:
We have researched our records to determine the ownership of the
water area bayward of the bulkhead line, at the above address.
In most areas in the harbor, as you are familiar, the property
bayward of the bulkhead line is state tidelands. In this
particular case, the property bayward of the bulkhead line is fee
property, originally belonging to the developer of the West Newport
area, however, at the time the tract map was filed on the
development, the fee land bayward of the bulkhead line was listed
as a dedicated waterway within the City of Newport Beach- it is
very similar to a situation where a tract map is filed for a
residential development and the underlying fee property is
dedicated for street use. In this particular case, the underlying
fee property was dedicated for a water right of way.

Dear Mr. Sullivan:
'Reference is made to your request of May 20, 1994 (94 -00827-
00 -MFS). Under the provisions of Section 10 of the Rivers and
Harbors Act of March 3, 1899 (33 U.S.C. 403), you are hereby
authorized to construct a private pier and dock in Newport Bay,
at 4210.River Avenue, Newport Beach, California. The
improvements shown on the enclosed drawings are subject to the
enclosed conditions and consist of:
1. Construction of a pier (10 feet by 14 feet).
2. Construction of a gangway (3feet by 22 feet) attached to
the pier and float.
3. Construction of a float (10 feet by 20 feet), including
driving three (3) new piles.
The owner or authorized responsible official must sign and
date all copies of this Letter of Permission (LOP) indicating
thathe/she agrees to the work as described and to comply with
.all conditions. One of the signed copies of this Letter of
.,Permission must be returned to the Corps of,Engineers (a
'preaddtes.sed envelope is enclosed for your convenience).

application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.

LOCATION: 4210 River Avenue, Newport Beach, Orange County.
PROPOSED DEVELOPMENT: Construction of new dock, pier and gangway. The
proposed pier will be 14 feet by 10 feet. The proposed gangway will be 3 feet
by 22 feet. The proposed float for docking will be 20 feet by 10 feet. There
is no U.S. Pierhead line in this area but the proposed development is
consistent with adjacent development.
RATIONALE: The proposed development will have no adverse impacts on coastal
access or resources, is consistent with the City's certified Land Use Plan,
the Chapter 3 policies of the Coastal Act and past Commission actions.
This waiver will not become effective until reported to the Commission at their
—July 12-15, 1994 — - , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

Dear Mr. Sullivan:
In accordance with your request, we submit the following addendum to the contract
dated October 11, 1993 for construction and installation of a new gangway and
float to be located at 4210 River Avenue, Newport Beach.
We propose to provide a 2' longer gangway for the same fee. Also, the float will
be increased to a 10' width, including an additional pontoon, for an increase of
$600.00.
Additionally, we will obtain a city permit to dredge approximately 80 cubic
yards, and deposit the spoils adjacent to the site. We will charge a $1,500.00
fee for dredging, and $300. 00 for the city fee and additional drawing. The city
advised we will also need to pay an additional fee to the Water Quality Control
Board, but on last Friday their staff was unable to connect us to the proper
staff person, and that fee will be additional. We expect it to be minimal, and
will advise as soon as we have the information.
We also propose to install a 15' wood groin along the West property line. We
propose the lumber to be creosoted, but if that isn't possible due to
environmental concerns, we will use pressure treated lumber. We will have a
dete . rmination in the next few days, and will advise you of the results. Since
the lumber will need to be milled and treated, we recommend we order it as soon
as possible. The fee for the groin is $300.00 a lineal foot, and can be included
in our dock permit package.
We have obtained a message from Water Quality that the permission letter for the
project was to be in last Fridays mail, so we should be able to initiate Coastal
prior to the close of this week. Therefore, we will also initiate the working
�drawings this week.

To move forward on the above mentioned process and work, we request additional
f ees of $300. 00 for dredging, $1, 500. 00 for the groin materials, $500. 00 draw for
the working drawings, and $500.00 to obtain the necessary pipe and dredge pump
modifications. We intend to be dredging at the site in approximately three (3)
weeks. At about this same time, we would request the material deposit so that
with city working drawing approval and no adverse Coastal reports, we will
construct the dock and gangway, and install them upon Coastal approval.

Please excuse my tardiness in providing a new schedule for the West Newport
project.
Please find included a copy of the Fax for the creosoted lumber for the groin,
from Jones Lumber. My previous calculations from repairing a groin three years
ago, I estimated a s100.00 per foot fee. With the recent changes. in
environmental laws, the only supplier found who could provide it, was the
supplier you referred us to with a total price of $2,210.34, or for just under
$150.00 per foot, and delivery in two to three weeks.
We are scheduled to be dredging the first phase on next Tuesday, March Sth.
We expect to have city approval of the working drawings by March 11, and can
start constructing the dock and gangway so that when the final permit is issued,
we can install the groin, dock, and gangway, and finish the dredging.
I recommend we go ahead with ordering the creosoted lumber, and store it in our
yard until needed.
We look forward to moving ahead with this project.
