Dear Mr. Collins:
The application for harbor construction work to revise the existing residential piers and
docks bayward from 421-427 E. Edgewater has been denied by the Harbor Resources
Division. The denial was due to the proposal to retain the present bayward extension of
the end of the docks, which are currently non -conforming. The current City Council
Harbor Permit Policies only allow the piers to extend out to the U.S. Pierhead Line.
Chapter 17.24.050.A of the Municipal Code "The application shall be denied if.- 1. The
application does not conform. to the provisions of this Code, standard harbor drawings
approved by the City Council or the harbor permit policies adopted by the City Council."
You have the right to appeal this decision to the City Manager by filing a written appeal;
with the Office of the City Manager within fourteen working days from the date on which
the applicant has notice of the denial. The City Manager considers the appeal and renders
a decision within fourteen (14) working days from the date of the appeal.

if I am allow(d to upgrade these docks it will clean up a blighted condition of old
docks. It will move one pier from the property line and create docks for single fimiily
new homes which wi I also improve the area.
I need to ke the dock location out to the U.S. project line so that it won't be a
constant dredging problem.
These docks bave not and will not be a threat to navigation. The Newport
Landing docks next or extend out to the U.S. project line.

A letter arrived towards the latter part of April regarding a matter at your pier and dock at
507 Edgewater (see attached). As you will read it alleges that there is an individual living
aboard the sailboat "Minx" at your harbor facility. The complaint is that he has been
living aboard for several months. I have deleted the names of the complaining parties at
this time, but they state that they represent other concerned residents in the immediate
area.
Please look into this situation and let me know what is going on as soon as you can. As
always this office appreciates your prompt attention to matters of this type.

.Dear Mr. Armand:
The undersigned is the proposed buyer of the property commonly known as
421-427 East Edgewater, Newport Beach, California (the "Property") including docks.
The City of Newport Beach has requested certain repairs prior to the transfer of
the docks to the undersigned.
Please be advised that the undersigned intends to do certain dock remediation
within the next year in conjunction with its development and construction on the Property.
In that regard, the undersigned commits to repair or replace the current floats supporting
the docks within one year from the date of close. The acquisition is scheduled for August
1,2002.
With respect to work requested by the City which is in addition to the float
repair or replacement, it is our understanding that such work will be performed by the
Seller prior to the. closing.
Accordingly, subject to the above, the undersigned requests the City of
Newport Beach to consent to the transfer of the docks, which are a part of the Property,
to the undersigned.

Dear Sirs:
The City of Newport Beach Harbor Resources Office has received a request to transfer
the pier permit for the above noted properties. The structures were inspected by the
Harbor Resources Staff and we cannot transfer the pier permit until the following
deficiencies has been corrected and we have been notified of the corrections:
The structure for permit 112-421 has one finger on the most east side that requires
additional flotation to correct the slant. There is some decking that needs to be nailed
down. There are a few places on the dock with dry rot and the lumber needs to be
replaced. The junction box on the landing requires repairs.
Permit 112-427 has pier and dock dimensions that do not match those on the original
permit drawing approved and issued by the City. A new drawing must be submitted
depicting the Site Plan drawn to an adequate scale to clearly show 1) the location and
dimension of the structure including pilesand location of existing structures on adjacent
properties. 2) Location of bulkhead, pierhead and project lines. 3) Location of property
lines. 4) Location of channel markers within 200 feet.
Both structures have legal non -conforming issues that in the event of a revision or major
maintenance would have to be brought into compliance with the City's Harbor Permit
Policies.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.

