SUBJECT: CONTINUE PUBLIC HEARING FOR PROPOSED UNDERGROUND
UTILITIES DISTRICT NO. 19 SANTA ANA HEIGHTS — MESA DRIVE,
CYPRESS STREET AND A PORTION OF ORCHARD DRIVE
RECOMMENDATION:
Continue Public Hearing for the proposed Underground Assessment District No. 19,
Santa Ana Heights, until June 14, 2005 to allow for noticing of a Public Hearing and
presentation of revised Engineer's Report.
DISCUSSION:
A Public Hearing was originally scheduled for January 11, 2005 to decide whether to form
an Underground Utilities District (UUD). The Hearing was continued until April 26, 2005
because of a legal and policy disagreement between the County of Orange's
redevelopment counsel and our Special Counsel's opinion about the use of
redevelopment funds for private property utility hook -ups. Currently, both counsels, the
City Managers office, Council Member Daigle, and Supervisor Silva are in agreement on
how to proceed with the formation and funding of this UUD.
Staff recommends continuing the Public Hearing until June 14, 2005 so that property
notice of the Public Hearing can be given.
Environmental Review:
A Notice of Exemption was completed October 22, 2004, and filed with the County
Recorder on October 29, 2004. A Certificate of Environmental Proceedings was
completed on November 9, 2004.
