SUBJECT: IRVINE AVENUE WIDENING, MESA DRIVE TO BRISTOL STREET -
RESOLUTION DECLARING PORTIONS OF IRVINE AVENUE, MESA
DRIVE, AND ORCHARD DRIVE TO BE COUNTY HIGHWAYS FOR
RIGHT -OF -WAY CONSTRUCTION PURPOSES, C -3653
RECOMMENDATION:
Adopt Resolution No. 2005 - declaring portions of Irvine Avenue, Mesa Drive, and
Orchard Drive from University Drive to SE Bristol Street to be County highways during
the right -of -way acquisition and construction of the project.
DISCUSSION:
Currently, the County of Orange is designing the roadway improvements for the
widening of Irvine Avenue from south of Mesa Drive to SE Bristol Street. In addition,
the project's Negative Declaration IP 02 -129 was recently certified by the Board of
Supervisors. The County's next phase is to prepare right -of -way documents and
acquire the needed land for construction of the six -lane divided arterial highway from
Mesa Drive to SE Bristol Street.
As the lead agency for the project, the County requires that the City Council adopt a
Resolution declaring the portions of the project within the City's limits to be County
highways during the right -of -way acquisition and construction of the improvements
pursuant to the Streets and Highways Code. This allows the County to conduct their
various activities within the City's boundaries. Construction is planned to start in Fiscal
Year 2006 -07. The Board of Supervisors passed Resolution No. 05 -043 on March 8,
2005 declaring the project's streets within the City limits to be County highways. The
County's Resolution will then take effect upon the passage of the City's Resolution.
The Resolution will sunset upon completion of the work.

Environmental Review:
Negative Declaration IP 02 -129 was prepared by the County and was certified by the
Board of Supervisors on March 8, 2005.
Funding Availabilityi
The City and the County will be funding their respective costs to match the $1.4 million
secured from the Competitive Measure M program, Preliminary construction costs are
estimated to be $ 3.2 million and right -of -way is estimated at $ 360,000.

RESOLUTION NO. 2005 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH FOR THE DECLARATION OF
PORTIONS OF IRVINE AVENUE, MESA DRIVE, AND
ORCHARD DRIVE WITHIN THE CITY OF NEWPORT
BEACH TO BE COUNTY HIGHWAYS
WHEREAS, those portions of Irvine Avenue, Mesa Drive, and Orchard from
University Drive to SE Bristol Street lying within the City limits of the City of Newport
Beach are deemed to be a highways of County -wide importance; and
WHEREAS, the County of Orange proposes to acquire right -of -way and to
construct roadway widening improvements along Irvine Avenue, Mesa Drive, and
Orchard Drive, portions of which are now annexed within the City of Newport Beach; and
WHEREAS, by Board of Supervisors Resolution No. 05 -043 dated March 8,
2005, the County declared all those portions of Irvine Avenue, Mesa Drive, and Orchard
Drive between University Drive and SE Bristol Street lying within the City Limits of
Newport Beach to be County highways during the right -of- way acquisition and
construction improvements to said road by the County of Orange, for those purposes; and
WHEREAS, the City of Newport Beach concurs with said improvements to
all those portions of Irvine Avenue, Mesa Drive, and Orchard Drive between University
Drive and SE Bristol Street lying within the City Limits of Newport Beach and desires to
consent to the establishment of said County highways during the period of said right -of-
way acquisition and construction improvements.
NOW, THEREFORE, be it resolved and ordered that pursuant to the
provisions of Section 1701, Article 3, Chapter 9, Division 2 of the Streets and Highways
Code, the City of Newport Beach does concur with Orange County Board of Supervisors
Resolution No. 05 -043 dated March 8, 2005, declaring those portions of Irvine Avenue,
Mesa Drive, and Orchard Drive between University Drive and SE Bristol Street lying
within the City Limits of Newport Beach to be County highways during the period of right
of way acquisition and construction improvements by the County of Orange.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and
directed to transmit to the Board of Supervisors of the County of Orange a certified copy
of this Resolution.
