SPECIAL CONDITIONS: See pages four to six.
.EXECUTIVE DIRECTOR'S DETERMINATION (continued):
The Executive Director hereby determines that the proposed development is a category of
development, which, pursuant to PRC Section 30624, qualifies for approval by the Executive
Director through the issuance of an Administrative Permit. Subject to Standard and Special
Conditions as attached, said development is in conformity with the provisions of Chapter 3 of the
Coastal Act of 1976 and will not have any significant impacts on the environment within the
meaning of the California Environmental Quality Act. If located between the nearest public road
and the sea, this development is in conformity with the public access and public recreation policies
of Chapter 3.
.FINDINGS FOR EXECUTIVE DIRECTOR'S DETERMINATION:
A. Promect Description
The applicant proposes to remove an existing boat dock and construct a new boat dock. The
proposed dock will include an 8' by 25'float supported by two 12" diameter concrete piles, a 3' by
24' gangway, a 10' by 14' pier platform supported by one 14" diameter concrete "T" pile. The dock
is proposed to be constructed of Douglas fir and "Trex" composite decking and conforms with the
U.S. Pierhead line.
The subject site is located at 3504 Marcus Avenue in Newport Beach, Orange County. The site
fronts on Newport Harbor. The majority of harbor front, residential development in Newport Harbor
is surrounded by private recreational boat docks. The proposed dock project is similar in function
to other docks associated with residential development in the immediate vicinity. The boat dock
will be used solely flor boating recreation purposes. The site has been surveyed by the City of
5-06-219 Reilly
Administrative Permit
Newport Beach Harbor Resources Division for eelgrass and no eelgrass was discovered within 15
feet of the project area. In addition, Special Condition 4 requires a Caulerpataxilfolia survey not
more than 90 days prior to commencement of construction. The surveys a - re valid for a limited
period of time (until the next growing I season for eelgrass and 90 days for Caulerpa taxiffiblia). If
construction does not occur within theresoective' lin 6 periods, subse I queint, I surveys will be
required. Special conditions 3 and 4 identify the procedures necessa . ry to' be completed prior to
beginning construction in case the surveys expire prior to commencement of construction. In
addition, special conditions 3 and 4 identify post -construction eelgrass and Caulerpa taxifolia
procedures.
The nearest public access is located approximately 1/4mile west of the subject site at the public
beach along the Balboa Peninsula. The proposed project has received approval in concept from
the City of Newport Beach (Harbor Permit No. 335-3504). The applicant has applied for approval
of the proposed project from the U.S. Army Corps of Engineers and the California Regional Water
Quality Control Board (RWQCB).
B. Marine Resources
The proposed recreational boat dock development and its associated structures are an allowable
and encouraged marine related use. The project design includes the minimum sized pilings and
the minimum number of pilings necessary for structural stability. There are no feasible less
environmentally damaging alternatives available. As conditioned, the project will not, significantly.
adversely impact eelgrass beds and will not contribute to the dispersal of the invasive aquatic
algae, Caulerpa taxitolia. Further, as proposed and conditioned, the project, which is to be used,
solely for recreational boating purposes, conforms to. Sections 30224 and 30233 of the 'Coastal
Act.
C. Water Qualit
The proposed work will be occurring on, within, or adjacent to coastal waters. The storage or
placement of construction material, debris, or waste in a location where it could be discharged into
coastal waters would result in an adverse effect on the marine environment. To reduce the
potential for construction related impacts on water quality, the Commission imposes special
conditions requiring, but not limited to, the appropriate storage and handling of construction
equipment and materials to minimize the potential of pollutants to enter coastal waters. To reduce
the potential for post -construction impacts to water quality the Commission requires the continued
use and maintenance of post construction BMPs. As conditioned, the Commission finds that the
development conforms to Sections 30230 and 30231 of the Coastal Act.
D. Local Coastal Proararn
The LUP for the City of Newport Beach was effectively certified on May 19, 1982. The certified
LUP was comprehensively updated in October 2005. As conditioned, the proposed development
is consistent with Chapter 3 of the Coastal Act and with the certified Land Use Plan for the area.
Approval of the project, as conditioned, will not prejudice the ability of the local government to
prepare a Local Coastal Program that is in., conformity with the proivisionsof Chapter 3.,
5-06-219 Reilly
Administrative Permit
E. California Environmental Quality Act (CEQA)
As conditioned, there are no feasible alternatives or additional feasible mitigation measures
available that would substantially lessen any significant adverse effect that the activity.may have
on the environment. Therefore, the Commission finds that the proposed project, as conditioned to
mitigate the identified impacts, is the least environmentally damaging. feasible alternative and can
be found consistent with the requirements of the Coastal Act to conform to CEQA.
SPECIAL CONDITIONS:
1. Construction Responsibilities and Debris Removal
(a) No construction materials, equipment, debris, or waste shall be placed or stored where it
may be subject to wave, wind, or rain erosion and dispersion.
(b) Any and all construction material shall be removed from the site within 10 days of
completion of construction.
(c) Machinery or construction materials not essential for project improvements shall not be
allowed at any time in the intertidal zone.
(d) If turbid conditions are generated during construction a silt curtain shall be utilized to control
turbidity.
(e) Floating booms shall be used to contain debris discharged into coastal waters and any
debris discharged shall be removed as soon as possible but no later than the end of each
day.
(f) Non -buoyant debris -discharged into coastal waters shall be recovered by divers as soon as
possible after loss.
2. BEST MANAGEMENT PRACTICES PROGRAM

