This is in violation of the Newport Beach Harbor Permit Policies: Moorings, A, which states: "Boats moored at private or public docks shall not extend beyond the projection of the property lines of the property to which the dock facility is connected in accordance with section 20-C." This letter is to advise you that unless you relocate your vessel within 30 days of the date of this notice, an Administrative Citation may be issued and penalties will begin to accrue ($100, $200, $500 increments). Your cooperation will be greatly appreciated in this matter. Please note that a similar notice was issued to you in December 2001. (See attached.) And finally, to clarify, you are only permitted to dock a boat with a 5' beam (approx. Duffy size) on the side of the dock that is closest to 350 Buena Vista. Any vessel over 5' will be encroaching. (See attached drawing noting the setback.) Please see the attached picture of the infraction.
