SUBJECT: ADOPT RESOLUTIONS FOR MEASURE M FUNDING FROM THE
ORANGE COUNTY TRANSPORTATION AUTHORITY AND FOR
SENATE BILL (SB) 1346 FUNDING FROM THE CALIFORNIA
INTEGRATED WASTE MANAGEMENT BOARD (CIWMB)
RECOMMENDATION:
Adopt Resolutions for Measure M funding from the Orange County Transportation
Authority (OCTA) and for SB 1346 funding from the California Integraged Waste
Management Board (CIWMB).
DISCUSSION:
Measure M
On November 8, 2004, OCTA issued a call for projects for various improvement
projects under the Combined Transportation Funding program. The City will be
applying for funds with the Arterial Highway Rehabilitation Program (AHRP), and the
Signal Improvements Program (SIP). The AHRP was developed to support local
agency efforts to address their pavement rehabilitation needs by providing funds for the
rehabilitation of Master Plan of Arterial Highway (MPAH) arterial roadways in Orange
County. The Signal Improvement Program provides funding for improvements that lead
to better operation and management of signal systems and traffic congestion relief
throughout the county.
Arterial Highway Rehabilitation Program
Within the AHRP, approximately $75 million is available for Fiscal Year 2005 -06 and
Fiscal Year 2006 -07 for improvements countywide. For a project to be considered for
AHRP funding, an agency must share at least 50 percent of their project's eligible
costs. Higher percentages of agency share will improve the agency's project

competitiveness against those projects submitted by other agencies. AHRP projects
limit the maximum funding amount per project to $400,000.
On January 24, 2005, staff submitted seven funding application packages for the
various pavement rehabilitation projects throughout the City. The proposed projects
are primarily for maintenance and repair of existing pavement with no widening or
modification of the existing roadway configuration. These projects will replace and
overlay the existing pavement, and replace median curbs and gutters to improve street
drainage. A summary of the projects with funding are as follows:

Signal Improvement Program
Within the SIP approximately $10 million is available for Fiscal Year 2005 -06 and Fiscal
Year 2006 -07 for improvements countywide. For a project to be considered for SIP
funding, an agency must share at least 20 percent of their project's eligible costs with
higher percentages of agency share improving the agency's project competitiveness
against those projects submitted by other agencies. SIP projects limit the maximum
funding amount per project to $250,000.

On January 24, 2005, staff submitted three funding application packages for the various
projects throughout the city. The proposed projects are the first phases of a program to
replace the City's outdated traffic signal control system. These projects will provide the
foundation of the new traffic signal system with the procurement and installation of a
new central traffic signal system that can be easily maintained and expanded.
Additionally, these projects will begin the city -wide upgrade of existing traffic signals to
a modern traffic signal controller and begin the upgrade of the traffic signal
communications system to a fiber optic system, including all applicable equipment,
training, and design to implement the new system. A summary of the projects with
funding are as follows:

Project 1 consists of the following:
• Procurement and installation of a new central traffic signal system to be
located in the traffic engineering area at City Hall, including three
workstations, software, hardware, communications interface, and training.
Procurement and installation of eight new traffic signal controllers and
communications equipment for MacArthur Boulevard from San Miguel Drive
to Bison Avenue, for Avocado Avenue at Farallon Drive and San Miguel, and
for San Miguel Drive at San Joaquin Hills Road.
Project 2 consists of the following:
• Procurement and installation of new traffic signal controllers and
communications equipment for the twelve recently- annexed signalized
intersections along Coast Highway from Jamboree Road to Newport Coast
Drive and one new controller for Avocado Avenue at Corporate Plaza.
• Procurement and installation of approximately 22,000 feet of fiber optic
interconnect cable to link the 13 intersections listed above to the central traffic
signal system, including communications equipment at the Central Library;
Project 3 consists of the following:
Procurement and installation of new traffic signal controllers and
communications equipment along the eight signalized intersections of

Newport Coast Drive, San Joaquin Hills Road at Ridge Park Road /Newport
Ridge Drive East, San Joaquin Hills Road at Newport Ridge Drive West, and
Ridge Park Road at the Fire Station.
• Procurement and installation of approximately 19,000 feet of fiber optic
interconnect cable to link the 11 intersections listed above to the central traffic
signal system, including communications equipment at the Newport Coast
Fire Station ( #8).
Submittal Requirements
For both the AHRP and SIP programs OCTA requires a draft copy of the Resolution
(attached) to be included with the application package, along with a confirmation that the
Resolution has been agendized for City Council consideration. A final copy of the
Resolution will be forwarded to OCTA upon adoption.
OCTA's schedule calls for Technical Advisory Committee review of the applications to
begin in February of 2005 and conclude in May, with OCTA Board approval anticipated on
May, 23, 2005.
Once the funding application has been approved by OCTA, the processing of project
advertisement authorization and reimbursement requests will be handled through Caltrans.
SB1346
Applications have been submitted to the California Integraged Waste Management Board
relating to SB 1346 for funding with Rubberized Asphalt Concrete Roadways. SB 1346
provides up to $50,000 per project when recycled tires are used in the paving of roadways as
Rubberized Asphalt Concrete. Newport Beach has had success with this product in recent
projects paving Jamboree Road (Coast Highway to San Joaquin Hills Road and Ford Road
to University Drive) and Balboa Boulevard (various projects between Balboa Village and 27w
Street). Rubberized Asphalt Concrete paving has a slightly higher cost than traditional
Asphalt Concrete, but it has a longer design life and performs at a higher level in arterial
roadways. For these reasons seven projects being submitted for AHRP funding will be
paved with the Rubberized Asphalt Concrete. Five of them qualify for funding as part of SB
1346 and are as follows:

The CIWMB requires a confirmation that a Resolution has been agendized for City Council
consideration. A final copy of the Resolution will be forwarded to the CIWMB upon
adoption.
Environmental Review:
Not applicable at this time. CEQA requirements for each project will be addressed
when they are in design.

