Bludau City Manager: City of Newport Beach 3300 Newport Boulevard Newport Beach, California 92658-8915 RE: Rental of boat dock space from private residence owners Dear Mr. Bludau: I've been a home owner in Newport Beach since 1966 and the owner of a bay front home and dock since 1976. This is the first time I've felt the need to contact anyone from the City to enlist their help for any reason. In this instance a major nuisance has been caused by a boat docked at 1038 West Bay Avenue next door to my home at 1034 West Bay. We have lived in this home since 1989 and because our lots are quite small (35' X 125") and open on the bay front (with a 20' setback requiring that fences be no more than 2 %Z feet in height), we're privy to all our neighbors "front yard" activities. The only thing which prevents this neighborhood from becoming an extremely high priced ghetto is the self disciplined consideration our neighbors have shown for one another. Recently this tranquility has been disrupted by the insertion of the boat "Moorea", a fractionally owned boat held by "Seanet Morrea, LLC". Seanet company is the Newport dealer for Sun Seeker Yachts and is promoting fractional ownership which is a sales enhancing tool. In this case there are six owners and Seanet is providing all provisioning and maintenance as well as the services of skippers and deck hands. This particular boat is used literally every day. Generally it leaves in the morning and arrives back at the dock at just before 10:00 p.m. when the users noisily disembark and walk to the street and their cars. The maintenance crews arrive early each morning to wash -down and scrub the boat for its next daily use. Guests arrive and park on West Bay Avenue, competing with neighborhood homeowners for already very short on street parking. Sometimes boat users stay on board overnight and on two occasions I've had to respectfully request quiet --both times after 2:00 am. Last week I visited Chris Miller, your Harbor Resources Division Supervisor, and asked him what could be done. I was left with the idea that my only hope for city relief would be if I could prove that the boat was being directly chartered or sales of other boats accomplished at the dock —tough assignment. (I think it would be interesting to find out if Seanet Morrea, LLC holds a business license and why). Chris did tell me that the City Council had asked the Harbor Resources Division to conduct a future study of dock rentals in the city. I believe the time for the study is now! "Fractional ownership" has been around with aircraft sales for some time but this is the first I've heard it used with boat sales. I believe there are five or six other Seanet LLC's in Newport and am convinced that this type of ownership and sales approach will become very popular in the future. The City would be well advised to take a hard look at this concept when applied to otherwise quiet residential neighborhoods. I believe the "fix" here is an ordinance which would prevent private dock rental to boats having multiple ownership.
