Edgewater has been denied by the Harbor Resources Division. The denial was due to the proposal to retain the present bayward extension of the end of the docks, which are currently non -conforming. The current City Council Harbor Permit Policies only allow the piers to extend out to the U.S. Pierhead Line. Chapter 17.24.050.A of the Municipal Code "The application shall be denied if.- 1. The application does not conform. to the provisions of this Code, standard harbor drawings approved by the City Council or the harbor permit policies adopted by the City Council." You have the right to appeal this decision to the City Manager by filing a written appeal; with the Office of the City Manager within fourteen working days from the date on which the applicant has notice of the denial. The City Manager considers the appeal and renders a decision within fourteen (14) working days from the date of the appeal. As you will read it alleges that there is an individual living aboard the sailboat "Minx" at your harbor facility. The complaint is that he has been living aboard for several months. I have deleted the names of the complaining parties at this time, but they state that they represent other concerned residents in the immediate area. The City of Newport Beach has requested certain repairs prior to the transfer of the docks to the undersigned. The structures were inspected by the Harbor Resources Staff and we cannot transfer the pier permit until the following deficiencies has been corrected and we have been notified of the corrections: The structure for permit 112-421 has one finger on the most east side that requires additional flotation to correct the slant. There is some decking that needs to be nailed down. There are a few places on the dock with dry rot and the lumber needs to be replaced. The junction box on the landing requires repairs. Permit 112-427 has pier and dock dimensions that do not match those on the original permit drawing approved and issued by the City. A new drawing must be submitted depicting the Site Plan drawn to an adequate scale to clearly show 1) the location and dimension of the structure including pilesand location of existing structures on adjacent properties. 2) Location of bulkhead, pierhead and project lines. 3) Location of property lines. 4) Location of channel markers within 200 feet. Both structures have legal non -conforming issues that in the event of a revision or major maintenance would have to be brought into compliance with the City's Harbor Permit Policies. Please advise this department when the above deficiencies have been corrected. Call 644- 3043 if you require additional information in regards to this matter or to request a re- inspection. There is also a gentleman at the same location living aboard this boat.' -.Many of the children in the neighborhood had the pleasureof hearing this gentleman wentertainingiv a lady aboard the boat.during the weekend past. Ofcourse you can understand that many of us parents are not pleased. This gentleman also complains about the parking on the street as N we are not allowed to park in front of our own homes. He drives a white,van with expired tags (680-JRF) from the state of Washington. If he Were actually residing in Washington I'm sure he would have received a notice of renewal for his tags. We do understand that this gentleman may not be residing on this sailboat 365 days out of the year, but he has been there , for several months, and as we understand he is not allowed to live aboard for a ny extended period of time. We are truly hopeful that you can help us in the continued removal of the liveaboards in our area. However, I want it on record that I am grudgingly participating in this project (financially) since it is both my opinion and the stated opinion of your City Engineer, Lloyd Dalton, that the need for this groin wall is a direct result of the Developer Mark Howard having removed the long time existing groin wall in front of Newport Landing and then dredging all the way up to the bay bulk head. Further, Mr. Dalton stated "that if the joint effort groin wall does not protect the city's and Method Art's interests that it would be necessary for Newport Landing to build a 20' concrete groin wall at its sole expense, and that no further dredging permits would be issued to Newport Landing until said second wall is erected to protect our interest." In our conversation, you told me that the wall should be built before pumping sand back onto my depleted beach, However, the beach has slid into the Newport Landing's pit at such a rate that my docks and tenants' boats are beginning to sit on sand bars at low tide. This is both damaging to my docks and tenants' boats and leaves my pier pilings sinking due to lack of sand support after just raising my pier two years ago because of the same problem! The permit allowed approximately 100 cubic yards of dredging adjacent to the seawall there, with the dredge spoils to be placed at Adams Street end. The dredging was done and the dredged material placed as proposed. Approximately in July 1987 the city of Newport Beach received a letter from the law firm of Rutan and Tucker representing the property owners at 421 Edgewater. The gist of that letter was that the dredging done in from of Newport Landing created damage to the property adjacent to 421 Edgewater and the property owners, through their attorneys, were requesting notice of future dredging projects at Newport Landing. Approximately September 1988 the City of Newport Beach corresponded with the property owners at 421 East Edgewater, indicating to them that dredging was proposed in the area, and if they had questions they should contact the Marine Department. The City did not receive any contact from any property owners. On September 29, 1989, the City of Newport Beach again contacted the property owners and indicated to them that dredging was proposed in the area and if they had questions they should contact the Marine Department. On OCtober 11,1989 one of the property owners from the property at 421 East Edgewater, Mrs. Von Oppenheim, contacted me regarding the proposed dredging at Newport Landing. She wanted a couple of weeks to study the dredging proposal and discuss with the property owner at Newport Landing alleged previous damage done to her dock adn beach from past dredging. I told her it may be possible to delay the project and I would contact the property owner. In a subsequent conversation with the property owner he indicated that because of changes in the leasees of his dock, immediate dredging was critical and additionally, his dredging contractor was going out of the harbor within two weeks and would not be back to perform the work for two and a half to three months. I contacted the von Oppenheims, indicating to them that unless there was sufficient information or sufficient reason to deny the application ,for dredging that we were going forward with the work. I also indicated to the Oppenheims that since they were mainly concerned with beach erosion, we would require Newport Landing to place dredge spoils up on their beach. Mrs. van Oppenheim indicated to me that it was too short a time, that they needed time to negotiate with the property owners relative to the damage that had occurred in the past. At the City COuncil meeting of October 9, 1989 during the public Comments section, Mrs. Oppenheim addressed the City Council and explained the situation with the dredging. The City Attorney indicated to the COuncil at that time, without discussion with the Marine Department, that we would give Mrs. Oppenheim several weeks to contemplate the dredging project before we issued the permit. On October 10, 1989 1 contacted the City Attorney and explained the situation to him relative to the timing of the dredging applicatin and the constraints limiting the applicant. Based on that information, he advised us that it was appropriate to go forward with issuance of the permit. We issued the permit. Dredging was performed on October 12, 1989. In the meantime I had again discussed with Mrs. Oppenheim the possibility of taking all the sand and placing it on her beach, thereby minimizing any possible chance of damage to her structure or her beach. I asked her to contact the applicant so this could be done. I understand they had one or two conversations, but Mrs. Oppenheim never indicated that she wanted to receive the sand. Prior to issuing the dredging permit, Ray Garver and I went down and inspected the Oppenheims structure relative to her allegation that dredging had caused damage to the pier. Visual inspection of the dock indicated that it was a very old dock in very seriously deteriorated condition with dry rott, settling, and anumber of problems. It had settled -and sank and basically is on the verge of becoming unsafe. It was hard, based on this inspection, to see how a dredging project in 1984 which placed sand on the Adams Street end could have accelerated or caused any damage to the Oppenheims pier. Based on these factors we felt that it would not be equitable to stop Newport Landing from going forward with their dredging project.
