(Sec. 7031d.5, Business and professions Code). Any City or County which requires a permit to
construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires
the applicant for such permit to file a signed statement that he is licensed pursuant to the
provision of the Contractors License Law (Chapter 9, commencing with Section 7000, of
Division 3 of the Business and Professions Code) or that he is exempt therefrom and the basis
for the alleged exemption. Any violation of Section 7031.5 by any applicant for a permit
subjects the applicant to a civil penalty for not more than five hundred dollars ($500)..

Please be advised that Waiver Number 5-98-366 W, which was reported the Commission on
November 6, 1998, became effective as of that date. Any deviation from the application and
plans on file in the Commission office may require a coastal development permit for the entire
project.

DESCRIPTION: Removal of an existing 81 foot long residential pier and 9 foot wide by 14
foot long residential dock. These structures will be replaced by a 66 foot
long pier, 3 foot wide by 22 foot long gangway and 9 foot wide by 25 foot
long Fshaped dock. The proposed pier will be located at the same site as
the present pier. In addition, twelve pier pilings will be removed and
replaced by 10 pilings in different locations to accommodate the new,
decreased pier length. No eelgrass was found in the project vicinity.

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments -Section 30624.7 of the Coastal Act
Based on your project' plans and information provided in your permit application for the
development described'below, the Executive Director of the Coastal Commission hereby
waives the requirement for a Coastal Development Permit pursuant to Section 13238.1,
Title 14, California Code of Regulations. If, at a later date, this information is found to be
incorrect or the plans revised, this decision will become invalid; and:, any development
occurring must cease until a coastal development permit is obtained or any discrepancy is
resolved in writing.

PROPOSED DEVELOPMENT: Removal of an existing 81 foot long residential pier and 9 foot
wide by 14 foot long residential dock. These existing structures will be replaced by a 66

project vicinity.
RATIONALE: The proposed development consists of the removal of an existing pier, dock
and associated structures and replacement with a new pier and pilings, gangway, and dock
within the U.S. Pierhead Line. The proposed pier and dock is similar in function to other
residential piers and docks in the immediate vicinity. In addition, an inspection performed
by the City determined that no eelgrass exists in the vicinity of proposed project.
Therefore, no eelgrass will be affected by the proposed project. Also, the Regional Water
Quality Control Board has determined that the proposed project will not adversely impact
water quality if standard construction methods and materials are used. The proposed
development will not adversely impact, coastal resources, public access, or public
recreation opportunities, and is consistent with past Commission actions in the area. and
Chapter Three policies of the Coastal Act.
This waiver will not become effective until reported to the Commission at their November
3-6,1998 meeting and the site of the proposed development has been appropriately
noticed, pursuant to 13054(b) of the California Code of Regulations. The enclosed Notice
Card shall remain postedo at the site until the waiver has been validated and no less than
seven days prior to the Cornrnlssign hearing. If four (4) Commissioners object to this
waiver of permit requirements, a coastal development permit will be required.

Dear Sir:
The City of Newport Beach has received an application to transfer
pier permit # 115-322 for the property located at 322 Buena Vista,
Newport Beach, California.
The structure was inspected on 7/6/87 at which time it was determined
that the following deficiencies exist:
1, Location OK
2. Plumbing - OK - Approved A/S located NW' corner of house near hose bib.
3. Electrical - OK .
4. Structural - OK - Both.pi.lings on dock cracked. Two .outermost floats
have concrete missing; floats need cleaning. Other-
wise OK.
5. Other: Upon receipt of the $250.00 transfer fee, we will complete the
ier:ra f
In accordar�ce. with 9ecri-on 10-D of the City Harbor Permit Policies
"All structural deficiencies must be corrected....:.", it will be
necessary for these to be corrected. A permit for any electrical or
plumbing work must be obtained from.the Building Department of the City.
All other work requires a Harbor Permit.
Please advise this department when the above deficiencies have been..
corrected.

an Single Family Dwelling. Project has R140CB, State Lands and Corps
of Engineers approvals.
I. The Executive Director of the South Coast Regional Commission hereby grants, subject to
condition(s), a permit for the proposed development, on the grounds that the development
as conditioned will be in conformity with the provisions of Chapter 3 of the California
Coastal Act of 1976, will not prejudice the ability of the local government having juris-
diction over the area to prepare a Local Coastal Plan conforming to the provisions of
Chapter 3 of the Coastal Act, and will not have any significant adverse impacts on the
environment within the meaning of the California Environmental Quality Act.

III. This permit may not be assigned to another person(s) except as provided in Section
13170 of the Coastal Commission Rules and Regulations.
IV. This permit shall not become effective until:
A. Completion of the Regional Commission review of the permit pursuant to the notice
of public hearing.
B. A copy of this permit has been returned to the Regional Commission, upon which copy
all permitees or agent(s) authorized in the permit application have acknowledged
that they have received a copy of the permit and have accepted its contents.
V. Any development performed on this permit prior to the review by the Regional Commission
is at the applicant's risk and is subject to stoppage upon completion of the review
pending the Regional Commission's approval and/or completion of any appeal of the
Regional Commission's decision.
VI. Work authorized by this permit must commence within two years from the date of approval.
Any extension of time of said commencement date must be applied for prior to expiration
of the permit.
