The City of Newport Beach Marine Department has received a request to transfer
the above Harbor Permit. The facility was inspected by a representative of the
Newport Beach Marine Division on October 24,1996.
We cannot transfer the pier permit until the following has/ have been corrected
and WE HAVE BEEN NOTIFIED OF THE CORRECTION:
1. A City approved anti -syphon device is required at the water connection for
the water supply line serving that pier and float. A sketch showing the approved
type of device and its installation is enclosed. This requirement is in accordance
with Title 17 of the California Administrative Code. It is also required that this
device be tested annually.
The Newport Beach City Council Harbor Permit Policies state:
10.1). "At the time of transfer, all harbor structures shall be inspected for
compliance with the City's minimum plumbing, electrical and structural
requirements, and the conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the permit."

Dear Mr. Lewis:
The Marine Department has sent notices to you regarding the
completion of the required repairs to your pier and float, so
the Pier Permit can be transferred into your name (copies
attached). City Requirements must be met before the permit
can be transferred. Harbor Permit Policies, Section 10.D.:
"At the time of transfer, all harbor structures shall be
inspected for coTpliance with the City's.minimum
plumbing, electrical and structural requirements, and
the conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."
An inspection conducted on February 29, 1992, has found that
the deficiencies indicated in previous correspondence still
exist and you have not complied with the above stated section
of the Harbor Permit Policies. These deficiencies are:
1. A backflow prevention device is required at the water
connection to the float.
2. The electricity to the dock is not up to code. Flex
conduit is needed to make the installation adequate
for marine use. The electrical boxes need cover
plates.
Under Section 17.24.090 of the Municipal Code the Pier Permit
may be revoked for failure to comply with Section 10.D. of
the Harbor Permit policies. If these deficiencies are not
corrected within two weeks from the date on this letter the
matter will be turned over to the City Attorney for further
action.

request was made to transfer pier permit 339-3915 for the property
at 3915 Marcus, Newport Beach. The pier permit at this address was
not transferred for the following reasons:

inspections have not been done.
The Newport Beach Harbor Permit Policies require that the pier
permit be transferred upon the sale of the abutting upland
property. Failure to transfer will result in additional fees and
revocation of the pier permit.

6/12/91.
We cannot transfer the pier permit until the following
deficiency(ies) has/have been corrected and WE HAVE BEEN NOTIFIED

Dear Sir:
A check of the City's Harbor Permit files has revealed that the
permit for the pier and float at 3915 Marcus Avenue, Newport
Beach is registered to ..Addlph Semler. w
A transfer application must be completed and a transfer fee
paid each time the permit has changed ownership.
Chapter 17.24.030 of the Municipal Code addresses the transfer of
a permit and reads as follows:
"No person shall transfer a permit for a pier, float or
similar structure granted under the provisions of this
chapter without prior written approval of the City".
Failure to pay the transfer fees can be grounds for revocation of
the Harbor Permit in accordance with Chapter 17.24.090 of the
Municipal Code.
Your cooperation in bringing this permit up to date will avoid
any action by the City.

Dear Sir:
The City of Newport Beach has received an application to transfer pier permit
# 339-3915for the property located at 3915 Marcus-, Newport Beach.
The structure was inspected on 6/1 . 0/85 at whi'ch time it, was determi'ned
that the following deficiencies exi'st:
1. A backflow prevention deviceJ's required at the water.connection to the
float. Csee enclosed drawi'ng and description).
2. The electricity to the dock is not up to code. Flex line condutt is needed
to make the installation adequate for marine use. The electri"cal
3. boxes need cover plates.

Section 1O.D. of the City Harbor Permi't Poli'cies states:
"At the time Of transfer -all harbor structures, shall be inspected for
compli'ance with the City"s- mi'nimum plumbing, electrical and structural
requirements, and the condi'tions of the existing permit. All structural
defictencies must be corrected prior to transfer of the permi't."
All the above deficiencies, except those noted as ItInformational" must be
corrected before the pfer permit is transferred. Electri,cal or plumbi'ng work
require a permit from the City Bui1ding Department. All other work requires
a permit from the Marine Department. -
Please advise this department when the above defi*ciencies have been corrected.
Another inspection will be made, and -when the problem i's solved the pier permit
will be transferred to the new owner.
