Dear Mr. Poleshuk:
Reference is made; to your application, dated February S, 2011, fur a Department of
the Army (DA) permit to construct a 6 -foot by 4.5 -foot deck with associated 3 -foot by 12 -
inch stair case, located just seaward of the existing seawall at 319 Crand Canal, Newport
Beach, Orange County, California (see- attached figure).
Specifically, yoo are authorized to:
1. Construct a 6-fopt by 4.5 -foot deck with associated 3 -foot by 12 -inch stair case,
composed of Douglas fir, composite decking, and stainless steel hardware. The
deck and staircase will be constructed off-site and unloaded on dry land at the
project site
2. Install the deck and stair case at low tide, including manually hammering into
place the wood support beams.
The owner or autl}orized responsible official must sign and date all copies of this
Letter of Permission (LQP) indicating that he/she agrees to the work as described and will
comply with all.conditio�ps. One of the signed copies of this Letter of Permission must be
returned to the Corps of Engineers. In addition, please use the two attached notification
forms to notify this office as to the dates of commencement (within 10 days prior to the
start of construction) and completion of the activity (within 10 days following the end of
construction).
Furthermoze, you ,gre hereby advised that the Corps of Engineers has established an
Administrative Appeal process which is fully described in 33 CFR Part 331. The complete
appeal process is outlined in the enclosed diagram "Notification of administrative appeal
options and process and! recluest for appeal."

Dear Mr. Swift,
Attached is the Preliminary Eelgrass (Zostera marina) Survey as well as a Caulerpa Survey
Reporting Form for a dock replacement project at 319 Grand Canal, Newport Beach. No
Caulerpa was observed, but two small patches of eelgrass were found at the site. However,
this4eelgr@iss_is greater than 15 feet from the construction site, - no impact on eelgrass is
anticipated. Since the deck can be placed on dry land during low tide, we recommend that a
land-based silt curtain be placed between the deck and the water, in case any sand is
disturbed during the platform placement. Other best management practices (BMPs) may
include avoiding direct contact by equipment, and unused equipment (dock materials, floats,
boats, etc.) should be left where the eelgrass bed will not be shaded, which can also cause
impact during construction. A Post -Construction survey will be conducted within 30 days of
project completion to determine whether there were direct or indirect impacts on the eelgrass.
This Preliminary Eelgrass Report was required in accordance with the Southern California
Eelgrass Mitigation Policy (SCEMP) since eelgrass is widely distributed throughout Newport
Bay. This policy protects an important marine habitat, seagrass beds, which provide habitat
and food for adult and juvenile marinelife such as halibut, lobster, seabirds and even
endangered sea turtles.
Responsible development by contractors like you help to protect these sensitive marine
ecosystems here in southern California, contributing to the greater challenge of protecting our

Introduction
The homeowners at 319 Grand Canal, Newport Beach have proposed to place a deck near a
seawall to access their moored boat. No pile removal or driving will be required.
This survey was conducted to determine the presence or absence of the invasive Caulerpa
sp., and to survey for and map the extent of eelgrass, Zostera marina, in the vicinity of the
property lines. Please refer to additional documents submitted by Swift Slips for more
information regarding the proposed platform.

Discussion
No Caulerpa was observed, but two small patches of eelgrass were found within the survey
area. However, these patches of eelgrass were greater than 15 feet from the construction site,
so no impact on eelgrass is anticipated. Since the deck is being placed in an area that is not
always submerged, we recommend that construction be conducted during low tide and that a
land-based silt curtain be placed between the deck and the water, in case any sand is
disturbed during the deck placement. Other best management practices (BMPs) may include
avoiding direct contact by equipment, and unused equipment (dock materials, floats, boats,
etc.) should be left where the eelgrass bed will not be shaded, which can also cause impact
during construction.
A Post -Construction Eelgrass Survey, conducted within 30 days of construction completion,
will assess the effectiveness of BMPs in minimizing direct impact caused by the work. We do
not foresee any long-term shading effects on the eelgrass patches.

This form is required to be submitted for any surveys conducted for the invasive exotic alga Caulerpa
taxifolia that are required to be conducted under federal or state permits and authorizations issued by the
U.S. Army Corps of Engineers or Regional Water Quality Control Boards (Regions 8 & 9). The form has
been designed to assist in controlling the costs of reporting while ensuring that the required information
necessary to identify and control any potential impacts of the authorized actions on the spread of
Caulerpa. Surveys required to be conducted for this species are subject to modification through
publication of revisions to the Caulerpa survey policy. It is incumbent upon the authorized permittee to

