State Health and Safety Code Sections 25297.1 and 25360 and Title 42 of the United States Code Section 6991b(h)(6) require recovery
of costs associated with the Local oversight program. When your site was put in the local oversight program, you received a
Letter explaining that the State Water Resources Control Board (State Board) would bill you for public costs of cleanup oversight.
This bill includes site specific and program management charges. Site specific charges directly relat2 to your site. Examples
are sampling for soil and ground water contamination, site inspections, and reviewing reports and workpLans. A description of
activity codes follows the itemized charges. Program management includes other costs associated with program operation. Such costs
may include: space rental, office services and supplies, purchase of sampling equipment, training and the salary and benefits of
support personnel (i.e., clerical staff, accountant, program supervisor). Program management charges are calculated at not more
than 50 percent of site specific charges. The exact rate is shown on the last page of your bill.

Dennis - Thanks for the info. As you probably figured out, this is an
unusual situation since it apparently involves the City as a property owner,
not as regulatory agency. Since it is related to tidelands administration
Tony has graciously offered to handle it.

In response to Robin's comments and to clarify the fire prevention
division's role in underground tank removal and installation:
1) The Fire and Marine Department issues a permit for the installation or
removal of underground pursuant to the municipal code
2) The plans for this work must be approved by the OCHCA prior to issuance
of the permit
3) The OCHCA is responsible for all hazardous waste, identification of site
contamination and clean up remediation
4) The Fire and Marine Department would not contract with the OCHCA for any
services in conjunction with these permit activities nor am I aware of any
prior contract activities with the OCHCA
I am unaware of any role the Fire and Marine Department played in hazardous
waste and site mitigation and cannot identify any municipal codes that
authorize such activities.
I hope this clarifies these issues, I will forward the paperwork to Chief
Mecum

Sylvia Marsten in the fire dept used to be the person in charge of oversight
of LIT removal and clean up from the fire dept's point of view. The city is
not responsible for clean up unless it is our property. Is it our property?

You, or the Company you represent, has been identified as a responsible party for the leaking
underground storage tank at the above referenced site. The attached Notice of Requirement to
Reimburse is your formal notification of your responsibility to investigate and remedy the
effects of this release and to reimburse the State Water Resources Control Board for the direct
and indirect costs incurred by local and state agencies while overseeing site investigation or
re medial action.
The Orange County Health Care Agency and the State Water Resources Control Board, have
entered into an agreement which authorizes this Agency to oversee corrective action at sites
contaminated by the unauthorized release of petroleum products from underground storage
tanks. The program developed by Orange County is funded by State and Federal monies and is
subject to the reimbursement requirements associated with the use of these funds. In order to
comply with the reimbursement requirement, it is necessary to account for all time and
materials expended by County staff at each site. On a routine basis, site specific amounts
detailing the time and expenses expended for each site will be provided to the State. The State
will then invoice the responsible parties (RPs) for all direct and indirect costs associated with
this Agency's oversight of corrective action.
This Agency will initially identify at least one RP per site, then broaden its identification
process to include all other RPs. When an additional RP is identified and added to or
dismissed and deleted from the list of RPs for the referenced site, you will receive a copy of

their Notice and an updated list of RPs. RPs may be held jointly and severally liable for site
cleanup costs. This means that the State Water Resources Control Board may collect the entire
amount due for the costs incurred at the site from any one RP or from several RPs. You may
wish to negotiate with the other RI's to allocate the oversight costs when the invoice is
received.

The federal Petroleum Leaking Underground Storage Tank Trust Fund (Federal Trust Fund)
provides funding to pay the local and state agency administrative and oversight costs
associated with the cleanup of releases from underground storage tanks. The Legislature has

underground storage tank at the above referenced site. The attached Notice of Requirement to
Reimburse is your formal notification of your responsibility to investigate and remedy the
effects of this release and to reimburse the State Water Resources Control Board for the direct
and indirect costs incurred by local and state agencies while overseeing site investigation or
remedial action.
The Orange County Health Care Agency and the State Water Resources Control Board, have
entered into an agreement which authorizes this Agency to oversee corrective action at sites
contaminated by the unauthorized release of petroleum products from underground storage
tanks. The program developed by Orange County is funded by State and Federal monies and is
subject to the reimbursement requirements associated with the use of these funds. In order to
comply with the reimbursement requirement, it is necessary to account for all time and
materials expended by County staff at each site. On a routine basis, site specific amounts
detailing the time and expenses expended for each site will be provided to the State. The State
will then invoice the responsible parties (RPs) for all direct and indirect costs associated with
this Agency's oversight of corrective action.

excavated for remedial action was inadvertently returned to the excavation. This is reflected by the

