RE: Vessel Encroachment
Dear Mr. Lemons,
A recent field inspection has revealed that there is a vessel berthed at your dock that is
extending beyond the projection of your property line at 342 Buena Vista. This is in
violation of the Newport Beach Harbor Permit Policies: Moorings, A, which states:
"Boats moored at private or public docks shall not extend beyond the projection of
the property lines of the property to which the dock facility is connected in
accordance with section 20-C."
This letter is to advise you that unless you relocate your vessel within 30 days of the date
of this notice, an Administrative Citation may be issued and penalties will begin to accrue
($100, $200, $500 increments). Your cooperation will be greatly appreciated in this matter.
Please note that a similar notice was issued to you in December 2001. (See attached.) And
finally, to clarify, you are only permitted to dock a boat with a 5' beam (approx. Duffy
size) on the side of the dock that is closest to 350 Buena Vista. Any vessel over 5' will be
encroaching. (See attached drawing noting the setback.)
Please see the attached picture of the infraction. If you have any questions regarding the
enforcement of the Harbor Permit Policies, please feel free to give me a call.

Council Harbor Permit Policy 2 LA that states:
"Boats moored at private or public docks shall not extend beyond the projection
of the property lines of the property to which the dock facility is connected"
There is a boat berthed at the dock at 342 Buena Vista Blvd that encroaches across the
projection of the side property line between 342 and 350 Buena Vista.
Please relocate this boat or remove the boat hoist within 10 working, days from the date
on this letter. Failure to comply with this notice may result in a Citation.