RE: Harbor Permit 335-3504 for bulkhead bayward of 3504 Marcus Avenue
Dear Mr. August:
The City of Newport Beach Marine Department has been notified by the City Building Department
that the bulkhead bayward of your property is deteriorating and this deterioration, particularly at
high tide, allows water to leak through the bulkhead. This water eventually ends up on City
streets and increases the chances of flooding of private property and creates a threat to public
saf ety.
Section 4.H. of the Harbor Permit Policies states:
4.H. "The Permittee shall keep the structure in good repair at all times. Failure to repair,
when written notice has been given by the Marine Department, shall be cause for revocation of
the permit."
As a result of this condition it will be necessary for you to institute maintenance repairs or
replacement of the existing bulkhead to resolve the above condition. Failure to, make these
repairs couid result in revocation of your Harbor Permit, as stated in Section 17.24.094 of the
Newport Beach Municipal Code which states:
17.24.094(5): Grounds for Revocation. "Any permit heretofore or hereafter granted for
any structure or work in the waters of Newport Harbor or the Pacific Ocean may be revoked by
the City Council if the work or structure has fallen into a state of disrepair."
If you have questions regarding the above or would like to discuss this with me, please contact
me at 644-3044. 1

Re: Harbor Permit #335-3504
Bulkhead Bayward, 3504 Marcus Avenue
Dear Sir:
The City of Newport Beach Marine Division in June 1993 corresponded with the
property owner regarding the deterioration of the bulkhead bayward of the
property at the above address. A copy of the letter is attached for your
information. As of this date we have received no indication that those repairs
have been done. A follow-up inspection by the Marine Division indicate that the
walls are still in a deteriorated condition.
Within the next 45 days, it will be necessary for you to hire an engineer to inspect
the wall, prepare drawings and submit drawings to the billing department for a
building permit. Repairs recommended by your engineer must be completed on
or before December 15, 1996.
Failure to complete these repairs could result in grounds for revocation of the
Harbor Permit as provided by Section 4.H of the Harbor Permit Policies and
Section 17.24.094-5 of the Newport Beach Municipal Code as outlined in the
letter addressed to you of June 22, 1993.
If you have any questions regarding the above or would like to discuss this
further with me, please contact me at 644-3041.

SUBJECT: Deteriorated Wood Bulkhead at 3500, 3502, 3504 Marcus Avenue
DATE: June 16, 1993
In an effort to reduce property loss due to flooding in the City of Newport
Beach, we investigated the causes of flooding in the 3500 block of Marcus Avenue.
On June 11, 1993 Lloyd Dalton from the Public Works Department and I inspected
the bulkhead at the subject addresses and found that the wood bulkhead is
deteriorated and is allowing earth to leak into the channel. Continued earth
leakage will result in the undermining of structural foundations. When high tide
occurs, water leaks through the bulkhead instead of a delayed rise through the
retained earth. This increases the rate of water accumulation in city streets
during rains and high tide when the tide valves have been closed by the General
Services Department. This results in an increased chance of flooding of private
property and creates a threat to public safety.
The worst bulkhead condition was found to exist at 3500 Marcus Avenue where earth
caved behind the bulkhead due to earth leakage to the bay through the
deteriorated bulkhead. Sand bags have been placed behind the bulkhead. However,
it is not an effective method of solving the problem. Since maintenance of the
bulkhead is under your department's authority, please request that the property
owners at the subject sites replace these wood bulkheads in order to protect
their properties and mitigate the causes of flooding in the area.

Dear Wes,
I do-n't know if you can see the Received Stamp dates on the attached Pier Permit Statement,
but they tell us that we only reCeived the bill April, 10, 1995 because it was originally sent to
Glendale Federal Bmik. They, of cotirse, sent it on to us as their Servicer on this property.
No one knew of this account as it ordy bills one time a year and we never got a bill until now.
t
The new people took over the property NovembeT 30, 1994 when ewtow closed. Can the biIJ
be pro -rated for the period until November 30 and the new owners pay the balance since
November 30? We have already paid The, $70,00 Fee for the year -
Also, we would ask that the Past Due Penalty be removed for the above reasons.
Thank, you -
Sincerely!

Mr and Mrs. Dean Vanderall

Dear Mr. and Mrs. Vanderall
A check of the City's Harbor Permit files has revealed that the
permit -for the pier and float at 3504 Marcus Avenue
is still.registered to E. D. Miscione.
As I i-ndicated in my previous letters, a transfer application must
be completed and a transfer fee paid for each time the permit has
changed ownership.
Chapter 17.24.030 of the Municipal Code addresses the transfer of
a permit and reads as follows:
"No person shall transfer a permit for a pier, float'or
similar structure granted under -the provisions of this
chapter without prior written approval of the City.."
Failure to pay the transfer -fees can be grounds for revocation of
the Harbor-Peri-iiit in accordance with Chapter 17.24.090 of the
Municipal Code which reads as follows:
"Grounds for Revocation - Any permit heretofore or hereafter
-fFu—cture or work in the waters of.Newport
granted for any s
Harbor or -the Pacific Ocean may be revoked by the City Council
upon any of the following grounds:
4. The permittee has failed for a period of sixty(60) days
to pay the fee or fees heretofore or hereafter imposed for
the occupancy of tidelands, filled tidelands or submerged lands
upon which such work or structure exists."
Your cooperation in bringing this permit up-to-date will avoid
any further action at this time.
Sincerely,
Glen Welden
