Michael Veal Coastal Development Permit 5-05-146, subject to the attached Standard
and Special Conditions, for development consisting of:
Demolition of an existing single-family residence and construction of a new
bayfronting 2,410 square foot, 26 feet high, two-story single-family

Reference is made to your request (No. 200600792-SJH) dated February 15, 2006, for
Department of the Army authorization to temporarily discharge fill into 0.012 -acre of open
waters of the United States. Discharge is associated with the like -for -like seawall replacement
bayward of �714 Charmel Place, within Newport Bay, in the City of Newport Beach, Orange
County, California.
While this activity meets the general terms and conditions for authorization under
Nationwide Permit Number 03 [Federal Register, January 15, 2002, pp. 2020-2095], we note that
you do not have Coastal Zone Management (CZM) consistency certification from the California
Coastal Commission. Therefore, your request is denied without prejudice. You will receive
authorization from the Corps when you have met the requirements outlined below.
CZM consistency certification, pursuant to section 307 of the Coastal Zone Management
Act, 0'r waiver thereof, is required prior to authorization of your project. You must therefore
obtain CZM consistency certification or waiver, or provide evidence that 6 months have passed
since you applied to the California Coastal Commission for CZM certification. Be aware that
any conditions on your CZM certification will become conditions on your Nationwide Permit
authorization.
When you receive your CZN4 consistency certification or waiver (or when 6 months have
passed since you applied), you should contact the Corps Project Manager for this project,
Stephanie J. Hall, at (213) 452-3410. Please reference application 200600792-SJH in your letter.
Your authorization could then be issued without further delay or processing.

marina, that are required to be conducted under federal or state permits and authorizations

U.S.C. 403) and Section 404 of the Clean Water Act of 1972 (33 U.S.C. 1344) over your proposal

The Corps of Engineers has determined your proposed activity complies with the terms
and conditions of Nationwide Permit Number 3: Maintenance (Sections 10 & 404) as described
in enclosure I -
Furthermore, you must comply with the following non -discretionary Special
Conditions:

1. The permitted activity shall not interfere with the right of the public to free navigation on all
navigable waters of the United States as defined by 33 C.F.R. Part 329.
2. Creosote treated pilings shall not be placed in navigable waters unless all of the following
conditions are met:
A) The project involves the repair of existing structures that were originally
constructed using wood products;
B) The creosote treated pilings are wrapped in plastic;
C) Measures are taken to prevent damage to plastic wrapping from boat use. Such
measures may include installation of rub strips or bumpers;
D) The plastic wrapping is sealed at all joints to prevent leakage; and
E) The plastic material is expected to maintain its integrity for at least ten years, and

The following is in response to the California Coastal Commission letter dated May 12, 2005.

Our responses are as follows:
QUESTION: Is the existing seawall1bulkhead adequate to support the proposed residence for its
expected life (Approximately 50 years)?
ANSWER: The existing seawall is composed of cast -in-place concrete with four courses of
bricks on top. Our study finds the wall over -stressed, unstable and not meeting
today's code and the City of Newport Beach requirements. It needs to be
replaced. The proposed seawall will consist of precast concrete sheet piles,
continuous concrete coping tied with steel tie -backs to a continuous concrete
deadman.
Please see drawings S-0 & S-1 prepared by our office.
The life expectancy for this kind of seawall shall be equal to or longer than the
expected life of the proposed residence. However, if in the future the proposed
bulkhead displays any signs of distress, it should be repaired or replaced.
QUESTION: Could the seawall be removed? Could the seawall be relocated landward of the
existing location?
ANSWER: No, this would cause damage to the neighboring properties and would preclude
tn
building on the site. If the seawall was relocated landward this would cause a
discontinuity as the wall is continuous along the same aligm-nent for several
properties and would cause damage to the neighbor's properties, the environment,
and would considerably decrease the size of the yard.
QUESTION: Do the adjacent properties have seawalls? If so, please indicate the location of
any adjacent seawalls in relation to the subject property's seawall on the project
plans.
ANSWER: Yes, the adjacent properties have seawalls. These walls are continuous along the
same alignment and cover several houses plus the City street end. Please see
drawing S-1 prepared by our office.

The above referenced application was received in this office on April 14, 2005. Review of
the application submittal reveals that additional information is necessary to adequately
analyze the project. Therefore, the application has been deemed incomplete. Please
submit the following additional information which is necessary to complete the application.