As neighbors in the 507 Edgewater area. we,,,P/ere extremely happy to
see the removal of the white tra ' wler L CF 7647 GG. However, we are
hoping that a continuation of the removals is taking place. In particular,'
the sailboat "Minx". There is also a gentleman at the same location
living aboard this boat.' -.Many of the children in the neighborhood had
the pleasureof hearing this gentleman wentertainingiv a lady aboard the
boat.during the weekend past. Ofcourse you can understand that
many of us parents are not pleased. This gentleman also complains
about the parking on the street as N we are not allowed to park in front
of our own homes. He drives a white,van with expired tags (680-JRF)
from the state of Washington. If he Were actually residing in
Washington I'm sure he would have received a notice of renewal for his
tags. We do understand that this gentleman may not be residing on
this sailboat 365 days out of the year, but he has been there , for several
months, and as we understand he is not allowed to live aboard for a ny
extended period of time. We are truly hopeful that you can help us in
the continued removal of the liveaboards in our area.

of Mr. Brown at 421-427 East Edgewater, a notification for the maintenance dredging of 222
cubic yards of sand and silt material by hydraulic suction and disposal of the dredged
material on the adjacent beach.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Pern-dt No. 89 -211 -
GS provided that Mr. Brown's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

Dear Tony:
It is my understanding per our conversation on April 1 7th that the City of Newport Beach
through the Marine Department, myself (Method Art Corporation), and David Salisburg
(Newport Landing Restaurant), will participate equally to cover the expense of building a
new groin wall bayward of Adams Street and Edgewater.
However, I want it on record that I am grudgingly participating in this project (financially)
since it is both my opinion and the stated opinion of your City Engineer, Lloyd Dalton, that
the need for this groin wall is a direct result of the Developer Mark Howard having removed
the long time existing groin wall in front of Newport Landing and then dredging all the way
up to the bay bulk head. Further, Mr. Dalton stated "that if the joint effort groin wall does
not protect the city's and Method Art's interests that it would be necessary for Newport
Landing to build a 20' concrete groin wall at its sole expense, and that no further dredging
permits would be issued to Newport Landing until said second wall is erected to protect our
interest."
In our conversation, you told me that the wall should be built before pumping sand back
onto my depleted beach, However, the beach has slid into the Newport Landing's pit at
such a rate that my docks and tenants' boats are beginning to sit on sand bars at low tide.
This is both damaging to my docks and tenants' boats and leaves my pier pilings sinking due
to lack of sand support after just raising my pier two years ago because of the same
problem!

I am, therefore, requesting that you expedite this wall construction and beach replacement
as rapidly as is possible to limit the damage we sustain.
My full payment of Method Art's portion of this project is available today 4/18/97 and, I
understand, the two contractors estimates are in your possession. I will call David Salisburg
today to fill him in on our progress to date and that he please make his funds available as
well. I hope to hear from you that you've secured the city's finances so that we have no
delay in scheduling the chosen contractor as soon as possible.

Dear Mr. Oppenheim:
The City of Newport Beach has received several complaints and one
inquiry regarding live aboards at the slip bayward of 423
Edgewater. Section 4-K of the Harbor Permit Policies states "in
those areas of the harbor where the piers and floats are bayward of
residentially zoned areas and are reserved for the occupants of the
abutting upland property, live aboards shall not be permitted".
As you may or m ay not know, the property landward of the dock is
zoned residential and, therefore, live aboards are not permitted by
Harbor Permit Policies.
It is our understanding that vessels CF 9517 GG and CF 6626 FX-'
have people living aboard. To preclude further action by the
Marine Department these vessels must be reloacted from the
residential pier and float.

We are in receipt of your letter dated August 3rd. Regarding the vessel CF 9517 GG, the
owner rents an apartment at 423 E Edgewater which is right in front of his boat. Therefore,
we feel that this vessel does not need to be relocated.
The owners of the second vessel, CF 6626 FX, live in Beaver Crossing, Nebraska and were
spending some of their summer vacation here. They will be gone by the 20th'. However,
they need to leave the boat until it is sold.
We trust that this letter will solve any problems or misunderstandings.

of the material on an adjacent beach, in the City of Newport Beach,
Orange County, California.
Based on the furnished information, we have determined that
your proposed activity complies with the terms and conditions of
Permit No. 89 -211 -GS provided Ms. Oppenheim does not exceed the
maximum dredging design depth of -5 feet MLLW with a maximum
allowable overdredge depth of -1 foot MLLW.