SUBJECT: MAINTENANCE DREDGING FOR BALBOA ANGLING CLUB
At the April 12, 1976 meeting, the City Council directed the Marine
Department to process an application for a dredging permit and
authorized City funding for the project in accordance with the
attached staff report. The funding for this project was not included
in the Marine Department budget for Fiscal Year 76-77.
The dredging permit has been obtained and the work completed. The.
.contractor, Shellmaker, Inc., has submitted an invoice for the work
which is attached for your use.

may result in the modification, suspension or revocation of this permit, in whole or in part, as set forth more specifically in General
Conditions I or k hersto, and in the institution of such legal proceedings as the United States Government may consider appropriate,
whether or not this permit has been previously modified, suspended or revoked in whole or in part.

b. Thal, ail activities authorized herein shall, if they involve a discharge or deposit into navigable waters or ocean waters, be at all
times consistent with applicable water quality standards, effluent limitations and standards of performance, prohibitions, and
pretreatment standards established pursuant to Sections 301, 302, 306 , and 307 of the Federal Water Pollution Control Act of 1972
(P.L. 92-500; 86 Stat. 816), or pursuant to applicable State and local law.�_,,,
c. That when the activity authorized herein involves a discharge or deposit of dredged or fill material into navigable waters, the
authorized activity shall, if applicable water quality standards are revised or modified during the term of this permit, be modified, if
necessary, to conform with such revised or modified water quality standards within 6 months of the effective date of any revision or
modification of water quality standards, or as directed by an implementation plan contained in such revised or modified standards, or
within such longer period of time as the District Engineer, in consultation with the Regional Administrator of the Environmental
Protection Agency, may determine to be reasonable under the circumstances.
d. That the permittee agrees to make every reasonable effort to prosecute the work authorized herein in a manner so as to minimize
any adverse impact of the work on fish, wildlife and natural environmental values.

f. That the permittee shall permit the District Engineer or his authorized representative (s) or designee(s) to make periodic i - nspections
at any time deemed necessary in order to assure that the activity being performed under authority of this permit is in accordance with

g. That the permittee shall maintain the structure or work authorized herein in good condition and in accordance with the plans and
drawings attached hereto;
h. That this permit does not, convey. any property rights, either in real estate or material, or any exclusive privileges; and that it does
not authorize any injury to property or invasion of rights or any infringement of Federal, State, or local laws or regulations, nor does it
obviat . a the requirement to obtain Stke or local assent required by law for the activity authorized herein.
L That this permit does not authorize the interference with any existing or proposed Federal project and that the permittee shall not
be.entitled to compensation for darfiage or injury to the structures or work authorized herein which may be caused by or result from
existing or future operations undertaken by the United States in the public interest.
j. That this permit may be §urrimarily 'suspended, in -whole or in part, upon a finding by the District Engineer that immediat
suspension 'of the activity authorized herein would be in the general public interest. Such suspension shall be effective upon receipt
the permittee of a Written notice thereof which shall indicate (1) the extent of the suspension, (2) the reasons for this action, anii
any corrective or preventative measures to be taken by the r permittee which are deemed necessary by the District Engineer to ab, te
imminent hazards to the general public interest. The permittee shall take immediate action to comply with the provisions of this notice.
Within ten'days following receipt of this notice of suspension, the permittee may request a hearing in order to present informabon
relevant to a decision as to whether his permit should be reinstated, modified or revoked. If a hearing is requested, it shall be condu ted
pursuant to procedures prescribed by the Chief of Engineers. After completion of the hearing, or within a reasonable time after is±ce
of th6 suspension notice to the permittee if no hearing is requested, the permit will either be reinstated, modified or revoked.
k. That this permit may be either modified, suspended or revoked in whole or in part if the Secretary of the Army or his authorized
representative determines that there has been a violation of any of the terms or conditions of this permit or that such action would
otherwise be in the public interest. Any such modification, suspension, or revocation shall become effective 30 days after receipt by the
permittee of written notice of such action which shall specify the facts or conduct warranting same unless (1) within the 30 -day period
the permittee is able to satisfactorily demonstrate that (a) the alleged violation of the terms and the conditions of this permit did not, in
fact, occur or (b) the alleged violation was accidental, and the permittee has been operating in compliance with the terms and conditions
of the permit and is able to provide satisfactory assurances that future operations shall be in full compliance with the terms and
conditions of this permit; or (2) within the aforesaid 30 -day period, the permittee requests that a public hearing be held to presilint oral
and written evidence concerning the proposed modification, suspension or revocation. The conduct of this hearing and the procedures
for making a final decision either to modify, suspend or revoke this permit in whole or in part shall be pursuant to procedures prescribed
by the Chief of Engineers.
1. That in issuing this permit, the Government has relied on the information and data which the permittee has provided in connection
with his permit application. If, subsequent to the issuance of this permit, such information and data prove to be false, incomplete or
inaccurate, this permit may be modified, suspended or revoked, in whoWor in part, and/or the Government may, in addition, institute
appropriate legal proceedings.
m. That any modification, suspension,'or revocation of this permit shall not be the basis for any claim for damages against the United
States.