Becausd the proposed project includes demolition of the existing residence, this appears
to be the best time to evaluate the expected life of the seawall. . Please provide an
Engineer's Assessment regarding the seawall, including, but not limited to, the following
information:
Is the existing seawall/bulkhead adequate to support the proposed residence for it
expected life (approximately 50 years)? If not, what is the expected life of the
exiting seawall? Are any measu I res % ' necessary to assure the competency of the
seawall? Please'include any necessary modifications to the seawall as part of the
proposed project's written description, as well as on the project plans.
• Could the seawall be removed (i.e. is the proposed home dependent on the
seawall)? Could the seawall be relocated landward of the existing location?
• Do the adjacent properties have. seawalls? If so, please indicate the location of any
adjacent seawalls in relation to the subject property's seawall on the project plans.

Water Qualit
Please submit landscape/hardscape and drainage plans. These plans should indicate
that, to the maximum extent feasible, runoff from the site W:ill be retained on site and
directed to pervious areas and that any runoff that does leave the site is treated (i.e.
filtered) prior to leaving the site. The plans should indicate that pervious areas on site are
maximized. This can be accomplished by, for example, using gravel and stepping stones
in yard areas, rather than concrete. I Please note that the use of invasive plants is
prohibited.
Also, please describe water quality measures (Best Management Practices) that will be
applied during construction. These may include placement of sandbags, and/or directing
drainage to an on-site depression during construction.
Increasing the pervious area maximizes infiltration of on-site drainage, which in turn
decreases the amount of untreated runoff entering the storm drain system. Filtering runoff
that must leave the site can be accomplished by means such as: directing runoff to
landscaped areas; use of a permanent on-site detention basin; and/or use of a
"bottomless" area drain which allows run-off to be absorbed into the ground. The goal of
these measures is to increase water quality in the harbor and ocean, by redlucing and
filtering the runoff that enters the storm drain system which ultimately empties into the
harbor and ocean. Although runoff from a single residence may not seem consequential,
the cumulative effects of each residence have a great effect on overall water quality

plans submitted in response to this letter, so that they may be included in the staff report.
Once the additional information has been received in this office and the application has

The above dock was inspected by The Harbor Resources Division of the City of
Newport Beach at the property mentioned above on April 18, 2003.
We cannot transfer the pier permit until the following deficiencies have been corrected
and the property has been re -inspected:
1. It either needs a new anti -siphon device installed or the water line to the dock removed.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures shall be inspected for
compliance with the City's minimum plumbing, electrical and structural
requirements, and the conditions of the existing permit. All structural deficiencies
must be corrected prior to transfer of the permit."
Please call 644-3034 to request a re -inspection. Once the property has passed
inspection the dock will be transferred.

The City of Newport Beach Pier Permit for the Pier and dock -at 3714 Channel
Place, Newport Beach is in the name of Richard -Giles. In checking the
City/ County records it appears that you receive correspondence and bills for this
property. Are you the current owner? If yes, it is very important that you
contact this office as soon as possible (949-644-3044). If you are not, please assist
us in locating the property owner by providing us with the their name and
current mailing address.
At the time a bay front property changes ownership, the City of Newport Beach
Municipal Code requires a transfers of the harbor permit from the seller to the
buyer. This process should be completed within 30 days from the close of
escrow. Sometimes the seller and/or the buyer are unaware of this requirement.
However once notified, compliance is required within a reasonable time to avoid
an administrative citation and or penalties to the normal transfer fee. Failure to
transfer within 30 days of notification will result in an additional charge of
$70.00 per month.
Your assistance in this matter will be greatly appreciated.

A check of the City's Harbor Permit files has revealed that the
permit for the pier and float at 3714 Channel Place, Newport
Beach is registered to R.P. Maskey.
A transfer application must be completed and a transfer fee
paid each time the permit has changed ownership. i
Chapter 17.24.030 of the Municipal Code addresses the transfer of
a permit and reads as follows:
"No person shall transfer a permit for a pier, float or
similar structure granted under the provisions of this
chapter without prior written approval of the City".
Failure to pay the transfer fees can be grounds for revocation of'
the Harbor Permit in accordance with Chapter 17,24.090 of the
Municipal Code.
Your cooperation in bringing this permit up to date will avoid
any action by the City.