Dear Mr. and Mrs. Oppenheim:
On July 27, 1990 we received a call from a contractor regarding a
construction job going on at the above property. There was an
inquiry as to whether or not a permit had been issued for the work
being done. A subsequent field inspection revealed that temporary
repairs were being made without a permit on the dock where it had
recently failed. It is my understanding that these repairs were
temporary, to make the dock safe, and that in the near future you
or your representative would be coming in to get a permit to repair
the dock properly.
It is the opinion of the Marine Department staf f that the structure
has fallen into a state of disrepair such that it poses a safety
hazard and it must be repaired a soon as possible. We would expect
that this repair work, after you have obtained a City issued
permit, would begin within the next thirty days. Failure to begin
the necessary repair work could subject the permit to revocation
as stated in the Newport Beach Municipal Code, Section 17.24.090:
1117.24.090. Revocation of Permit. A. GROUND FOR REVOCATION.
Any permit heretofore or hereafter, granted for any structure or
work in the waters of Newport Harbor or the Pacific Ocean may be
revoked by the City Council upon any of the following grounds:—..
(5) The work or structure has fallen into ' a state of
disrepair .....

In approximately March 1984 the City of Newport Beach approved
a dredging permit for the property bayward of Newport Landing.
The permit allowed approximately 100 cubic yards of dredging
adjacent to the seawall there, with the dredge spoils to be
placed at Adams Street end. The dredging was done and the dredged
material placed as proposed.
Approximately in July 1987 the city of Newport Beach received
a letter from the law firm of Rutan and Tucker representing
the property owners at 421 Edgewater. The gist of that letter
was that the dredging done in from of Newport Landing created
damage to the property adjacent to 421 Edgewater and the property
owners, through their attorneys, were requesting notice of
future dredging projects at Newport Landing.
Approximately September 1988 the City of Newport Beach corresponded
with the property owners at 421 East Edgewater, indicating to them
that dredging was proposed in the area, and if they had questions
they should contact the Marine Department. The City did not
receive any contact from any property owners.
On September 29, 1989, the City of Newport Beach again contacted
the property owners and indicated to them that dredging was
proposed in the area and if they had questions they should
contact the Marine Department.
On OCtober 11,1989 one of the property owners from the property
at 421 East Edgewater, Mrs. Von Oppenheim, contacted me regarding
the proposed dredging at Newport Landing. She wanted a couple of
weeks to study the dredging proposal and discuss with the property
owner at Newport Landing alleged previous damage done to her dock
adn beach from past dredging. I told her it may be possible to
delay the project and I would contact the property owner.
In a subsequent conversation with the property owner he indicated
that because of changes in the leasees of his dock, immediate
dredging was critical and additionally, his dredging contractor
was going out of the harbor within two weeks and would not be back
to perform the work for two and a half to three months. I contacted
the von Oppenheims, indicating to them that unless there was
sufficient information or sufficient reason to deny the application
,for dredging that we were going forward with the work.
I also indicated to the Oppenheims that since they were mainly
concerned with beach erosion, we would require Newport Landing
to place dredge spoils up on their beach. Mrs. van Oppenheim
indicated to me that it was too short a time, that they needed
time to negotiate with the property owners relative to the damage
that had occurred in the past.
At the City COuncil meeting of October 9, 1989 during the public
Comments section, Mrs. Oppenheim addressed the City Council and
explained the situation with the dredging. The City Attorney
indicated to the COuncil at that time, without discussion with
the Marine Department, that we would give Mrs. Oppenheim several
weeks to contemplate the dredging project before we issued the
permit.
On October 10, 1989 1 contacted the City Attorney and explained
the situation to him relative to the timing of the dredging
applicatin and the constraints limiting the applicant. Based on
that information, he advised us that it was appropriate to go
forward with issuance of the permit. We issued the permit.
Dredging was performed on October 12, 1989.
In the meantime I had again discussed with Mrs. Oppenheim the
possibility of taking all the sand and placing it on her beach,
thereby minimizing any possible chance of damage to her structure
or her beach. I asked her to contact the applicant so this could
be done. I understand they had one or two conversations, but
Mrs. Oppenheim never indicated that she wanted to receive the
sand.
Prior to issuing the dredging permit, Ray Garver and I went down
and inspected the Oppenheims structure relative to her allegation
that dredging had caused damage to the pier. Visual inspection
of the dock indicated that it was a very old dock in very seriously
deteriorated condition with dry rott, settling, and anumber of
problems. It had settled -and sank and basically is on the verge
of becoming unsafe. It was hard, based on this inspection, to
see how a dredging project in 1984 which placed sand on the Adams
Street end could have accelerated or caused any damage to the
Oppenheims pier. Based on these factors we felt that it would
not be equitable to stop Newport Landing from going forward with
their dredging project.

