Please note that the eelgrass and Caulerpa taxifolia surveys completed are only valid for a limited time period and that additional surveys must be completed and submitted to Commission staff for review if the proposed dock projects listed above do not commence prior to expiration of the initial survey. In addition, please note that this authorization shall expire on October 23, 2009 and that all authorized work must be completed prior to that date. Finally, please note there are ongoing obligations relative to water quality protection established in the authorization which must be implemented for the entire life of the approved development. Please be advised that only the projects described in the materials submitted for the sites listed above have been found to conform with Consistency Certification CC -031-06 and/or conform with the terms and conditions of Coastal Development Permit 5-06-117. Any change in the projects may cause them to lose their status as consistent with CC -031-06 and/or CDP 5-06-117. This certification is based on information provided by the City of Newport Beach. If, at a later date, this information is found to be incorrect or incomplete, this letter will become invalid, and any development occurring at that time must cease until a new determination regarding conformance with CC -031-06 and/or CDP 5-06-117, is obtained. This project is a like for like replacement so will not require an eelgrass inspection because it does not create any new shading. There is no harbor bottom disturbing activity either, such as pile replacement, so it will not require a Caulerpa taxifolia survey. Water Quality Control Board notification will not be necessary as well, because this activity does not result in any discharge or fill. Box 532711 Los Angeles, CA 90053-2325 GENERAL CERTIFICATION FOR REPLACEMENT OF SHEET PILES AND DOCK PILES SUBJECT TO NATIONWIDE PERMIT 3 AND/OR SECTION 10 OF THE RIVERS AND HARBORS ACT Dear Mr. Durham: Clean Water Act (CWA) Section 401 states, in pertinent part, that, "Any applicant for a Federal license or permit to conduct any activity including, but not limited to, the construction or operation of facilities, which may result in anydischarge into the navigable waters, shall provide the licensing or permitting agency a certification from the State in which the discharge originates or will originate." Regional and State Board staff believe that CWA Section 401 is not limited to Federally regulated activities under CWA Section 404, but includes any Federally regulated activity which may result in a discharge to navigable waters. Consequently, the Regional Board issues CWA Section 401 Water Quality Standards Certifications (Certifications) for activities resulting in discharges of dredge or fill subject to CWA Section 404 and some activities regulated under Section 10 of the Rivers and Harbors Act (RHA). In inundated conditions, hydro -jetting is typically employed whereas in dry conditions, typical excavation. techniques are employed but bed materials are generally returned to their original location and the original bottom elevations are maintained. As outlined, this General Certification applies to a subset of activities authorized by the U.S. Army Corps of Engineers Nationwide Permit 3 and/or Section 10 of RHA and does not necessarily certify all activities authorized by Federal permits or licenses issued thereunder.
