SUBJECT: ORDINANCE AMENDING SECTION 12.40.055 OF THE NEWPORT
BEACH MUNICIPAL CODE TO ALLOW PARKING OF EQUESTRIAN
VEHICLES IN SANTA ANA HEIGHTS
RECOMMENDATION:
Introduce Ordinance No. 2005- amending Section 12.40.055 of the Newport
Beach Municipal Code - Parking of Certain Oversized Vehicles and Nonmotorized
Vehicles in Residential Districts Prohibited.
DISCUSSION:
The new Ordinance would add an exception to the restricted parking or standing of
large motor vehicles in a residential district, specifically allowing the parking of vehicles
involved with the transportation of horses, in the Santa Ana Heights equestrian district,
for a period not to exceed 72 hours. This exception includes any vehicle used for a
variety of equestrian related issues, including detached trailers and other vehicles used
for transporting horses, equipment and feed.
The equestrian community in Santa Ana Heights requested this revision stating that the
current 24 hour parking limit is too restrictive for their activities. The Assistant City
Manager and the Police Department have worked with the community to draft the
proposed revision, which has been reviewed and approved by the City Attorney's office
and the Public Works Department.

ORDINANCE NO. 2005 -
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AMENDING SECTION 12.40.055(G) OF THE
NEWPORT BEACH MUNICIPAL CODE TO ALLOW PARKING OF
EQUESTRIAN VEHICLES IN SANTA ANA HEIGHTS.
The City Council of the City of Newport Beach does hereby ordain as follows:
Section 1: Section 12.40.055(G) of the Newport Beach Municipal Code is
amended adding Subsection 6 which reads:
6. Any motor vehicle or non - motorized vehicle, currently registered and
licensed by the Department of Motor Vehicles, that is parked in the REQ
(SP 7) district of Santa Ana Heights for the express purpose of
loading /unloading or standing for a period not to exceed 72 hours. This
exemption is exclusively for vehicles involved with the transportation of
horses and does not pertain to any commercial vehicle not involved with
the movement and placement of horses.

SECTION 2: The City Clerk shall cause the same to be published once in the
official newspaper of the City, and it shall be effective thirty (30) days after its adoption.
SECTION 3: This Ordinance was introduced at a regular meeting of the City
Council of the City of Newport Beach held on the 8th day of March, 2005, and adopted
on the day of 2005, by the following vote, to wit:
