Developments—Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below-, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER # 5-87-583 APPLICANT: Dave Stone
LOCATION: 132 So. Bayfront, Balboa Island
NEWPORT BEACH
PROPOSED DEVELOPMENT: Replacing a dock, pier and a ramp with a new dock, pier
and a ramp.
RATIONALE: The project is compatible with the neighborhood, will have no
significant impacts and is consistent with the Coastal Act.
This waiver will not become effective until reported to the Commission at their
August 25-28, 1987 , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

project will extend are sovereign lands of the State of
California that the Legislature granted in trust to the City of
Newport Beach pursuant to -Chapter 74, Statutes of 1978.

project authorization. You should, however. apply to all other
agencies -having approval authority.
This action does not constitute, nor shall it be construed

SUBJECT: HARBOR PERMIT APPLICATION 259-132 BY DAVE STONE TO
REVISE HIS RESIDENTIAL PIER AND FLOAT BAYWARD OF
132 SOUTH BAY FRONT.
Recommendation: If desired, approve the application subject to
the following conditions:
1. Approval of the California Coastal Commission,
2. Approval of the U.S. Army Corps of Engineers,
3. Approval of plans and specifications by the Public
Works Department.
Discussion: This application is before the City Council as
required by Section 5.C.1 of the Harbor Permit Policies, which
states:
5.C.l. "Prior approval of the City Council will be re-
quired before issuing a permit for shore -connected
-structures when the abutting upland property is a
dedicated public right-of-way except along the Grand
Canal on
Balboa Island."
Regarding piers on Balboa Island, the Harbor Permit Policies
further state in Section 22:
22. "BALBOA ISLAND
No new, non-commercial piers on Balboa Island shall
be recommended unless it is in the public interest
or unless it is at such a location that it is not
useable for swimming or bathing.
Piers presently in use may be repaired but
recommendations for any additions or remodeling
shall be restricted to such changes that do not
lessen the use of either the immediate water or
land areas."
The revision proposed by the applicant is basically a rebuilding
and minor downsizing of the existing structure. No substantial
changes are proposed and the revision will not diminish the useage
of either water or land areas.

Dear Mr. Riddle:
The Newport Beach Marine Department has received a complaint
regarding the use of your residential float bayward of 132
South Bay Front. Specifically, the complaint Is that the
float is being used,in violation of Sections 1.A. and 4.K of
the Harbor Permit Policies, which state:
1.A. "Shore connected pi-ers and floats bayward of residential
zoned areas shall be reserved for the occupants of the.abutting
upland property and controlled by the'Harbor-Permittee. Ves,sels
moored at residenti'al piers shall not create a nuisance wi'th
regard to vehicle parking, vessel waste, li'veaboards, or
noise disturbances to adjoi,ning residents."
4.K. "In those areas of the harbor where the piers and floats;
are bayward of residential zoned areas and are reserved for the
occupants of the abutti"ng upland property, liveaboards s -hall not
be permitted. "
To preclude further actfon by this department, the above sItuatipns
must be corrected withi'n ten days.

# 259-132 for the property located at 132 South Bay Front, Balboa Island.
The structure was inspected on 6/10/85 at whi,ch ti'me it was determi'ned
that the following defici'enci'es exi'st:

Section 10.D. of the City Harbor Permi't Poli'cles states-:
"At the time of transfertll harbor structures�shall be inspected for
compli'ance with the City"s mi'ni'mum plumbing, electrical and structural
requirements, and the condi'ti'ons of the existing permit. All structural
deficiencies must be corrected prior to transfer of the permi't."
All the above deficiencies, except those noted as� "Informational" must be
corrected before the pfer permit is transferred. Electri'cal or plumbi"ng work
require a permit from the City Buildi'ng Department. All other work requi,res
a permit from the Mari'ne Department. -
Please advise this department when the above defi'ciencies have been corrected.
Another inspection will be made, and -when the problem is solved the pier permit
will be transferred to the new owner.
