HomeMy WebLinkAboutSS3 - Code Enforcement in Santa Ana Heights• CITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. SS- 3 December 14, 2004 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: City Manager's Office Dave Kiff, Assistant City Manager 9491644 -3002 or dkiff @city.newport- beach.ca.us SUBJECT: Code Enforcement in West Santa Ana Heights ISSUE: Should the City enter into a contract with the County of Orange to provide code enforcement in West Santa Ana Heights in advance of our annexation of that area? RECOMMENDATION: • Receive and file. DISCUSSION: Background: State law suggests that cities should ultimately annex territories within spheres of influence. The law suggests that cities are generally more effective providers of municipal services (like libraries, public safety, recreation, code enforcement and street sweeping) than counties or special districts. One area that Newport Beach has considered annexing is West Santa Ana Heights (see map). Council has not yet formally acted on a Resolution of Application to annex West SAH, but we have discussed the matter several times prior to today and expect to bring forth a draft resolution in January 2005. Most of west and east Santa Ana Heights is within a redevelopment area administered by the County of Orange. The SAH Project Advisory Committee (PAC) assists the County in allocating redevelopment funds in both the east and west sides of SAH. SAHPAC has complimented the City (especially Sr. Code and Water Quality • Enforcement Officer Cass Spence) on our Code Enforcement activities since annexation. They have suggested that the same extensive enforcement should occur in Letter regarding West SAH Code Enforcement December 14, 2004 Page 2 the West side, too. Because of staffing constraints, the County's Code Enforcement • staff isn't always able to respond as thoroughly as the City's staff. In advance of an expected annexation, SAH PAC and the City have discussed having the County contract with the City to provide Code Enforcement Services up until such time as the West side is annexed. City Manager Bludau sent the attached letter to Supervisor Jim Silva proposing such a relationship. We have not yet heard back from the County. This Study Session item is an opportunity to further inform the City Council as to the tentative proposal and to answer any questions about it. Committee Action: SAH PAC supports the City's attempt to provide Code Enforcement in West SAH. Env. Review: None required. • Public Notice: This agenda item may be noticed according to the Ralph IA. Brown Act (72 hours in advance of the public meeting at which the City Council considers the item). Funding Availability: We have estimated that these services will cost $30,000 annually, including management and a vehicle. The details of our proposal are as follows: • • The City of Newport Beach's Code and Water Quality Enforcement Division will provide 20 hours per week (on average) of Code Enforcement to West Santa Ana Heights each week that the Contract is in place. • The Contract will last until such time as the City of Newport Beach annexes West Santa Ana Heights or until either party agrees to end the Contract with 30 days notice to the other party, whichever comes sooner. • The codes to be enforced will be from the Orange County Codified Ordinances rather than the City of Newport Beach's municipal code. • Any fees generated by citations would be deposited in a County account which the County so designates. • Any appeals made to citations issued by our staff will go through the County's appeals process. City staff will make themselves available to testify in support of staff's action to issue a citation at no additional cost. • The City will provide these services for $30,000 per year, which equates to $2,500 per month. The County may choose to pay the City in quarterly, semi - annual, or annual increments. • All records of our actions shall be provided to RDMD management, with copies kept by the City for our records. • City staff will regularly update your office and the Santa Ana Heights Project Area Committee (PAC) as to our actions. • All aspects of the proposal are subject to refinement as a part of developing • the actual Contract with County Counsel and with our City Attorney. While the decision to enter into this proposal is entirely the County's, we urge you to consider using redevelopment funds for this service. We have consulted with our own special counsel in this regard (David McEwen), and he suggested that this service can appropriately be Funded via redevelopment dollars.
