Dear Ms. Compton:
The City of Newport Beach Fire and Marine Department has received
a request to transfer pier permit 1011-0067-1 for the above
mentioned property. The facility was inspected on October 24,
1997.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. This requirement is in accordance with Title 17 of the
California Administrative Code.
2. The electrical outlets on the dock must be GFI or twist lock
receptacles for use in a water environment.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's
minimum plumbing, electrical and structural
requirements, and the conditions of the existing
permit. All deficiencies must be corrected prior to
transfer of the permit."

Dear Mr. Melum:
If standard dock construction methods and materials are utilized,
this project should not adversely impact water quality. A
statement has been submitted that there will be no waste discharged
from the proposed project. Based on these assurances, clearance is
provided.
However, should the Army Corps of Engineers determine that this
project requires a Section 404 permit, it will be necessary for the
project proponent to obtain from this Board a Water Quality
Certification under Section 401 of the Clean Water Act.

Developments —Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER # 5-96-195 APPLICANT: City of Newport Beach
LOCATION: 67 & 68 Balboa Coves, Newport Beach, Orange County
PROPOSED DEVELOPMENT: Relocation of existing residential boat docks 20 feet
west of their present position. The docks will be rebuilt to their existing
dimensions.
RATIONALE: The relocated docks will extend no further channelward than the
existing docks. The proposed development will not inhibit existing navigation
along the channel. The proposed development will have no adverse impacts on
coastal access or resources, is consistent with the City's certified Land Use
Plan, and the Chapter 3 policies of the Coastal Act.
This waiver will not become effective until reported to the Commission at their
October 8-11. 1996 , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

Dear Mr. Salter:
Enclosed is a drawing that describes the relocation of the floats bayward of #67
and #68 Balboa Coves.
Our intent is to relocate these floats, complying with all state and local laws. We
need a letter of clearance from you in order to apply to the California Coastal
Commission and the Army Corps of Engineers.
As a condition of this letter, this project will not affect the Least Terns or Eelgrass
in any way, and there will be no discharge of vessel waste of any kind at this
location.

SECTION VI. COMMUNICATION WITH COMMISSIONERS
Decisions of the Coastal Commission must be made on the basis of information available to all commissioners

@ 13054. Notification Requirements
(a) For applications filed after the effective date of this subsection, the
applicant shall provide notice to adjacent landowners and residents as provided
in this section. The applicant shall provide the commission with a list of the
addresses of all residences, in apartments and each residence within a
condominium complex, and all parcels of real property of record located within
one hundred feet of the perimeter of the parcel on which the development is
proposed and the name and address of the owner of record on the date on which
the application is submitted, of any such parcel which does not have an address
or is uninhabited. This list shall be part of the public record maintained by
the commission for the application. The applicant shall also provide the
commission with stamped envelopes for all parcels described above. Separate
stamped envelopes shall be addressed to 'owner" and to 'occupant" except that
for parcels which do not have addresses or are not occupied, the envelopes shall
include the name and address of the owner of record of the parcel. The applicant
shall also place a legend on the front of each envelope including words to the
effect of "Important. Public Hearing Notice." The executive director shall
provide an appropriate stamp for the use of applicants in the commission office.
The legend shall be legible and of sufficient size to be reasonably noted by the
recipient of the envelope. The executive director may waive this requirement and
may require that some other suitable form of notice be provided by the applicant
to those interested persons, upon a showing that this requirement would be
unduly burdensome; a statement of the reasons for the waive"haI4-be-pla�ed in

post, at a conspicuous place, easily read by the public and as close as possible
to the site of the proposed development, notice that an application for a permit
for the proposed development has been submitted to the commission. Such notice

for such posting. If the applicant fails to so post the completed notice form
and sign the declaration of posting, the executive director of the commission
shall refuse to file the application, or shall withdraw the application from
filing if it has already been filed when he or she learns of such failure.

