The City of Newport Beach has received a complaint regarding the pier bayward of 405 E. Edgewater, Newport Beach. Specifically the complaint is that there has been a modification to the pier railing which does not conform to the Standard Drawings for Public Works and Harbor Constructions and this modification has been done. without receiving a permit as required by the City Municipal Code. Section 17.24.010. of the City Municipal Code regarding structures in the harbor require anyone who build, maintain, extend or make structural alterations on any building, pier, etc., upon the waters or any other water where the tide ebbs and flows within the City to first obtain a written permit to do so from the City. Section 14. B. in the City Harbor Permit Policies states that structures shall be designed in accordance with the design criteria adopted by the City of Newport Beach. A field inspection revealed that there exist a violation of the above stated codes. Please remove the fencing on your pier walkway in accordance with the requirement to conform to the City policy. Discussion The application requires City.Council approval under the conditions of approval placed on the City of Newport Beach general permit for maintenance dredging issued by the U. S..Army Corps of Engineers,'on February 12, 1974, and subsequently amended on May 10, 1977 to allow beach restoration. The locations and applicants for the proposed dredging and beach restorations are: 112-405 Burnetta Cassel, 405 Edgewater 154-113 Del M. Pinkney, 113 E. Bay Front, Balboa 110-1114 J. R. Bahan, 1114 E. Balboa Blvd. The staff has reviewed the projects and has determined that the work will be done within the parameters of the Corps of Engineers permit. The dredging. contractor will place a filter screen around the discharge site to control turbidity. There is no known eel grass in the vicinity of the projects. All dredged material will be placed on adjacent beaches. This will aide in the restoration of beaches bayward of private residences. D. On November 12, 1968, the harbor permit was approved by the City Council subject to the condition that it not be -issued until commencement of the construction on the proposed apartment building. Since that time, Mr. Cassel has abandoned his plans for an apartment building and has under construction a single family dwelling. Mr. Cassel has also submitted a revised harbor permit application showing a single pier, ramp and slip bayward of this single family dwelling. Transferring Permit: This permit is not trans- ferable without the written consent of the City Council of Newport Beach. 4. Notice Prior to Starting Work: The Permittee shall notify the City Engineer at least three (3) days in ad- vance of the date work is to begin and its completion. 5. Inspection: The work shall be subject to the supervision and approval of the City Engineer. On work which requires the presence of an employee.of the City of Newport Beach as inspector, the salary and other incidental expense of such inspection during the work shall be paid by the Permittee upon presentation of a bill therefor. 6. Protection of Traffic: Adequate provisions shall be made for the protection of the traveling public. Barricades shall be placed on streets, with red lights at night, also flagmen employed, all as may be required by the particular work in progress. The Permittee shall not attempt to forbid the full and free use by the public of all navigable waters at or adjacent to the work or structure. If the display of lights and signals on any work hereby authorized is°not otherwise provided by law, such lights and signals, as may be prescribed by Bureau of Light Houses, Department of Commerce, shall be installed and maintained at the expense of the Permittee. 7. Liability for Damages: The Permittee is respon- sible for all liability for personal injury or property damage which may occur through work herein permitted, and in event any claim is made against the City of Newport Beach or any de- partment, officer or employee thereof, through, by reason of, or in connection with such work, Permittee shall defend, in- demnify and hold them and each of them harmless from such claim. This permit shall not be effective for any purpose unless and until the above named Permittee files with the City of Newport Beach., a surety bond in the f orri and amount required by said city, unless specifically exempted on the face hereof. S. Expiration of Permit: If the structur r work herein tho tied is not completed on or before theelti day u of � �, 19 40 , this permit, if not previously revoked or specifically extended, shall cease and be null and void. PLEASURE PIERS 1. The City of Newport Beach shall,never be held liable or obligated for any injury or damage resulting to either persons or'property through the erection, use or possession of private piers. 2. The -pier shall be so constructed as not to obstruct, interfere with or prevent the free use or passage of any sidewalks., street, alley, public way or navigable channel. 3. The right given for the erection and mainten- ance of a pier is permissive only and the Permittee shall upon revocation hereof, remove said pier and appurtenances thereto within thirty (30.) days after date of mailing written notice of the revocation of this permit, which notice may be mailed to the last known address of the Permittee. 4. The City of Newport Beach reserves full right, power and authority to revoke this permit and in the event the Permittee fails to remove said pier within the time specified, then the City Engineer shall have the right to immediately remove same at the cost and expense of the Permittee. 5. Pleasure piers shall be constructed in accord- ahce with Standard Plan No. 1055-A for Pleasure Piers, adopted by the City Council. Painting of piers shall be as designated by the City Engineer. 6. The Permittee shall beep the pier in good repair at all times and shall paint the pier when required to do so. Failure to repair or paint pier, when written notice has been given by the City Engineer, shall be cause for revocation of the permit and removal of the pier. 7.
