The attached Notice of Requirement to Reimburse is your formal notification of your responsibility to investigate and remedy the effects of this release and to reimburse the State Water Resources Control Board for the direct and indirect costs incurred by local and state agencies while overseeing site investigation or remedial action. The Orange County Health Care Agency and the State Water Resources Control Board, have entered into an agreement which authorizes this Agency to oversee corrective action at sites contaminated by the unauthorized release of petroleum products from underground storage tanks. The program developed by Orange County is funded by State and Federal monies and is subject to the reimbursement requirements associated with the use of these funds. In order to comply with the reimbursement requirement, it is necessary to account for all time and materials expended by County staff at each site. On a routine basis, site specific amounts detailing the time and expenses expended for each site will be provided to the State. The State will then invoice the responsible parties (RPs) for all direct and indirect costs associated with this Agency's oversight of corrective action. This Agency will initially identify at least one RP per site, then broaden its identification process to include all other RPs. When an additional RP is identified and added to or dismissed and deleted from the list of RPs for the referenced site, you will receive a copy of their Notice and an updated list of RPs. RPs may be held jointly and severally liable for site cleanup costs. This means that the State Water Resources Control Board may collect the entire amount due for the costs incurred at the site from any one RP or from several RPs. You may wish to negotiate with the other RPs to allocate the oversight costs when the invoice is received. The existing development is a boat fuel dock station. The fuel tanks are located adjacent to and landward of the bulkhead. The remainder of the project is located seaward of the bulkhead. RATIONALE: The project is proposed to bring the existing fueling equipment up to current state and federal regulations. The proposed development will provide better protection against possible fuel leakage. Furthermore, the proposed development will have no adverse impacts on coastal access or resources, is consistent with the City's certified Land Use Plan, past Commission actions, and the Chapter Three policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their December 13-16, 1994 , meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the Administrative Code. The enclosed Notice Card shall remain posted at the site until the waiver has been validated and no less than seven days prior to the Commission hearing. Approval of the City's Public Works Department. Discussion• This application is before the City Council as required by Section 5.C.3 of the Harbor Permit Policies, which states: 5.C.3. "Prior approval of the City Council will be required before issuing a permit for shore -connected structures when the upland property is zoned commercial." The applicant is being required by State and Federal Law to upgrade the existing fuel storage tanks at his fuel dock at 814 Bay Avenue. There are currently 6 tanks of single wall construction at the site, and new law requires that they be replaced with double wall tanks. The new tanks will occupy the same location as the older tanks. In addition to the double walling of the tanks, there will be double wall piping installed, going from the tanks out to the pumping stations on the floating docks bayward of the facility. The applicant will also install electronic monitoring, which will detect any leakage in the tanks or in the double wall piping. The purpose of this bulkhead and slab is to also provide additional parking at the site and by raising the bulkhead to the city standard of plus nine, it will reduce flooding in the area during extreme high tides. Approval of the City's Public Works Department. Discussion• This application is before the City Council as required by Section 5.C.3 of the Harbor Permit Policies, which states: S.C.3. "Prior approval of the City Council will be required before issuing a permit for shore -connected structures when the upland property is zoned commercial." The applicant is being required by State and Federal Law to upgrade the existing fuel storage tanks at his fuel dock at 814 Bay Avenue. There are currently 6 tanks of single wall construction at the site, and new law requires that they be replaced with double wall tanks. The new tanks will occupy the same location as the older tanks. In addition to the double walling of the tanks, there will be double wall piping installed, going from the tanks out to the pumping stations on the floating docks bayward of the facility. The applicant will also install electronic monitoring, which will detect any leakage in the tanks or in the double wall piping. A concrete slab will be poured over the tanks, essentially, to hold them into the ground and to provide a platform for ingress and egress from the street. It will also provide some temporary parking at the site. In conjunction with the tank replacement, the applicant wishes to install a bulkhead to the west of his property, approximately 30 feet long and at an elevation of plus nine. The purpose of this bulkhead and slab is to also provide additional parking