SUBJECT: DONNA & JOHN CREAN MARINERS BRANCH LIBRARY
CONTRACT NO. 3496 — REJECT BIDS
RECOMMENDATION:
Reject the bid received for Donna & John Crean Mariners Branch Library, Contract No.
3496 and authorize staff to re- advertise the pre - qualification process to obtain qualified
bidders and re -bid the project.
DISCUSSION:
At 2:00 P.M. on October 21, 2004 the City Clerk opened and read the following bid for
this project:
BIDDER TOTAL BID AMOUNT
C.W. Driver $6,224,000.00
Three contractors were pre - qualified to bid this project. Only one bid was received and it
was over 29% higher than the engineer's estimate of $4.8 million. A second bid was
rejected by the City Clerk, as it was submitted after the bid opening deadline. The third
contractor elected not to submit a bid due to internal problems.
On October 27, 2004, the Mariners Library Ad Hoc Committee met to discuss the bid
results. City staff and the City's program manager, Griffin Structures, presented
information regarding the City's options to proceed with the project. Due to the lack of
competition and the lack of available funds, the Committee unanimously recommended
that the City Council reject bids and direct staff to re -open the prequalification process
and re -bid the project.
If approved, the prequalification process would be completed by November 15 with the
bid opening scheduled for December 21. A contract could be awarded by City Council
on January 11 with construction starting by the end of the month.

Environmental Review:
Under the California Environmental Quality Act Implementing Guidelines (CEQA),
Planning Department Staff has determined a Notice of Exemption is appropriate for this
project. Staff has determined that it qualifies for a categorical exemption pursuant to
Section 15332 (Class 32, In -Fill Development Projects) of the CEQA Guidelines and
recommended Council approval of the Notice of Exemption. Council approved a Notice
of Exemption for this project on June 11, 2002.
