7031d.5, Business and Professions Code). Any City or County which requires a permit to construct, alter,
improve, demolish, or repair any structure, prior to its issuance, also requires the applicant for such permit
to file a signed statement that he is licensed pursuant to the provision of the Contractors License Law
(Chapter 9, commencing with Section 7000) of Division 3 of the Business and Professions Code) or that
he is exempt therefrom and the basis for the alleged exemption. Any violation of Section 7031.5 by any
applicant for a permit subjects the applicant to a civil penalty for not more than five hundred dollars ($500).

The above mentioned Harbor Permit billing for 1994 reflects the
following:
In February of 1994 the owner was billed for the annual fee of
$65.00. There was a $60.00 adjustment based on a $60.00 penalty
carried over from 1993 and there was a $32.50 penalty assessed at
the time that he made the payment.
His payment in 1994 was $97.50, which included the $65.00 annual
fee and the $32.50 penalty. The $60.00 penalty for 1993 was
carried forward and is still listed as a balance due.
Our records reflect, and the attached documents suggest that the
$60.00 penalty was acutally paid for out of escrow in 1993 when the
harbor permittee acquired the property. As a result of this
confusion, he did not pay the bill because he was waiting for this
to be resolved and as a result incurred the $32.50 penalty.
Therefore, 'we should waive the $60.00 penalty from 1993 and the
$32.50 penalty from 1994. Once these penalties have been waived
this permit should show that there is a zero balance due, and the
harbor permittee should be refunded the $32.50 penalty which he
paid.

Dear Mr. Mullins:
As per our telephone conversation On Wednesday August 10, 1 am writing on
behalf of Mr. Talleur to request a refund of all late penalties that were
charged. Since Mr. Talleur's purchase of this property on October 27, 1993,
I have tried to assist in getting Mr. Talleur a correct bill for his annual
pier permit. On April 6, 1994 (see enclosed attachment) after speaking with
you by telephone previously, I sent you a letter with a copy of the escrow
closing statement, and a billing from the City of Newport Beach that
appeared to be inaccurate.
Mr. Mullins, please refund Mr. Talleur any late payments he has paid as he
and myself both feel we have tried to comply with this billing, but have had
some problems getting this billing corrected.
Should you desire to speak in person with myself or Mr. Talleur, we will
certainly make ourselves available to you.

Each year the City of Newport Beach sends statements to the holders
of pier permits in Newport Harbor notifying them that the annual
pier permit fee is due. Two statements have gone to this address
and have been returned. We conclude, therefore, that the permitee
is not the person or entity shown in our records.
The City Council Harbor Permit Policies state:
10. "Permits for harbor structures are issued subject to the
condition that any improvements constructed shall not be sold in
whole or part, leased, or transferred, without the written consent
of the City"., and
4-C. "The permit is not transferrable without the written consent
of the City of Newport Beach".
10.D. "At the time of transfer, all harbor structures shall be
inspected for compliance with the City's minimum plumbing,
electrical and structural requirements; and the conditions of the
existing permit. All structural deficiencies must be corrected
prior to transfer of the permit."
We enclose "Instructions for Pier Permit Transfer". Please contact
the Marine Department for further advice on transferring the permit
for a pier, if such be necessary. ,If we need only make an address
change, please inform us of the correct address to use.
We call attention to the enclosed statement from the Finance
Department of the City.

at 3311 Finley Avenue, Newport Beach, California
The staff of the State Lands Commission has received your letter
dated November 1, 1982, and copies of the permit drawing relative to
the construction of your client's dock, ramp, and piling in Newport Bay.
This is to advise that any interest the State of California may
have in the tide and submerged lands over which.the proposed project will
extend has been granted in trust to the City of Newport Beach. Therefore,
you need not apply to the State Lands Commission.for project authorization.
You should, however, apply to the City of Newport Beach for any necessary:
permits or approvals. You should also apply to all other agencies having
approval authority.
This action does not constitute, nor shall it be construed as, a
waiver of any right, title, or interest by the State of California in any
lands under its jurisdiction.

EXECUTIVE DIRECTOR'S DETERMINATION
A. Project Description.
The development is in conjunction with an existing single family
dwelling located adjacent to the Rivo Alto Channel.
B. Public Access/Certified Land Use Plan Consisting.
PUBLIC ACCESS
Section 30210.
In carrying out the requirement of Section 4 of
Article X of the California Constitution, maximum access,
which shall be conspicuously posted, and recreational
opportunities shall be provided for all the people
consistent with public safety needs and the need to protect
public rights, rights of private property owners, and
natural resource areas from overuse.
Section 30211.
Development shall not interfere with the public's right
of access to the sea where acquired through use or
legislative authorization, including, but not limited to,
the use of dry sand and rocky coastal beaches to the first
line of.terrestrial vegetation.
Section 30212.
(a) Public access from the nearest public roadway to the
shoreline and along the coast shall be provided innew
development projects except where (1) it is inconsistent
with public safety, military security needs, or the
protection of fragile coastal resources, (2) adequate access
exists nearby, or (3) agriculture would be adversely
affected. Dedicated accessway shall not be required to be
opened to public use until a public agency or private
association agrees to accept responsibility for maintenance
and liability of the accessway.
Public vertici-&-access to the Rivo Alto is by way of the street
ends in the area. The proposed development is located midway
between the ends of 34th. street and Clubhouse Avenue (see
exhibit 1) approximately 8r., ft. to the east and weM. The
Executive Director determines thatadequate verticle — access
exists nearby.
A policy relating to public lateral access appears on page
9(a) of the Certified Land Use Plan which states that lateral
access easements are not required "in -established existing
residential subdivisions where no sandy beach exists".
The waterside parcels in the area are adjacent -to an existing
bulkhead seaward of which no sandy beach exists. The.
Executive Director determines that public lateral access is
therefore not required and further, Vhat the proposed development
is consistent with the access policies of the Certified Land
Use Plan and Chapter 3 of the California Coastal'Act.

and the first public road nearest the shoreline and is in conformance
with the public access and Public recreation policies of Chapter 3 of
the Coastal Act, and will not have any significant adverse impacts on
the environmen4C within the meaning of the California Environmental
Quality Act.
1. STA14DARD CONDITIONS
1. Notice of Receipt and Acknowledgement. The permit is not valid
and construction shall not commence until a copy of the permit, signed
by the permittee or authorized agent, acknowledging receipt of the
permit and acceptance of the terms and conditions, is returned to the
Commission office.
2. Expiration. If construction has not commenced, the permit will
expire two years from the date on which the Commission voted on the
application. Construction shall be pursued in a diligent manner and
completed in a reasonable period of time. Application for extenstion
of the permit must be made prior to the expiration date.
3. �99mpliance. All construction must occ ur in strict compliance with
the propos s set forth in the application for permit, subject to
any special conditions set forth below. Any deviation from the approved
plans must. be reviewed and approved by the staff and may require Commission -
approval.
4. Interpretation. Any questions of intent or interpretation of any
condition will be resolved by the Executive Director or the Commission.
5. Inspections. The Commission staff shall be allowed to inspect
the site anT_t"Fe development during construction, subject tc 24-hour
advance notice..
6 Assi Ment. The permit may be assigned to any qualified person,
pio e ass gnee files with the Commission an affadavit accepting all
terms and conditions of the permit.
7. Terms and Conditions Run with the Land. These terms and conditions
shall be perpetual, and it is the inten-tIo-n of the Commission and the
permittee to bind all future owners and possessors of the subject
property to the terms and conditions.
