SUBJECT: DECORATIVE CONCRETE PAVERS IN ALLEY — REVISION OF
COUNCIL POLICY L -25
RECOMMENDATION:
1. Adopt Revised City Council Policy L -25 for Decorative Alley Pavement Program.
2. Adopt Revised City STD - 144 -L, Interlocking Concrete Alley Pavers.
DISCUSSION:
On August 24, 2004 the City Council approved Policy L -25 and Standard STD - 144 -L,
which allows residents to upgrade alley improvements with decorative concrete pavers
at their cost. The first project approved utilizing this policy was recently awarded to
Nobest Construction for the Ocean Front alley between G Street and Channel Place.
During the coordination with the residents for the Ocean Front alley project it became
apparent that several clarifications to the Council Policy and Standard Plan would assist
the residents in accomplishing their improvement goals. Attached for Council's
consideration is the revised Policy and Standard Plan. Most of the changes center
around these following issues:
1. Clarifying the type of paver improvements and cost responsibilities.
2. Clarifying the petition circulation process for collecting 60% adjacent property
owner approval for the improvement.
3. Requesting that the residents utilize an escrow account and single point of
contact to collect the funds for the project improvements.
During the discussion with the residents on the Ocean Front alley a considerable
amount of time was spent researching types of pavers that could be utilized on the
project. The proponents contacted several different developers and found locations in
Orange County where decorative concrete pavers were utilized and requested staff to

review their installations. The revised policy places the research burden on the
proponent and also stipulates that `readily" available products are to be utilized.
The petition process for this project also became confusing and generated countless
inquiries from residents questioning the process. The revised policy requires that a
"City" approved petition be circulated which will clearly define the process.
In addition, the original policy required the residents to pay the difference in cost
between a standard alley project and their proposed decorative paver project. To
obtain the exact cost, the City would have to bid alternatives or bid separate projects.
Once the cost was determined, the City would notify the residents giving them 15 days
to provide the necessary funds. Based on our recent experience, it would be virtually
impossible for the residents to collect the funds and provide them within 15 days.
It was also unclear on who collects the funds. At one point, the City was going to act as
an escrow agent for the proponents of the Ocean Front alley. However, the normal City
process for collecting funds could not be utilized. Assessment type collection requires
accurate information with regards to contact name, amount received, address and
phone number. This information would be required in case any funds would have to be
returned either due to the lack of total funding to accomplish the project or if excess
funds were collected. Each resident for the Ocean Front project did not give the same
amount of funds and any excess funds would be returned to them based on a
proportionate amount that was collected. In order to resolve the disproportionate
shares, the Ocean Front alley residents chose an independent escrow agent to collect
funds for the project. The revised policy requires the proponents to identify an escrow
agent or a single person (agent) as point of contact for funding. The policy also
requires the proponent to deposit the funds prior to bidding the project. Any excess
funding will be returned at the completion of the project to the identified single agent for
distribution.
Staff believes these revisions will assist the residents in accomplishing their
improvement goal and will clarify responsibility of the City and proponents.

DECORATIVE CONCRETE PAVERS IN ALLEYS
The City supports the beautification of public alleys by adjacent property owners.
It is the intent of this policy to allow property owners to contribute funds to
enhance the surface of alleys with decorative concrete pavers.
General
A. Installation is permitted in residential and commercial alleys upon approval
offor the Public Works Department. No person shall install decorative
concrete pavers without first obtaining an encroachment permit from the
Public Works Department.
B. All improvements shall conform to Citv Standards and pavers shall
conform to City Standard Drawing STD - 144 -L. The block choice color

and the reeler ^nheme must be approved by the Public Works Department.

schemes that are readilVavailable materials are required.

for alley replacement by the City. If the alley is not scheduled for
replacement, the proponents shall be responsible for all costs associated