n. That the permittee shall notify the District Engineer at what time the activity authorized herein will be commenced, as far in
advance of the time of commencement as the District Engineer may specify, and of any suspension of work, if for a period of more than
one week, resumption of work and its completion.
o. That if the activity authorized herein is not stated on or before 31st day of D e cemb er 1917 (one
year from the date of issuance of this permit unless otherwise specified) and is not completed on or before 31st _day
of December 19 T) (three years from the date of issuance of this permit unless otherwise specified) this permit, if not
previously revoked or specifically extended, shall automatically expire. .
p. at no attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the activity authorized by this permit.
q. That if the display of lights and signals on any structure or work authorized herein is not otherwise provided for by law, such lights
and signals as may be prescribed by the United States Coast Guard shall be installed and maintained by and at the expense of the
permittee.
r. That this permit does not authorize or approve the construction of particular structures, the authorization or approval of which..
may require authorization by the Congress or other agencies of the Federal Government.
s. That if and when the permittee desires to abandon the activity authorized herein, unless such abandonment is part of a transfer
procedure by which the permittee is transferring his interests herein to a third party pursuant to General Condition v hereof, he must
restore the area to a condition satisfactory to the District Engineer.
t. That if the recording of this permit is possible under applicable State or local law, the permittee shall take such action as may be
necessary to record this permit with the Register of Deeds or other appropriate official charged with the responsibility for maintaining
records of title to and interests in real property.
u. That there shall be no unreasonable interference with navigation by the existence or use of the activity authorized herein.
v. That this permit may not be transferred to a third party without prior written notice to the District Engineer, either by the
transferee's written agreement to comply with all terms and condition of this permit or by the transferee subscribing to this permit in
the space provided below and thereby agreeing to comply with all terms and conditions of this permit. In addition, if the permittee
transfers the interests authorized herein by conveyance of realty, the deed shall reference this permit and the terms and conditions
specified herein and this permit shall be recorded along with the deed with the Register of Deeds or other appropriate official.

accompanying this notice.
The dredged material will be hauled to sea by a dump barge and disposed of
at approved Environmental Protection Agency (EPA) disposal site LA -3,
Newport Beach, within a 1,000 -yard radius of Latitude 33'31'42" North,
Longitude 117*54'48" West, at a depth of 250 fathoms.
PURPOSE AND USE: To maintain an adequate depth for small craft operating
in the -area.
FEDERAL, STATE AND LOCAL AUTHORIZATIONS: This project is exempt from the
Coastal Zone Conservation Commission. Approval will be required from the
Water Quality Control Board, prior to issuing permit.
ENVIRONMENTAL IMPACT: This office does not intend to prepare an Environ -
.mental Impact Statement on this activity unless significant detrimental
effects are brought to our attention.
PUBLIC HEARING: Any person who has an interest which may be adversely
affected by the issuance of a permit may request a public hearing. The
request must be submitted in writing to the District Engineer within
thirty (30) days of the date of this notice and must clearly set forth the
interest which may be affected and the manner in which the interest may be
affected by the activity. Activities under Section 103 of the Marine
Protection, Research and Sanctuaries Act (PL 92-532) and Section 404 of
the Federal Water Pollution Control Act (PL 92-500) will be considered in
conjunction with this notification.

and date of this notice and must reach this office within thirty (30) calendar
days. The decision whether to issue a -permit will be based on an evaluation
of the probable impact of the activity on the public interest. That decision
will reflect the national concern for both protection and utilization of
important resources. The benefit which reasonably may be expected to
accrue from the activity must be balanced against its reasonably foreseeable
detriments. All factors which may be relevant to the activity will be
considered; among those are conservation, economics, aesthetics, general
environmental concerns, historic values, fish and wildlife values, flood
damage prevention, land use classification, navigation, recreation, water
supply, water quality, and, in general, the needs and welfare of the
people. Details of changed conditions on the final permit action will
be provided upon request.

