Contractor's Signature Date: September 15, 1994 TO: EMMA BELLO, FINANCE DEPARTMENT FROM: Marine Department SUBJECT: HARBOR PERMIT 433-3311 The above mentioned Harbor Permit billing for 1994 reflects the following: In February of 1994 the owner was billed for the annual fee of $65.00. There was a $60.00 adjustment based on a $60.00 penalty carried over from 1993 and there was a $32.50 penalty assessed at the time that he made the payment. His payment in 1994 was $97.50, which included the $65.00 annual fee and the $32.50 penalty. The $60.00 penalty for 1993 was carried forward and is still listed as a balance due. Our records reflect, and the attached documents suggest that the $60.00 penalty was acutally paid for out of escrow in 1993 when the harbor permittee acquired the property. As a result of this confusion, he did not pay the bill because he was waiting for this to be resolved and as a result incurred the $32.50 penalty. Therefore, 'we should waive the $60.00 penalty from 1993 and the $32.50 penalty from 1994. Once these penalties have been waived this permit should show that there is a zero balance due, and the harbor permittee should be refunded the $32.50 penalty which he paid. The development is in conjunction with an existing single family dwelling located adjacent to the Rivo Alto Channel. B. Public Access/Certified Land Use Plan Consisting. PUBLIC ACCESS Section 30210. In carrying out the requirement of Section 4 of Article X of the California Constitution, maximum access, which shall be conspicuously posted, and recreational opportunities shall be provided for all the people consistent with public safety needs and the need to protect public rights, rights of private property owners, and natural resource areas from overuse. Section 30211. Development shall not interfere with the public's right of access to the sea where acquired through use or legislative authorization, including, but not limited to, the use of dry sand and rocky coastal beaches to the first line of.terrestrial vegetation. Section 30212. (a) Public access from the nearest public roadway to the shoreline and along the coast shall be provided innew development projects except where (1) it is inconsistent with public safety, military security needs, or the protection of fragile coastal resources, (2) adequate access exists nearby, or (3) agriculture would be adversely affected. Dedicated accessway shall not be required to be opened to public use until a public agency or private association agrees to accept responsibility for maintenance and liability of the accessway. Public vertici-&-access to the Rivo Alto is by way of the street ends in the area. The proposed development is located midway between the ends of 34th. street and Clubhouse Avenue (see exhibit 1) approximately 8r., ft. to the east and weM. The Executive Director determines thatadequate verticle — access exists nearby. A policy relating to public lateral access appears on page 9(a) of the Certified Land Use Plan which states that lateral access easements are not required "in -established existing residential subdivisions where no sandy beach exists". The waterside parcels in the area are adjacent -to an existing bulkhead seaward of which no sandy beach exists. The. Executive Director determines that public lateral access is therefore not required and further, Vhat the proposed development is consistent with the access policies of the Certified Land Use Plan and Chapter 3 of the California Coastal'Act. Expiration. If construction has not commenced, the permit will expire two years from the date on which the Commission voted on the application. Construction shall be pursued in a diligent manner and completed in a reasonable period of time. Application for extenstion of the permit must be made prior to the expiration date. 3. �99mpliance. All construction must occ ur in strict compliance with the propos s set forth in the application for permit, subject to any special conditions set forth below. Any deviation from the approved plans must. be reviewed and approved by the staff and may require Commission - approval. 4. Interpretation. Any questions of intent or interpretation of any condition will be resolved by the Executive Director or the Commission. 5. Inspections. The Commission staff shall be allowed to inspect the site anT_t"Fe development during construction, subject tc 24-hour advance notice.. 6 Assi Ment. The permit may be assigned to any qualified person, pio e ass gnee files with the Commission an affadavit accepting all terms and conditions of the permit. 7. Terms and Conditions Run with the Land.
