Pacific Coast highway, City of Newport Beach, CA Dear Ms. Bolin: On August 4, 1998 our office received your application for the subject Coastal Development Permit. Please accept this letter as notification that your application is Incomplete pending receipt of additional information necessary for a thorough analysis by Commission staff. First, Section Il, Item 1 of your Application for Coastal Development Permit states the proposed project will involve multiple parcels. However, the proof of legal Interest provided by you only identifies one parcel, registered to Mr. Ron Presta, whom is not, according to your application, an applicant. Since the proposed project involves multiple parcels, and the Townhome Owners Association is the applicant, you must provide adequate proof of legal interest to act on behalf of the members of the Association and all owners of the affected properties. Please provide a written letter or resolution from the Association's governing body demonstrating the legal ability of the Association to act on behalf of the property owners. Specifically state in this letter or reaoluti the Assessors Parcel Number(s) which are pert of the proposed project. Also, the governing body must appoint a person to be the Association's representative. We acknowledge the action taken by Bowie Houghton, under Section Vlll of your application, authorizing you as an agent. In order for this authorization to be valid, Bowie Houghton must be appointed by your Associations governing body to act on their behalf in matters related to this permit application. Demonstrate this appointment in the same written letter or resolution `mentioned previously. In addition, please provide a copy of the Association' Co munity Codes and Restrictions (CC & A's). Plans must clearly portray all existing and proposed structures subject to this permit in site specific, profile and plan views, as appropriate. These views should include elevation, tidal range, all cuts, dredging, or fills, and existing/proposed ground profile, as appropriate. Also, please show the project in relation to existing property boundaries, Examples of sufficiently detailed plans include architectural and civil engineering drawings, certified by the appropriate licensed 1 professional, and at a resolution sufficient to evaluate project detail li,e. no less than 1" 1 20'j. Y Finally, since the proposed work will occur in coastal waters, this agency is interested In any adverse impacts your project may have on coastal, biological resources. Please contact the 1 California Department of Fish and Marne (CDFG) regarding your project. Demonstrate the results of your contact by providing copies of permits (including any special conditions) or other correspondence CDFG may provide to you. Upon our arrival we were niet by Rose Perez who lives at 303 - 43rd st_eet. Perez stated that the dredging operation that was taking place on the other side of the bay was dumping its dredged material onto the )beach at 43rd street and Creating a oily, dirty mess on the beach, causing a hazardous environment for her children and the neighbors who live along the 43rd street 'beach area. We met with Eric Langenbach, who works for Shellmaker Inc., who was in charge of the dredging operation. Langenbach presented documentation that he indeed had city permits to bg dredging the bay in this area. Langer,,bach stated that once the dredging was complete, he would bring in aback hoe and remove the dredging material. We requested N.b.P.D. Environmental Officer respond to determine if any environmental laws were being violated regarding this dredging operation, N.B,P,D, Officer D. White responded and took a report of the situation. This makes it impossible for me to enter or leave my boat slip in low tide. At that time you investigated the problem and you were kind enough to call me back stating that you had "good news and bad news". The bad news was that the city is not responsible for any sand washed into the channel from city property. The good news was that our channel was budgeted to be dredged in the summer of 1980. As we both know this was never done in 1980 and according to your last conversation with me, since you did not have any other complaints other than mine, it probably would not be done in 1981 but you would investigate. L.-have thought about this problem for many months and have made the following conclusions. The threat to navagation in our channel is the direct result of the sand from a city park being washed into a public channel by a city drainage pipe and rain. This has rendered my slip unusable during low tide. This does not seem morally correct and proper. It would appear the city has a responsibility to correct a hazard that was created as a result of a city park beach. I feel the number of complaints made to you regarding this problem is really unrelated to the city's responsibility. Would more complaints make the city more responsible? On any weekend there are 20-30 smaller boats that pull into that beach. Need I have each of them (and I am sure they would) sign a petition requesting the city to correct this problem? I do not think this is the answer but we both know the squeeky wheel gets the oil. Finally, one year ago the Newport Beach Townhouse Owners' Association could have had it