at the site and by raising the bulkhead to the City standard of plus nine, it will reduce flooding in the area during extreme high tides. The purpose of the meeting was to receive input from the various regulatory agencies that will have the most involvement in the replacement of the underground storage tanks and pipelines at your facility. The meeting was also attended by the following individuals: Mr. Dennis Lockhard, Fire Marshall, City of Newport Beach Fire Department; Mr. Stephen Badum, Senior Civil Engineer, City of Newport Beach Public Works Department; Mr. Steve Bunting, representing the City of Newport Beach Fire Department; Mr. Tony Melum, Deputy Director, City of Newport Beach Tidelands; Mr. James Henderon, representing the County of Orange Health Department. Copies of the preliminary plans for the project were distributed to the attendance, and I gave a brief overview of the various components of the fueling system that we are contemplating at this time. A number of comments and concerns were raised and I have prepared the following recap of those items and the associated decisions as follows: 1. Limit of Underground Storage Tank Size to 3,000 Gallon and Area Subject to Flooding Mr. Dennis Lockhard, Fire Marshall, expressed concern regarding Appendix H-B of the current Uniform Fire Code which restricts the capacity of underground storage tanks to a maximum of 3,000 gallons, in areas subject to flooding, unless mitigation measures are provided. This section of the code T.I.N. 95-2106456 ENG. LIC. #ME-230 #CE-38. 123 GEN. CON. LIC. ##B1-201566-C-36-HAZ ARIZ. LIC. #1792 POF-13323 Hill's Boat Service would prevent the installation of the 2- 20,000 gallon tanks that are being proposed at this time. I indicated to Mr. Lockard that on Seymour Beek's facility, on Balboa Island, we were able to mitigate the concern of flooding and buoyancy, by providing engineered calculations for the installation of a structural slab that would provide ample counter buoyancy to the underground storage tanks. A safety factor of 1.5 was provided and deemed acceptable to the Fire Department at that time. Mr. Lockard indicated that they would consider alternative mitigation measures and would like to review engineering calculations and the slab design before rendering a decision on this issue. 2. Seawall Reconstruction Mr. Tony Melum indicated the height of the reconstructed seawall must be 9.0 feet above the mean low low water level. This requirement would locate the top of the new seawall approximately 6" higher than the existing finished floor of the storage building on the fixed pier. Mr. Stephen Badum indicated that the City would be willing to work with us to adjust or elevate the street grades as much as possible, in order to minimize the grade differential caused by the new height of the seawall. Mr. Melum indicated that these changes would require City Council approval which would take approximately two weeks to schedule once he receives the final plans and a description of the project. 3. Property Line Location Mr. Lockhard was concerned with the exact location of the property lines and their relation to the location of the new, underground storage tanks to insure compliance with the Uniform Fire Code, which requires a minimum 3' setback from the property lines. Mr. Badum volunteered to provide a copy of a map from the Public Works Department to facilitate the research regarding the property lines. Due to the new requirements and the proximity of the new and old structures, it is essential that a property/topographical survey be prepared to insure the proper location of the new seawall, sheet piling, and new tanks, without encroaching on the City right-of-way or required setbacks. The survey will also help in the determination of existing grades and proposed elevations. 4. Tank and Pining Disposal a. Mr. Lockard had questions regarding the handling of the old storage tanks once they are removed from the ground. Mr. James Henderon with the County of Orange Environmental Health indicated that the July 21, 1994 2 POF-13323 Hill's Boat Service method of disposal that has been used recently reduces the length of time of removal by pumping out the residuals, and immediately transporting the tanks with an authorized hauler to an approved disposal site for degassing and disposal. The company that handles this is Erickson Co., 13738 Flover, Fontana, CA 92337; 9091355-5601. b. We have been in contact with Erickson and they have indicated that they would be willing to take the old piping at the same time that the storage tanks are removed from the site. 5. Coordination Between the City of Newport Beach Building Department and Orange County Environmental; Health Mr. Henderon was concerned with the coordination of administrative procedures of the Newport Building Department, for the replacement of underground tanks. Recently, the City has been requiring that the old storage tanks be completely removed and the site certified cleaned, and/or a cleanup plan be submitted to the County, prior to the issuance of the building permit. On the other hand, the County will not open a file if the site has no record of contamination; it will only get involved after the contamination has been discovered. Mr. Lockard indicated that he would contact the Building Department to alleviate this situation and prevent delays for this installation. It was the general consensus that it would be most desirable to minimize the amount of time with the excavation opened due to its close proximity to the street. 