reconfigure or modify the dock system or bulkhead, the following conditions will now be in
effect:
1. The project proponent is aware of the Harbor Permit Policies (Council Policy H-1) and Title
17 of the City of Newport Beach Municipal Code. The project proponent understands that the
above referenced structure(s) is under the purview of these Policies and Codes.
2. Any future work on the above mentioned structure(s) requires permits with the City of
Newport Beach and any other applicable agencies. Painting and work considered to be
cosmetic in nature does not require a permit.
3. The conditions set forth in this document pertain to the proposed dock system and/or
bulkhead under consideration. Any future modifications or alterations to the dock system
and/or bulkhead may require new conditions which may override or change these conditions.
These conditions supersede all past conditions associated with this property.
4. Only marine oriented uses are allowed on the pier, pier platform, gangway and float. Patio
furniture, plants etc ... are not permitted.
5. In accordance with Municipal Code 10.08.030 A. the project proponent shall obtain the
proper permits for equipment and materials storage. "Except as otherwise provided in this
section, no person shall use any public street, sidewalk, alley or parkway or other public
property for the purpose of storing or displaying any equipment, materials or merchandise, or
any other commercial purpose. B. Public streets, sidewalks, alleys, or parkways may be used
for the purpose of selling, storing, or displaying any equipment, material, merchandise or for
other commercial purposes in the following cases: ... For the temporary storage of construction
equipment or material provided a permit is issued pursuant to Chapter 12.62 of this Code and
the storage is consistent with provisions of the Uniform Building Code."

Land Use Plan.

7. In accordance with Municipal Code 10.28.040 the following noise regulations apply: "A.
Weekdays and Saturdays. No person shall, while engaged in construction, remodeling, digging,
grading, demolition, painting, plastering or any other related building activity, operate any tool,
equipment or machine in a manner which produces loud noise that disturbs, or could disturb, a
person of normal sensitivity who works or resides in the vicinity, on any weekday except
between the hours of seven a.m. and six -thirty p.m., nor on any Saturday except between the
hours of eight a.m. and six p.m. B. Sundays and Holidays. No person shall, while engaged in
construction, remodeling, digging, grading, demolition, painting, plastering or any other related
building activity, operate any tool, equipment or machine in a manner which produces loud
noise that disturbs, or could disturb, a person of normal sensitivity who works or resides in the
vicinity, on any Sunday or any federal holiday."
8. Your side property lines extend in the water along their same bearing. Vessels shall
not encroach upon the neighbor's property on either side.
9. Vessels may not extend beyond the end of the fingers by more than the width of its
beam.

7. In accordance with Municipal Code 10.28.040 the following noise regulations apply: "A.

grading, demolition, painting, plastering or any other related building activity, operate any tool,
equipment or machine in a manner which produces loud noise that disturbs, or could disturb, a
person of normal sensitivity who works or resides in the vicinity, on any weekday except

Dear Lt. Milewski:
The subject vessel was first noticed by me on Saturday, July
23 when I visited my house on the adjoining property at 321 Grand
Canal. Telephone calls were then made to Orange County
Sheriff -Harbor Patrol -Moorings (834-2654) and Newport City Marine
Department -Lifeguard Section (644-3044). Duty personnel at those
offices advised me to call back the following Monday, July 25,
which I did.
Telephone conversations on July 25 and 28 with Tony Melum,
Tidelands Administrator of the City of Newport Beach revealed the
name and address of the vessel's registered owner to be Justin
Stallcup of 209 Opal St, Balboa Island (which was confirmed by a
letter) .
Telephone conversations with you on July 25 concluded with
your offer to remove the vessel within an hour if I would then
write a note.stating that neither I nor any agent or employee of
mine had given permission for this mooring; and with my statement
that I would investigate to make sure and would write you a
letter about the matter.
Subsequent interviews with each of my employees and guests
confirmed the truth of my statement to you that neither I nor any
of them has ever given anyone permission to moor any boat or
vessel at 321 Grand Canal or the adjoining vacant lot at 319
Grand Canal both of which properties are owned by me.
Attempts were also made by me to resolve the matter by
friendly contact. At my request one of my guests Toni
Gussenhoven, personally went to the owner's address on the
evening of July 27 and reported that although all lights in the
house were on no one answered the door. Again at my request the
next morning another guest, Albert Gussenhoven, went to the
owner's address and talked to a woman who identified herself as
Karen Stallcup the mother of the owner of the vessel and
represented that the vessel would be removed from said premises
on "the weekend" of July 30-31.
On the following Monday, August 1, other guests on the
premises reported to me that the vessel was still there.
Accordingly you are requested to remove the subject vessel
by the official, legal means available to your Department.
I wish to thank you and Tony Mellum for your prompt and
courteous cooperation.

Attached for your information are pages 22 and 23
of the City of Newport Beach Harbor Permit Policies
which deal specifically with Grand Canal docks that
can be constructed there.
As you are probably aware, there has been a moratorium
on dock construction on Balboa Island since 1964.
However, staff has taken the position that the Grand
Canal was exempted from that policy, and in the past we
have issued additional permits for docks on the Grand
Canal, subject to the conditions in the Harbor Permit
Policy herewith provided to you.