dredged for $600.00. Now we both know the price is probably $1,000.00. The association has waited one year because of our previous conversation and prior plans by the city to dredge the area in 1980. You can also imagine the effect this has on the value of our condo and slip which is large enough for a 40' boat but which at low tide is blocked by sand above the water line, and can not be used for navagation by a vessel of any size. As time goes on more sand is being washed into the channel. The City Council's Harbor Permit Policies adopted in the 1960's addresses the renting of slips bayward of residentially zoned areas. Policy 11-1 A. states "Shore connected piers and floats bayward of residentially zoned areas shall be reserved for the occupants of the abutting upland property". In con- junction with this city policy, it is understood that the harbor permit per se must be held in the name of either the owner or long term leasee of the property. Harbor Permit Policies H-17 and H-19, ancillary to commercial marinas respectively state: 17. Parking Requirements - "All commercially operated boat docking facilities shall provide 0.75 parking stalls for each single boat slip and 0.•75 parking stalls for each 25 feet of available mooring space not classified as a slip". These parking spaces must be located on the abutting upland property corresponding to the subject marina. 19. Sanitary Requirements - "All public or private com- mercially operated shore connected boat anchorages shall have a minimum of two restroom facilities ..... for each 20 boat slips or berths..." These above excerpts from the Council's Harbor Permit Policies are tied to Chapter 17 of the Newport Beach Municipal Code. Page Two Section 17.24.090 of the code outlines grounds for permit revocation. One of the grounds for revocation (7) is that a permittee has breached or failed to comply with the terms or conditions contained in the permit or upon which the permit was granted. Smith Construction Company is building the condominium houses on the property just to the north of the City park at 43rd.Street as shown on the attached sketch. The construction company also wishes to dredge 500 yards from the water area in order to provide more water depth for existing slips. Of paramount concern in dredging operations in this area is control of sedimentation from return waters and control of odors. Subject to these two concerns, the removal of 500 yards in this area is a step further in improving water quality through a removal of debris and poor bottom soil that is accumulated over the years. This dredging project then is desirable providing we can find the means to handle the spoil. After considering several alternatives, it is proposed that the spoil be deposited on the sandy area of the public beach in the City park. The contractor will construct a 3 foot circular berm to contain the spoil and for the control of returned waters. Returned waters will be drained back into the bay through drainage tiles located at the top of the berm and the waters will subsequently be filtered through bailed straw. If hydrogen sulfied odors are strong, the spoil area can receive a chlorine treatment. The contractor will agree to restoring the beach upon completion of the operation to include hauling in fresh sand if deemed necessary by the City, and he will agree to the posting of a $10,000 performance bond. Prior to actual. work, he will also have to receive a permit from the U—S. Corps of Engineers and the Regional Water Quality Control Board as well as from the City. It is requested that you review the proposal and advise me as to whether or not the City property can be utilized for this purpose and, if so, what specific conditions you feel should be placed upon the contractor.. All lumber used in the construction of the floating doc'-_ system shall be iTo. 1 grade douglas fir or better, provided there are no loose knots or other defects. All lumber to be S4S and shall be picked for appearance. Tie bands used for delivery must have plates between the bands and wood to prevent crushing. Bundle indentification shall be done so as not to stain lumber surfaces. 2. Lumber Treatment All lumber for the construction of the floating docks shall be Dressure treated to conform to AINPA Standard C-1 (ACZA) to a minimum retention of 0.6r/-/CF. All field cuts and bored holes to receive a brush coat of concentrated preservative. Prior to shipment from treatment plant the Contractor shall submit a C-ertification of Treatment to the Owner for approval. 3. Bumper StriDDing Bumper stripping shall be white or off-white, extruded vinyl plastic, ethylene propylene, neoprene or other syntheiic rubber, compounded to resist salt water, ozone and sunlight. Bumper shall be non -marking and non -yellowing and have a minimum weight of 0-85#1LF. 4. Corner Bumpers Corner bumpers shall be ASTRO #304 or equal. 5. LgDper Nails All corner bumpers and bumper stripping shall be secured to the fender lumber with 1 1/4" hot dip galvanized or aluminum roofing nails at 111, O.C.. on top apd 811 O.C. on the bottom. Galvanized nails to be manufactured by Keystone. Aluminum nails to be #R30 by Phifer Western. 6. Hardware a. All hardware, including bolts, cleats, clip angles, etc. shall be hot dip galvanized after fabrication. b.