Within the next two or three weeks the City of Newport Beach, under
its Maintenance Dredging Permit, proposes to issue a permit to

The City Attorney pointed out that if
the Specialty Food Ordinance is adopted
by the City Council, he does not feel
Mr. Mione would have to apply for a use
permit to the Planning Commission for
the requested use.
Following discussion, substitute motion
was made to continue this public hearing

enforcement in that area from 10:00 p.m.
to 12:30 a.m. on weekends during the
winter, and from 10:00 p.m. to 3:00 a.m.
every night during the summer.
In view of the foregoing comments, the
staff was directed to brief the Council
at an upcoming study session on the
status of the cruising ordinance.
2. Ron Merrick, 890 W. 15th Street,
resident.of Seacliffe Mobile Home Park,
addressed the Council regarding rent
control. He stated that the owner of
the mobile home park has raised the
tenants rent substantially over the
years, with a 14% last year.
Mr. Merrick was advised that the City
Council does not have the authority to
mediate or arbitrate rent control and
--th-at—i-t-i-s-a p-riv-at-e--ma-tt-er--b-e-t-ween -th-e
property owner and tenant.
Following discussion, Council Member
Watt commented that she would like more
information on the Rent Arbitration
Board concept, to which there were no
objections.
MINUTES
3. Nan Von Oppenheim, 423 E. Edgewater,
addressed the Council regarding dredging
in front of Newport Landing.
The City Attorney reported that he has
spoken to Ms. Von Oppenheim and Tony
Melum, Tidelands Administrator,
regarding this issue and stated that the
project involves 146 cu. yds. of
dredging which is well under the 500 cu.
yds. limit the Coastal Commission
considers to be maintenance dredging.
Ms. Oppenheim requested that the City
impose a condition on the permit
requiring the person engaged in the
dredging to indemnify the Oppenheims for
any damage caused to their facility, to
which Mr. Melum has agreed to add to the
permit. Mr. Melum has also delayed the
issuance of this permit to allow the
Oppenheims to study the request further.

Dear Mr. Oppenheim: I
The City of Newport Beach has received a complaint regarding the
use of the pier and float bayward of the above address.
Specifically, the complaint is that the docks are being used in
violation of Section 21.A. of the� Harbor Permit Policies, which
state:
21.A. "Boats moored at private or public docks shall not
extend beyond the projection of the, property lines of the property
to which the dock facility is connected...".
We have received a complaint from the property owner at 419
Edgewater which indicates that a vessel is being side tied at the
above slip, encroaching across the, common property line and into
his water area.
In order to preclude further action by the Marine Department this
vessel must be relocated to bring it into compliance with the
quoted section of policy.

In the area of the above properties, the City of Newport
Beach has an easement for a sidewalk and bulkhead. Because
erosion adjacent to the bulkhead, it will be necessary
within the next several months, -for the City to do dredging
to support the bulkhead wall. It is likely that the
dredged material will be taken from the beaches adjacent
to the bulkhead wall and pushed up against the wall to
support it and thereby support the sidewalk.
When definite dates for the tractor work are determined,
adjacentproperty owners will be notified.
