RATIONALE: The proposed development consists of the removal of an existing pier, dock and associated structures and replacement with a new pier and pilings, gangway, and dock within the U.S. Pierhead Line. The proposed pier and dock is similar in function to other residential piers and docks in the immediate vicinity. In addition, an inspection performed by the City determined that no eelgrass exists in the vicinity of proposed project. Therefore, no eelgrass will be affected by the proposed project. Also, the Regional Water Quality Control Board has determined that the proposed project will not adversely impact water quality if standard construction methods and materials are used. The proposed development will not adversely impact, coastal resources, public access, or public recreation opportunities, and is consistent with past Commission actions in the area. and Chapter Three policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their November 3-6,1998 meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the California Code of Regulations. The enclosed Notice Card shall remain postedo at the site until the waiver has been validated and no less than seven days prior to the Cornrnlssign hearing.