agreement, Southerly of that certain center line described in paragraph 2nd of said "Class C"
agreement, and the second parties are the owners of the land nottherly of said center line, and
the third parties are the owners of the land forming the easterly continuation of said "Parcel
A" as described in paragraph 6th of said "Class C" agreement northerly of the easterly prolong-
ation of said center line, and
WHEREAS the first party is the owner of a certain parcel of land westerly of and adja-
cent to said "Parcel A" and hereinafter in paragraph 5th more particularly described, and
WHEREAS the first party and second parties hereto now desire to locate and.establish
and describe a certain strip of land at least 100 feet in width to be used as a waterway and
channel in accordance with paragraph 9th of said "Class 0" agreement, and in lieu of the water-
way mentioned in paragraph 5th of said "Class C" agreement, said new waterway to be over and
across a strip of lard 125 feet in width northerly of and adjacent to the southerly line of
said "Parcel A" and desire to release all the land northerly of said 125 foot strip in both
"Parcel A" and in the easterly continuation of said "parcel A" from the easements created in
said agreement, and
WHEREAS the first party and second parties hereto desire to establish a new boundary
line between their properties to take the place of the boundary line described in paragraph
2nd of said "Class C" agreement, and
WHEREAS the first party and the second parties hereto do not claim any interest in
and to the lands in the easterly continuation of said "parcel "A" as described in paragraph 6tb
of said "Class CO agreement northerly of a lire 125 feet north of and parallel to the southerly
line of said easterly continuation of said "Parcel A" and desire to disclaim in writing any
interest thereto.
1. Now therefore in consideration of the mutual acvantages to be derived from the
definite establishment of said new waterway and said new boundary line the first party and the
second parties hereto do mutually hereby covenant, grant and agree that the aforesaid easement
for waterway and channel shall be over and across a strip of land located in Orange County,
California, of the uniform width of 125 feet lying 62.5 feet on either side of a. center line,
shown on. the annexed map which 1s made a part hereof, and is more particularly described as
follows:
Beginning at the intersection of the westerly line of said "ParceVA® with the westerly
prolongation of a line, parallel to and 62.5 feet; northerly, measured at right angle, from the
northerly line of Blocs 441, Canal Section, as shown on a map reoorded in Book 4, Page 99 His-
cellaneous Maps, Records of Orange County, California, running thence easterly along said
westerly prolongation and easterly in a continuous line parallel co, and 62.5 feet northerly,
measured at right angles from the Southerly line of the land referred to as "Parcel A" and the
Easterly continuation of said "Parcel All as described in Paragraph btn of said ^ mass 02 a3re

the center line more particularly described in Paragraph 1 hereof to the Westerly line of the,
property of the Southern Pacific Railroad Company is and shall be the line dividing the property
of the first party from, the property of the second parties.
j. In order to more fully carry out the intent hereof and in consideration of the
premises the first party herein does hereby remise, release and forever quit claim to the
second parties, as joint tenants, their successors and assigns forever, all right, title and
interest of said first party in and to the real property located in said "Parcel A" northerly of
that certain cente4lne more particularly described In paragraph 1 hereof, and second parties
herein in consideration of the premises do hereby remise, release and forever quit claim to the
first party herein all their right, title and interest in ann to the real property located in
said "Parcel A" southerly of that certain center line more particularly described in paragraph
1 hereof,
4. Nothing herein contained shall limit the right of first party hereto to Widen the
aforesaid waterway and channel on the Southerly side thereof and nothing herein contained shall
limit the right of second parties hereto to widen the aforesaid waterway and channel on the
Northerly side thereof,
5. In orde4o further carry out the intent hereof and as a part of the same consider-
ation the first party does hereby grant to the second parties as joint tenants, their heirs,
successors and assigns forever all the right, title and interest of the first party in and to
that certain parcel of land in Orange County, California and more particularly described as
Bounded on the north by the center line described in Paragraph 2nd of said "Class C"

agreement; Bounded on the east by the westerly line of said "Parcel A"; bounded on the south
by the westerly prolongation of the center line described in paragraph 1 hereof; bounded on
the west by the northeasterly line of Block 244 said Canal Section and the northwesterly pro-
longation thereof.
6. In order to remove the cloud to the title of the land hereinafter in this para-
graph described and in consideration of the premises thelfirst party and the second pasties hereto

do hereby disclaim and quit claim to the third parties their heirs, successors and assigns for-
i ever, as their respective interests may appear, that certain parcel of land in Orange County,
California, more particularly described as follows:

j That part of land included in the easterly continuation of said "Parcel A" referred to
in Paragraph 6th of said "Class C" agreement lying northerly of a line located 125 feet northerly
of and parallel to the southerly line of said easterly ooz.tinuation of said "Parcel.A".
