A copy of any variance, exception, conditional use permit or other issued permit is

approved tentative tract maps. On the basis of this finding, these plans are approved in
concept and said approval has been written upon said plans, signed and dated.
Should Newport Beach adopt an ordinance deleting, amending or adding to the Zoning
Ordinance or other regulations in any manner that would affect the use of the property or
the design of a project located thereon, this approval in concept shall become null and
void as of the effective date of this said ordinance.
In accordance with the California Environmental Quality Act or 1970, and state and local
guidelines adopted thereunder, this development:

applicable policies, ordinances, codes and regulations of Newport Beach.

Reference is made to your request of October 7,2003 (File No. 200400065-SJH). Under the
provisions of Section 10 of the Rivers and Harbors Act of March 3,1899 (33 US.C� 403), you are
hereby authorized to modify the e.,dsting floating boat dock bayward of 505 and 507 Edgewater
Ave., West, in Newport Bay, in the city of Newport Beach, Orange County, Califomia, as shown
on the enclosed drawings. Modifications consist of replaciog a single floating dock covering 032 -
acre of open waters of the United States (U.S.) with two separate docks of the same dimensions,
totaling 0.017 -acre of waters of the U.S., a net decrease in coverage of 0.15 -acre.
The owner or authorized responsible officialmust sign and date all copies of dds Letter of
Permission (LOP) indicating that lie/she agrees to the work as described and will comply with all
conditions. One of the signed copies of this Letter of Permission must be returned to the Corps of
Engineers (a pre -addressed envelope is enclosed)- In addition, please use the two attached
postcards to notify this office as to the dates of commencement (within 10 days prior to the start of
construction) and completion of the activity (within 10 days following the end of construction).

Certification under Section 401 of the Clean Water Act.
