The facility was inspected on May 15, 2002. We cannot transfer the pier permit until the following deficiency has been corrected and WE HAVE BEEN NOTIFIED OF THE CORRECTION: 1. It needs an update GFI, ground fault interrupter on the electrical line to the dock. The Newport Beach City Council Harbor Permit Policies state: 10.D. "At the time of transfer, all harbor structures shall be inspected for compliance with the City's minimum plumbing, electrical and structural requirements, and the conditions of the existing permit. All structural deficiencies must be corrected prior to transfer of the permit." Please call 644-3034 to request reinspection. Once the property has passed the reinspected, and we have signatures of both buyer and seller on the application and the second half of the transfer fee, the dock will be transferred. I will attach for your information a copy -of the club's plan. At this time the City has indicated to the club that as far as the City is concerned the bulkhead is feasible. However, it would require City Council approval. At this time the application is on hold pending further action from yacht club. In addition to approval at the City Council level, permits would be required from the California Coastal Commission and the U.S. Army Corps of Engineers. He has substantiated the situation you described in your letter of February 9, 1989 that on ocassions of Santa Ana winds the small vessel tied to the shore mooring has come loose. He feels that because of its location relative to the Santa Ana winds, this may occur again. However, except for that situation the boat is properly moored and there seems to be enough area for it on the beach and the mooring perTnittee wants to keep the mooring there. We have investigated the possibility of moving the mooring to other locations. There are, however, no other comparable locations available. For the time being the mooring will remain in its present location. We will work with the Harbor Department to make sure the vessel is properly moored with sufficient tackle to keep it in its proper place. If you have further questions please contact me at 644-3044. No. You will recall we talked about the City small boat mooring located on the Buenavista Street and beach. I reside at 700 W. Bay Avenue which ajoins the Buenavista Beach and Mrs. Earl G. Corkett resides at 304 Buenavista which is located next to the east side of Buenavista Beach. Both my home a -rid the Corketts have piers located in front of their respective houses and because of the angles involved the distance between the two piers at the outboard end is much much narrower than at the beach end. In two different Santa Ana wind storms this winter, the samll plastic sailboat on the Buenavista mooring broke loose. The first storm the Harbor Department was able to tie the boat to my dock, but in the second storm it got loose again, and this time went ashore and wedged itself under my dock. The Harbor Patrol was able to assist us in freeing the boat so no substantial damage was done to our dock. The small boat on the Buenavista mooring is used at most once a year, and some years I don't believe it has even been off the mooring. The small boat mooring at times interferes with the use of both ours and the Corkett docks. The presence of the beach mooring interferes greatly with the public's use of the beach since it greatly diminishes the area where the public can swim as well as beach small boats. It is hoped that the city will take action to move this mooring to another location; and if that cannot be done, to terminate the mooring. We have no record of a permit transfer application and $50 fee being processed through our office. Council Policy H-1 Harbor Permit Policies Section 10 Transfers states: 10. Transfer of Permits A. Permits for harbor structures are issued sub-iect .J to the condition that any improvements constructed shall not be sold in whole or part, leased, or transferred, without the written consent of the City. B. Whenever a permittee sells the abutting upland -property, a request shall be made to the city to transfer the permit. Forms for this purpose may be obtained from the Marine Safety Department. Failure to apply for a transfer within 30 days from the date that the abutt- ing upland property changed ownership will result in an additional fee by the,City. C. The Marine Safety Department is authorized to approve transfers to the new owners or long -terra lessee of the abutting upland property. D. At the time of transfer all harbor structures shall be inspected for compliance with the City's minimum plumbing, electrical and structural requirements, and the conditions of the existing permit. All structural deficiencies must be corrected within 6months from date of transfer. Page 2. Section 12 Fees: States: A-3. Transfers $50.00 A-6.
