Dear Mr. Kniss:
Reference is made to your request of March 6, 1990 to amend Permit No. 90-
049 -GS which authorized you to ad - - �y 36 -feet dock extension onto an
existing dock in Newport Bay a 219 Evening Star Lane: Newport Beach, Orange
County, California.
Under the provisions of 33 Code of Federal Regulations 325.7(b) your
permit is modified as follows:
You are hereby authorized to remove the existing dock, and construct a new
boat dock at the site.
The conditions of Permit No. 90 -049 -GS, except as changed herein, remain
in full force and effect.
Please note that a copy of this letter is being forwarded to those
agencies on the enclosed list.

Dear Sam:
The staff is prepared to issue an Approval in Concept of the
revised drawing for the above permit. Would it be possible, prior
to that, for the applicant to secure approval or a sign off on
your.8 1/2 x 11 drawing from the adjacent property owners, those
on either side?
This is an unusually large structure, and if we could get
acknowledgement from the neighbors it would preclude us from taking
it to the City Council.

these plans are approved in concept and said approval has been written upon

Should Newport Beach adopt an ordinance deleting, amending, or adding to the
Zoning Ordinance or other regulations in any manner that would affect the use
of the property or the design of a project located thereon, this approval in
concept shall become null and void as of the effective date of this said
ordinance.
In accordance with the California Environmental Quality Act of 1970, and state
and local guidelines adopted thereunder, this development:

pursuant to the California Coastal Act of 1976:

II. The South Coast Commission finds that:
A. The proposed development, or as conditioned;
1. The developments are. in conformity with the provisions of Chapter
3 of the California Coastal Act of 1976 and will not prejudice
the ability of the local government to prepare a local coastal
program that is in conformity with the provisions of Chapter 3 of
the California Coastal Act of 1976.
2. If located between the nearest public road and the sea or shore-
line of any body of water located within the coastal zone, the
development is in conformity with the public -access and public
recreation policies*of Chapter 3 of the California Coastal Act of
1976.
3. There are no feasible alternatives, or feasible mitigation
measures, as provided in the California Environmental Quality
Act, available for imposition by this Commission under the

ficant adverse impact that the development, as finally proposed
may have on the environment.
