Dave Mann, Harbor Master SUBJECT: Private Dock Extension 350 Buena Vista, Newport Beach As per your request, we have inspected the existing dock and adjacent mooring area with reference to extension of the dock at 350 Buena Vista, Newport Beach. There are two off -shore moorings near the dock in question. Mooring #M-4 has a 45' cabin cruiser secured to it and Mooring #M-5 has a 60' sailboat secured to it. These are single buoy moorings which allow the two moored vessels to swing 360' on the mooring depending on wind and current directions. From the documents provided to us, it appears the dock at 350 Buena Vista currently extends out to the pierhead line. It is our opinion that if the dock were extended as requested, a navigation hazard could arise at anytime that the wind or current forces the stern of either vessel towards the location in question. This could reduce the safe navigation between the end. of an extended dock and the stern of the above vessels to approximately 50' or less under certain conditions, causing a liability situation to vessels transiting the area. During our inspection, it was evident that a small section of dock, not appearing on the pier application, had been added to the existing dock on the north side. There were also five boats observed secured to the dock. It is our understanding that at least one of these boats is paying rent for the dock space. Similarly if Edgewater Avenue were designated as the "front yard", the easterly and westerly properlyline prolongation would eliminate a usable permit area. The over crowding of our bay is becoming an ever increasing hazard to those who use the bay. By 'permitting such extensions we only add to our present congestion. The intent of providing limits is to insure that there is adequate space so that all reasonable uses of the bay may be realized. Only when strict conformance would deny one person the rights that others enjoy should there be a limited variance from strict conformance. However the fact that an individual buys a 70' boat does not mean that to require conformance with the present limits would deny to him what others enjoy. We are presently faced with ever increasing encroachments upon our land, air, and sea.