D. Upon installation, the City will be responsible for maintenance of the
concrete pavers during the design life of the product (estimated at 20
years). During the maintenance period, every effort shall be made to
match shape and color of replacement pavers. At such time the Public
Works Director determines that the concrete pavers have deteriorated to
an unacceptable condition and /or suitable replacements are unavailable,
the proponents shall be given an opportunity to replace said pavers or the
Public Works Department shall have the option of replacing the alley
pavement with alternative standard materials.
Procedure
A. The Proponents shall appoint a treasurer trustee, escrow agent or fiscal
agent (agent) to collect and record individual property owner contributions
at the property owners expense and notify the City of the appointed agent
in writing.
AB. Proponents must circulate a City provided petition to owners adjacent
to the alley where decorative concrete pavers are
desired. The petition shall include product specifications, color palette,
paver layout pattern, estimated project costs, and expected contribution
amounts. Proponents shall submit samples and manufactures
specifications for review and approval. The petition fnu6t shall be

petition. However, support of the project does not make contribution

CD. Upon certification of the petition, City staff will prepare construction p4 Rs

resurfacing projects to include pavers. At this time the City may require a
non - refundable fee to cover the administration and desian costs of the
project. The desiqn and administration fee can vary between 5 and 15
percent of the anticipated construction cost.and determine estimated

8E. Upon completion of construction documents. the remaininq portion of the

City by the agent in lump sum and deposited in a designated project trust
account. Interest earned on the construction deposit, the roject proceeds
and on any proceeds received in excess of the cost of the project shall

City will obtain bids for the proposed project. If the contributions are
inspection, administration and reasonable contingencies, staff will seek
City Council approval to recognize the contributions, appropriate the
expenditures for the project, award the contract to the successful bidder,
and proceed with construction. Any principal proceeds in excess of the
design, construction and administration of project shall be returned to the
appointed agent after the Public Works Department has accepted the
project, the final retention has been paid and a final accounting of the

NOTES
1. SUB GRADE SHALL BE COMPACTED NATIVE MATERIALS TO AT LEAST 95
PER ASTM D 1557. THE EFFECTIVE DEPTH OF COMPACTION SHALL BE AT
LEAST THE TOP 12 INCHES.
2. THE CONCRETE BASE SHALL BE CLASS 560 -C -3250 P.C.C.
3. PAVERS SHALL ABUT A STRAIGHT EDGE OF EXISTING P.C.C. OR A.C.;
OTHERWISE P.C.C. EDGE RESTRAINTS ARE REQUIRED ALONG THE
PERIMETER OF THE PAVERS. P.C.C. SHALL BE CLASS 560 -C -3250 AND
REINFORCED WITH A CONTINUOUS # 4 BAR AS SHOWN IN THE STANDARD
DRAWING. THE INSIDE FACE OF THE EDGE RESTRAINT SHALL BE VERTICAL.
EDGE RESTRAINTS SHALL HAVE 114 -INCH RADII AT THE TOP CORNERS.
4. THE GRADATION FOR BEDDING SAND SHALL CONFORM TO ASTM C 33 (SEE
TABLE 1).
5. PAVERS SHALL BE CONSTRUCTED WITH CONCRETE AND SHALL CONFORM
TO ASTM C 1272 SPECIFICATION FOR HEAVY VEHICULAR PAVING BRICK.
6. THE MINIMUM PAVER THICKNESS, EXCLUSIVE OF ANY CHAMFERS, SHALL BE
3.15 INCHES (80 MM). THE RATIO OF MAXIMUM PAVER LENGTH TO THICKNESS
SHALL BE LESS THAN 3 TO 1. THE MAXIMUM ALLOWABLE CHAMFER SHALL BE
3/16 INCH.
7. PAVER COLOR AND LAYOUT PATTERN SHALL BE APPROVED BY THE PUBLIC
WORKS DEPARTMENT.
8. PAVER PIECE CUT SMALLER THAN 2 -INCH X 2 -INCH WILL NOT BE ACCEPTED.
9. JOINT SAND SHALL CONFORM TO ASTM C 144 AGGREGATES FOR MASONRY
MORTAR FOR CLEANLINESS AND AGGREGATE SIZE (SEE TABLE 2).
10. TOP OF PAVERS SHALL CONFORM TO FINAL DESIGN ELEVATIONS TO THE
TOLERANCE SPECIFIED BY THE ENGINEER.
11. IF THE LONGITUDINAL FLOWLINE GRADE IN THE ALLEY IS LESS THAN 0.5
PERCENT, THEN A 2 -FOOT WIDE (MINIMUM) GUTTER, 81NCHES THICK, SHALL
BE CONSTRUCTED.