6. Street Closure During Construction Mr. Lockard requested that his office be given an ample notice whenever the street closure is required during construction. It is anticipated that a partial or complete street closure may be needed during the pile driving, the tanks removal and the tanks installation. 7. Emergency Shut-off Switches Mr. Lockard indicated that emergency shut-off devices must be installed at the bulkhead and at the end of the pier. 8. Stand Pine on Fuel Dock Mr. Lockard also indicated that he had measured the furthest distance of this facility from shore to be 165' and it will therefore, require that a stand pipe July 21, 1994 3 POF-13323 Hill's Boat Service be provided on the fuel dock. The stand pipe must provide a minimum of 100 gallon per minute flowing and 65 psi residual. Arrangements must be made with the City to conduct the necessary tests of the existing stand pipe. 9. Dewatering During Construction The last item of discussion concerned the disposal of the dewatering effluent. Mr. Henderon indicated that a NPDES permit would be required if the water was to be discharged in the bay. He suggested the dewater could be discharged into the sanitary sewer system provided the proper clearances are obtained and there is no contamination of hydrocarbons. The water should be processed through a sediment trap to prevent intrusion of sand into the sanitary system. We will incorporate these items and requirements into the final permit package. Dear Gary: In April 1954 the Planning Commission issued Use 'Permit No. 10-030 allowing two bait receivers at Boat Service, Inc. That Use Permit is outstanding and still in force. There was, howver, one condition to the Use Permit and that was that the receivers be inspected and found to be in compliance with the City of Newport Beach Municipal Code. Section 17.36.020 requires that bait receivers have a screened in bottom to stop bait from falling out of the receiver to the bottom of the bay and to be covered. Wes Armand of this department indicated that he has come down to your facility to inspect your receivers and they meet the requirements of the above section of the Municipal Code. Mary Moyer, 331 Seville, owner of 904 E. Balboa, three lots east of the subject pier, addressed the Council and indicated she felt there was a conflict between residential and commercial use in this instance, and that a second story was not needed and could destroy some views. Mayor Maurer, member of the Tidelands Affairs Committee, advised that the Committee had reviewed the permit in question, and viewed the site which is adjacent to the Pavilion. He stated that the second story will be 8' lower than the existing sign which will be removed. The Committee felt the addition would not be an intensification of the permitted use and, therefore, have recommended approval, subject to conditions. Ms. Moyer spoke again, stating that one of the reasons she moved from the Balboa Boulevard residence was because of the continual diesel fuel film on top of the water in the bay, which also creates a problem for swimmers. Wallace Siegel, 900 E. Balboa Boulevard, addressed the Council and stated that he has lived at his residence for approximately 10 years, and feels that Gary Hill's Boat Service has become -;a public nuisance. He also feels that 3f a second story is approved, it will block his view of the ferry, and reduce the value of his property. He stated that there is continual fuel in the bay as mentioned by Ms. Moyer and also noise emanating from Mr. Hill's pier. He stated he was just made aware of Mr. Hill's request and wished he had had more time to study the proposal. Bay Avenue, addressed the Council and stated that her home is currently for sale, and she was told by her real estate agent that if the second story were approved, it definitely would lower the value of her property, inasmuch as it would remove some of her water view. The existing structure was built in 1947 and he needs the additional space for office use. He stated that the buildings to the rear of his facility are two walk-in ice houses and a filter/tool room. He emphasized that his was the only fuel dock with no property outside the bulkhead line, with the exception of the Union dock at the other end of the bay. Tony Melum, Tidelands Administrator., addressed the Council at their request, and stated that the applicant currently has a harbor permit which is renewed annually, and which was issued in 1947. At that time, the City was allowing gas docks to be built out over public piers, and he believes there are only three in the City. He felt the City permitted the docks because they were and are a public serving business. Gary Hill, applicant, addressed the Council again, and stated that his facility is on private property, which is designated as four underwater lots, on which he pays taxes. He feels the proposal has two very major problems, inasmuch as it significantly alters the navigation along the main channel as well as to his dock. In addition, any dredging that would have to be done will alter the configuration of the sand and beach at that location. He stated Mr. Ortega was new to the area and it could be that he does not realize how "profound" his proposal is and the serious implications of his plan.
