Dear Mr. Melum:
Reference is made to your letter dated June 3, 1996 in which you submitted on behalf
of Mr. Darrel Rosenberry at the Segerstrom Residence at 820 West Bay Drive, a notification
for the maintenance dredging of 100 cubic yards of sand and silt material by hydraulic
suction and disposal of the dredged material on the adjacent beach.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that Mr. Rosenberry's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

2. Approval of the California Coastal Commission
3. Approval of the Army Corps of Engineers.
Discussion•
This application is before the City Council as required by Section 5-B of the
Harbor Permit Policies, which states:
"5. ISSUING OF PERMITS
B. Prior approval of the City Council will be required before the Fire
and Marine Department may issue any permit that does not conform to the
standard drawings and the adopted Harbor Permit Policies."
The subject application does not meet the standard drawings or harbor permit
policies in that the proposed repairs to the residential bulkhead are bayward of
the bulkhead between the bulkhead and pierhead lines. Section 1-C of the
Harbor Permit Policies states:
"1. HARBOR INSTALLATION GENERAL
C. Only piers, floats and certain patio decks and their appurtenances
shall be permitted between the bulkhead and the pierhead lines."
During remodeling of the existing residence, it was felt by the applicant that the
existing poured in place wall needs extensive repairs. Because of the proximity
of the existing. residence and adjacent properties, it was felt that installation of a
new bulkhead or the driving of steel sheet piles behind the existing bulkhead
could severely affect the applicant's residence and possible surrounding
residences. As a result, the applicant has come to the City Council for an
exception to the Harbor Permit Policies to allow him the do his repairs bayward
of the existing bulkhead between the bulkhead and pierhead lines.
The Council has the authority to grant an exception to the Harbor Permit Policies
as outlined in Section 24, which states:
24. EXCEPTIONS
The City Council may approve exceptions to any of the requirements and
regulations set forth if there are special circumstances or conditions affecting the
harbor installation that would impose an undue hardship on the applicant or if
it would be detrimental to the best interests of the City."
It is the applicant's position that the location of their residence and surrounding
residences to the old bulkhead has created a special circumstance and removal of
the existing bulkhead or the driving of steel sheet piles behind the existing
bulkhead could potentially cause severe damage to the applicant's residence or
surrounding residence and therefore impose an undue hardship on the
applicant.
The applicant is asking for an exception to the above quoted Harbor Permit
Policy 1.0 and for approval to install the repair bayward of the bulkhead
approximately 12 inches.

Dear Tony:
Enclosed please find a drawing for the proposed repair to the existing bulkhead. The existing
Bulkhead is a very old poured -in-place wall with a very shallow embedment into the bay bottom.
The existing house sits back from the existing bulkhead 17 feet, and the existing tie rods are
rusting. As you will note, the new pile and coping project beyond the Bulkhead Line 12 inches.
I met with Darrel Roseberry, General Contractor; Scott Wallace, Structural Engineer; and
Lorenzo Miller, Shellmaker, Inc. on January 11, 1996 to try and determine a method of repair for
the existing wall.
We all agreed that steel sheet pile could not be jetted behind the existing bulkhead because the
jetting would undermine the existing house. We also agreed that to drive or vibrate steel sheet
pile behind the existing bulkhead would probably cause severe settlement to the surrounding
residences.
Removing the existing bulkhead and installing a new bulkhead would result in undermining the
existing residence and the neighboring residences.
I would appreciate your consideration for the approval of the repair work as shown on the
drawing. We will submit final design plans to the Building Dept. upon approval.

Dear Ms. Heimerl:
Regarding a pier permit transfer for the property located at 820
West Bair Street, the structure was inspected on July 20, 1995, at
which time it was determined that it conforms to City standards.
Although the stairs leading from the pier deck to the sand is not
part of the pier and dock proper and is not in the scope of this
inspection, it is this department's recommendation the stairway be
repaired.
Once the Marine Department has received the original pier transfer
application card, signed by both the previous owner and the new
owner, the pier permit will be transfered.

Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0116-0820-1 for the property located at 820
West Bay Avenue, Newport Beach, CA. The facility was inspected on
June 28, 1995.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch

shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."

Harbors Act of March 3, 1899 (33 U.S.C. 403), you are hereby
authorized to revise an existing residential boat dock in Newport
Bay at 820 West Bay, Balboa, Orange County, California, as shown
on the enclosed drawings and subject to the enclosed conditions.
The owner or authorized responsible official must sign and
date all copies of this Letter of Permission (LOP) indicating
that he/she agrees to the work as described and to comply with
all conditions. One of the signed copies of this Letter of
Permission must be returned to the Corps of Engineers (a
preaddressed envelope is enclosed for your convenience). Notice
of the commencement of the activity must reach this office at
least 10 days before the activity actually starts. Please use
