Dear Ms. Mclntee
I am responding to your call today with this letter because you did not leave
your phone number with your message and your number was not listed with the
information operator.
From your message, I understand that you may have an encroachment dispute
with one of your neighbors. However, I was not exactly clear with all of the
details of your message.
For reference, I have copied the section of the Harbor Permit Policies that applies
to encroachment for your review. This can also be referenced on the City's
website under City Council / Council Policy Manual / Harbor Permit Policies.
"Boats moored at private or public docks shall not extend beyond the
projection of the property lines of the property to which the dock facility
is connected in accordance with section 20-C."
Therefore, if your neighbor's boat extends upon your property lines, then they
would be encroaching. I would be happy to inspect this dispute from the water
if you are unable to settle the matter yourself with your neighbor.

RE: Encroachment Across Mutual Property Line
Dear Ms. Benson and Ms. McIntee,
A recent field inspection has revealed that there are two vessels on both of your docks
that are extending beyond the projection of the property lines into both of your
properties. In other words, the Duffy that is docked at 503 36th St. is extending beyond
the property line while the small power boat's stern, docked at 501 36th St. is also
extending beyond the property line. This is in violation of the Newport Beach Harbor
Permit Policies: Moorings, A, which states:
"'Boats moored at private or public docks shall not extend beyond the projection
of the property lines of the property to which the dock facility is connected in
accordance with section 20-C."
This letter is to advise you that unless you relocate your vessels immediately (by
Sunday, August 24, 2003), or position them in such a way as they do not extend beyond
the property line, an Administrative Citation may be issued and penalties will begin to
accrue ($100, $200, $500 increments). Your cooperation will be greatly appreciated in
this matter. Due to the fact that both boats are rubbing against each other and that
personal property damage may occur, it is imperative these boats be moved
immediately.
Please see the attached picture of the infraction. If you have any questions regarding
the enforcement of the Harbor Permit Policies, please feel free to give me a call.