RESOLUTION NO. 2005 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING THE SUBMITTAL OF
VARIOUS IMPROVEMENT PROJECTS TO THE ORANGE
COUNTY TRANSPORTATION AUTHORITY FOR FUNDING
UNDER THE COMBINED TRANSPORTATION FUNDING
PROGRAM
WHEREAS, the City Council of the City of Newport Beach, hereby resolves,
determines, and orders as follows that:
WHEREAS, the City Council of the City of Newport Beach desires to
implement the transportation improvements listed below; and
WHEREAS, the City Council of the City of Newport Beach has been
declared by the Orange County Transportation Authority to meet the eligibility
requirements to receive Measure M "turnback" funds; and
WHEREAS, the City's Circulation Element is consistent with the County of
Orange Master Plan of Arterial Highways; and
WHEREAS, the City Council of the City of Newport Beach will provide
matching funds for each project as required by the Orange County Combined
Transportation Funding Program Procedures Manual; and
WHEREAS, the Orange County Transportation Authority intends to allocate
funds for transportation improvements projects within the incorporated cities and County;
and
WHEREAS, the City Council of the City of Newport Beach will not use
Measure M funds to supplant Developer Fees or other commitments; and
WHEREAS, the City Council of the City of Newport Beach will use Arterial
Highway Rehabilitation Funding as a supplement to their existing pavement management
program.
NOW, THEREFORE, be it resolved that the City Council of the City of
Newport Beach hereby requests the Orange County Transportation Authority allocate
funds in the amounts specified in the City's application to City from the Combined
Transportation Funding Programs. Said funds shall be matched by funds from City as
required and shall be used as supplemental funding to aid City in the AHRP- related
improvements of the following streets:
• Hospital Road Rehabilitation from Newport Boulevard to Placentia Avenue,
• Placentia Avenue Rehabilitation from Hospital Road to North City Limits,
• Birch Street Rehabilitation from Bristol Street to McArthur Avenue,
• Jamboree Road Rehabilitation Project from University Drive to Bristol Street,
• Superior Avenue Rehabilitation from Coast Highway To North City Limits
• Jamboree Road Rehabilitation Project from San Joaquin Hills Road to Ford Road
• Bristol Street Rehabilitation from Jamboree Road to Campus /Irvine Avenue
Additionally, said funds shall be matched by funds from City as required and shall
be used as supplemental funding to aid City in the SIP - related improvements of the traffic
signal system, including the following:
• New central traffic signal management system
• Upgraded traffic signal controllers to be Ethernet ready at 29 intersections

• Bring improved traffic signals online with fiber optic communications, including
connection at the Central Library and Fire Station No. 8
• New system and equipment training

RESOLUTION NO. 2005 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING THE APPLICATION TO
THE CALIFORNIA INTEGRATED WASTE MANAGEMENT
BOARD FOR SB 1346 RUBBERIZED ASPHALT
CONCRETE GRANT
WHEREAS, the City Council of the City of Newport Beach desires to
implement the transportation improvements listed below; and
WHEREAS, the Public Resources Code Section (PCS) 42872, authorizes
the California Integrated Waste Management Board ( CIWMB) to establish a grant
program to provide opportunities to divert waste tires from landfill disposal, prevent illegal
tire dumping, and to promote markets for recycled- content waste tire products; and
WHEREAS, the CIWMB has been delegated the responsibility for the
administration of the program within the state, setting up necessary procedures governing
application by individuals, businesses, local governments and research institutions under
the program; and
WHEREAS, said procedures established by the CIWMB require the City to
certify, by resolution, approval of the application before submission of said application to
the State; and
WHEREAS, if awarded a grant, the City will enter into an agreement with
the State of California for development of the projects.
NOW, THEREFORE, be it resolved that the City Council of the City of
Newport Beach authorizes the submittal of an application to the CIWMB for SB 1346
Rubberized Asphalt Concrete Grant. The Public Works Director or his /her designee, of
the City of Newport Beach is hereby authorized and empowered to execute in the name
of the City of Newport Beach all necessary applicants, contracts, agreements,
amendments, and payment requests hereto for the purposes of securing grant funds and
to implement and carry out the purposes specified in the grant application. Said funds
shall be used as supplemental funding to aid City in the improvements of the following
street:
• Birch Street Rehabilitation from Bristol Street to McArthur Avenue,
• Jamboree Road Rehabilitation Project from University Drive to Bristol Street,
• Superior Avenue Rehabilitation from Coast Highway to North City Limits
• Jamboree Road Rehabilitation Project from San Joaquin Hills Road to Ford Road
• Bristol Street Rehabilitation from Jamboree Road to Campus/Irvine Avenue
