SUBJECT: NOTICE TO PROCEED (File No. 199915116-VAW)
Dear Mr. Armand:
Reference is made to your letter dated December 11, 1998, in which you submitted on
behalf of Mr. Brian Hartman, a notification for the maintenance dredging of 160 cubic yards
of sand and silt material at 111 E. Edgewater by hydraulic suction and disposal of the
dredged material on the adjacent beach.
Based on the furnished information, the Corps of Engineers has determined that your
proposed maintenance dredging activity complies with the terms and conditions of Permit
No. 89-211-GS (Regional General Permit No. 18) provided that Mr. Hartman's contractor does
not exceed the maximum dredging design depth of -5 feet MLLW with a maximum
allowable overdepth of -1 foot MLLW.
This letter of verification is valid until August�2r9, 1999, when RGP No. 18 will expire.
A general permit does not grant any property rights exclusive privileges. Also, it does not
authorize any injury to the property or rights of otHers or interference with any existing or
proposed Federal project. Furthermore, it does not obviate the need to obtain other Federal,
State, or local authorizations required by law.

(Sec. 7031d.5, Business and professions Code). Any City or County which requires a permit to
construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires
the applicant for such permit to file a signed statement that he is licensed pursuant to the
provision of the Contractors License Law (Chapter 9, commencing with Section 7000, of
Division 3 of the Business and Professions Code) or that he is exempt therefrom and the basis
for the alleged exemption. Any violation of Section 7031.5 by any applicant for a permit
subjects the applicant to a civil penalty for not more than five hundred dollars ($500).

Dear Mr. Hartman:
The Marine Department has received a complaint regarding the
boat plank and vessels stored on the public beach adjacent to
your pier. A field inspection has been made which confirms
this complaint. There is also an unauthorized dinghy rack built
on the beach adjacent to your pier.
The beach from Island Avenue to Alvarado Place is public beach.
Your permit allows you to construct a pier and float for
mooring vessels within your permit.zone. You are not allowed
to store equipment and/or vessels on the public beach. The
Newport Beach Municipal Code Section 17.32.030 states, in part:
"...No person shall place or allow vessels, boats, materials
garbage, refuse, timber or waste matter of any description
to remain on or upon the shorelines of the Pacific Ocean or
on the shorelines of Newport Harbor within the City. The City
manager may remove the same with or without notice, at his
option, and the cost thereof may be recovered from any person
owning the same, or placing or causing it to be placed on the
shoreline, in a civil action...".
Section 17.16.021 states further:
"...No person shall store any vessel, watercraft, or trailer,
on any public beach in the City."
This letter serves as notice to you that the above described
vessels and equipment must be removed from the public beach by
September 18, 1989 or it will be impounded, as stated above.

Dear Mr. Hartman:
This office received a complaint regarding the pier bayward from your residence at
I I I E. Edgewater. Specifically, the complaint is that you have constructed a wooden
groin wall attached to the pilings of your pier. A field inspection revealed that there is
groin wall as indicated, and in addition there is maintenance work being done to your
pier. There is no record of a permit being issued for construction of the groin wall or a
permit issued for maintenance work to your pier. This is a violation of the City of
Newport Beach Municipal Code that requires a permit for the above -described work.
Enclosed is a Warning Citation. Please remove the groin wall and submit a
maintenance permit application to do the work to your pier. Both of these should be
done within 10 working days from the date on this letter. Failure to comply with this
request will result in a citation that has a fine.