Background
ITEM NO.: F-7
The City Council, on March 22, 1976, referred the attached letter
(Exhibit #1).from the Balboa Angling Club to the Marine Department
for study and report back.
The Balboa Angling Club, by their letter, describe a need for main-
tenance dredging beneath their slip facility located at "A" Street
on the peninsula. The letter requests that the City participate
financially or physically in the removal of 200 cubic yards of material
at a cost of approximately $1,000. The reason for requesting City
assistance is that the club provides public services for the citizens
of Newport Beach. In addition, the Club's limited budget based upon
a small dues paying membership does not have the necessary funds for
undertaking the project, and completing previously scheduled capital
improvements.
Lease
The primary objectives of the Angling Club are to promote the conser-
vation of fish in.local waters, compile and distribute scientific
data relating to sport fishing, promote salt water rod and reel
fishing as a sport and to promote sportsmanship among its members
and sports fishermen in general. In addition to these objectives,
the Angling Club provides the following public services:
1. Annual fishing trips for under privileged children.
2. junior fishing tournaments.
3. Official public weigh station.
4. Statistical information and fish tagging in cooperation with
State and Federal agencies.

5. Statistics, information, and specimens available for college
and student research.
6. Financial aid to conservation projects such as coastal kelp
restoration and species control programs.
7. Fishing and boating information.
8. Daily manned ship -to -shore radio communications..
9. The building and facilities are available and have been used by
civic groups such as the Power Squadron and Balboa Point Asso-
ciation.
The facilities maintained by the Balboa Angling Club over City pro-
perty are conducive to the public boating services described.
During 1974, the City Council extended a lease with the Balboa Angling
Club for an additional 25 years. A summary of the lease (attached as
Exhibit #2) describes the terms and conditions of the lease and prior
history.
Under Section II "Lease Provisions" there is a sub -section reference
Maintenance and Reeairs which states that the lessee is to keep the
pier and building in good condition and repair. The lease is silent
with respect to maintenance dredging.
The Marine Department staff has discussed the various provisions of
the lease with the City Attorney. The City Attorney's opinion is
that the lease neither obligates nor prohibits the City from partici-
pating in maintenance dredging.
Discussion
With regards to precedents, the staff is unable to find an analogous
situation. In the last five years, when the City has participated
with the County in maintenance dredging, the dredging has been
confined to channels in both West Newport and the Grand Canal. The
dredging done in these locations has been limited to the center
navigational zone (bayward of the pierhead lines). The material
dredged has been deposited on city beaches and against City bulkheads
contiguous to the project.
In the 1975-76 Fiscal Budget, there are no specific accounts set
aside for City participation in maintenance dredging project requests.
The staff has checked with the Finance Department and there appears to
be sufficient funds in the Non -departmental Section of the Budget under
Object 16 Services, Professional, Technical, etc. to handle the requested
dredging cost, if Council so desires.

In February, 1974, the City Council graciously agreed to
extend our Lease (exi.sting since 1947) for an additional
25 -year period.. This extension was granted in part upon
the club's need to expend substantial sums in capital
improvement to the property, and in part, upon the fact
that the Balboa Angling Club provides valuable public
services to the City and its inhabitants, all as shown
in documents attached to the Application for Lease
Extenslon on file with the City.
The Balboa Angling Club is a non-profit corporation that
operates entirely within a limited budget based upon small
annual membership dues. Many of thE�.- expenditures of the
club funds are directly related to providing public services
to non-members.
We have recently discovered that the bay, including the
main channel as well as the area under our public docks,
is silting in to the point wliere our facility is not usable
during low -tide conditions., Members of the public will not
safely be able to use the docking and public service
facilities that we provide during periods,of*low water
unless the main channel and sloping banks under our floats
are dredged.
We have determined that it will require the removal of
approximately two barge loads of material at a cost of

Since the Club's function is to provide substantial public
services for the City of Newport Beach, the Board of Directors
seeks the help of the City Council in physically or financially
assisting us in providing for the dredging prior to the start
of the fishing season.
The Standard Oil dock immediately to the west of our Club's
facility plans to dredge its dock area in the immediate future,
and if we can take advantage of the dredging companyts
presence at the location, they will do this dredging for us at the
price mentioned above. Will the City Council help us in this

LM BAIT RSMEVOS
I* The City of Nmport Beach sh&U never be held liable or
obligated for any injury or damage resultirg to either persons or pro -
party through the erection,, use or possession of live bait receivers.
2o The right given for the erection and maintenance of a live
bait receiver is permissive only and the Permittee shall. upon revocation
hereof* remove said live bait receiver and appurtenances thereto, within
thirty (30) days after date of mailing written notice of the revocation
of this peradt$ which notice may be mailed to the last known address of
the Permittes.
3. The City of Newport Beach reserves full right,, power and
authority to revoke this permit and in the event the Permittee fails -*Vo
remove said live bait receiver within the time specified# then the City
Engineer shall have the right to remove same at the cost and
expense of the Permittee.,
4% Live bait receivers shall be constructed in accordance with
Standard Specifications for Live Bait Receiveres adapted by the City
Council*
. 5. The Permittee shall keep the live bait receiver in good
repair at all time, Failure to repair live bait receiver, when weitten
notice has been given by the City Engineer., shall be cause for revocation
of the permit and removal of the live bait receiver&
