Dear Mr. Jones:
The City of Newport Beach essentially does dredging in the main
navigational channels and to rebuild public beaches. According to
Harbor Permit Policies, H-1, 11C, ^"Maintenance dredging bayward of
residential and commercial properties is the responsibilities of the
harbor permittee for the zone delineated by the bayward prolongation
of the side property lines, out to the U.S. Project Line". Therefore, in
your case the majority of area in that small channel is the responsibility
of the adjacent harbor permittees.
Based upon the above, the City is not proposing to spend any public
funds to dredge in this area.

Balboa Island. We are residents on either side of a small channel
between Collins Island and the first six homes on the North Bay Front.

where a build-up of.silt has been occuring for the past twelve years,
which is approximately the time since the last dredging.

Dear Mr. Melurn:
Reference is made to your letter dated April 22, 1997 in which you submitted on behalf
of The Valencia Group, Inc. located at 208 South Bay Front, a notification for the maintenance
dredging of 55 cubic yards of sand and silt material by hydraulic suction and disposal of the
dredged material on the adjacent beach.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that The Valencia Group's contractor does not exceed the maximum dredging
design depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER # 5-94-040, APPLICANT: Matt Clabaugh
LOCATION: 208 South Bay front, Balboa (Newport Beach), Orange County
PROPOSED DEVELOPMENT: Revision of an existing boat dock resulting in a
U-shaped dock with an attached 11 foot by 21 foot platform. The dock will be
21 feet long and 23 feet wide. The proposed dock will extend no further
channelward than the existing dock and will be within the U.S. Project line.
RATIONALE: The proposed development will have no adverse impacts on coastal
access or resources, is consistent with the City's certified Land Use Plan,
past Commission actions in the area and the Chapter Three policies of the
Coastal Act.
This waiver will not become effective until reported to the Commission at their
MARCH 15-18. 1994 . meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Admi.nistrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit

Discussion: This application is before the City Council as
required by Section 23.V. of the City Harbor Pe3;mit Policies, which

existing piers will be permitted providing they do not lessen the
use of either the immediate water or land areas."
The proposed revision does not increase the square footage of the
structure and therefore should not lessen the use of either the
immediate land or water areas.
