I did find that, in fact, the Arnolds.have moved their dock since it was originally measured by the City. We have no permit for this removal,.but in looking at old permits dna in looking at the dock at i -t is currently configured, it is obvious that the float has been moved 1-n towards. their property. This .being the case, if they originally had four feet, which our drawing indicated they did, and they have moved the dock at least one foot over, it appears that the vessel Tiny -Toot" can be Iggally berthed in its present location. Although it is.very close, sighting clown the property line from Buena Vista it looks to me that the "Tiny Toot" is within the Arnold's water. based on the above, we will do nothing further in this regard. On Tuesday, I spoke to the Arnolds and showed them the paperwork I had obtained from your office. (I had also spoken to Mr. Arnold on Monday questioning whether or not a small boat called "Tiny Toot" was in the waterway of 334 Buena Vista. He never mentioned the existing paperwork showing hishavingfour feet). I measured the small boat "Tiny Toot",and it is at least five feet wide and thus is at least a foot into my waterway. I asked Mr. and Mrs. Arnold to remove the boat but they said they had moved the moorings closer to their main dock so they now have five or six feet on that side of the jetty. When I called your office, you said you have no paperwork verifying such move. Without trying to create a problem or tension between myself and the Arnolds, I request you either speak with them or see that said boat is removed, since your office also feels it is in violation of 334 Buena Vista property waterway. Dear Mr. Melum: This is to confirm our complaint which we made to you in person and by telephone in early May regarding the continuing problem on our neighbors dock at 334 Buena Vista. To refresh your memory, the dock was originally built so that the son of the owner could sell boats. When this was not possible the illegal use of renting the single finger dock to liveaboards began. The first summer a boat named UN REEL, a commercial fishing boat from Mexico, leased the side tie for six months. The boat arrived in early May and was permitted to stay by the owners until October when the fishing season in Mexico resumes. The crew lived aboard the vessel as you had the Harbor Patrol verify many times. The boat would arrive in the middle of the night, unload and get washed down. This was done with no regard to sleeping people in our residential area. This boat was replace by a boat called SCOTCH ROCKS. The owner, a man from the Fullerton area, purchased the forty foot plus boat and then signed up for sailing lessons at O.C.C. In practicing his arrivals and departures from the single finger slip he quite often would be pushed by the wind into our small boat, our dock, or our larger boat in the center slip. TERRY AND THE PIRATES, a large motor sailor, was the next liveaboard tenant to lease the side tie at 334 Buena Vista. The boat arrive in early May 1985. At that time there were six boats tied to the single finger slip. Some were tied side by side so all could fit. Among the six boat was another small liveaboard sail boat of about twenty feet. Again you and the Harbor Department verified all of this. During this time we had motor oil poured in our trash can and open buckets of oil were left on the beach. In August 1985 our block was awakened very early in the morning by the Harbor Patrol on the dock of 334 Buena Vista and the Police in the alley serving warrants for arrest of the people aboard Terry and the Pirates. When this boat left we were told by our neighbors that they were sorry for all of the problems and no further trouble would occur. Well May 1986 is now here. There are three boats not owned by the property owner of 334 Buena Vista on the dock and two pulled up on the beach and the situation begins again. On a recent Friday night in the early morning hours a party on one of the boats awakened the neighbors. When a complaint was made to the offending people on the dock of 334 Buena Vista the response was they were paying rent and they can do anything they want!! The newest boat is tied on the side closest to our house. It is almost touching our boat. There is no possible way they can safely dock that size power boat on the side tie without damaging our small boat or dock. May I remind you that this is a continuing situation, where as stated in the Harbor Permit Policies, piers bayward of residentially zoned areas shall be reserved for occupants of the abutting upland property and that vessels moored at residential piers shall not create a nuisance with regard to parking, vessel waste, liveaboards or noise to adjoining residents. Further on there is a section which states that the City has the right, power and authority to revoke a permit. If you cannot get the owners to cooperate the pier permit can and should be revoked at this time. We have lived on Buena Vista since 1970. When the City Staff were checking the drawing, they realized that through this area an ordinance is in effect that allows docks only to the U.S. Pierhead Line. Normally, if the proposed work is within the existing ordinance, the City will approve administratively. Since we are going beyond the limit according to the ordinance, the proposed permit will have to be heard at the City Council. You will be notified of the date and you should plan to attend. That the applicant secure a permit from the Army Corps of Engineers.' 2. That the applicant have a permit from the California Coastal" Commission. Discussion: This permit is before the City Council as required.by Section 5.B. of the Harbor Permit Policies, which states: 5.B. "Prior approval of the City Council will be required before the Marine Department may issue any permit that does not conform to the standard Harbor Drawings and the adopted Harbor Permit Policies". Harbor Permit Policy Section 23.F requires: 23.F. "BAYWARD LOCATION OF PIERS AND FLOATS: U.S. Bulkhead Sta. No. 114 to 119: Piers will be permitted to extend to the U.S. Pierhead Line". The applicant, as indicated on the attached drawing, is proposing to construct his float 20 feet bayward of the U.S. Pierhead Line, an exception to the above quoted policy. As his drawing further indicates, and as field inspection by the staff has verified, the floats adjacent to the applicant's proposed float have been built approximately 20 feet bayward of the U.S. Pierhead Line. This is also true for most of the floats along Buena Vista. The reason this has occurred is that most of these floats were constructed prior to the adoption of the above quoted policy section. ,.� Section 24 of the Harbor Permit Policies states: 24. "EXCEPTIONS. The City Council may approve exceptions to any of the requirements and regulations set forth if there are special circumstances-or conditions affecting the harbor installations that would impose undue hardship on the applicant or if it would be detrimental to the best interest of the City. It would be detrimental to the best interest of the City to require the applicant to comply with Section 23.F. in that, by having to pull his pier closer to the shore, the applicant might be forced to dredge on a more frequent basis, and thereby jeopardize the sandy sloping beach bayward of Buena Vista. In addition to this, it would be a"hardship on the applicant to require that he comply and locate his pier on the Pierhead Line when all the adjacent floats are approximately 20 feet bayward of that line. It would also break up a historically established float Eine in this area, at no benefit to the City. The actual design and construction of the pier and float will conform to the standard drawing, the plan does not conform in that rather than a U-shaped float, the applicant is proposing a single finger float, which is not considered amaterial' deviation. For the reasons discussed above, the Marine Department is not opposed to the plan as submitted.
