Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER #__.5-90-944 APPLICANT: Hal Segestrom
LOCATION: 816-818 West Bay Ave., NEWPORT BEACH
PROPOSED DEVELOPMENT: Removal of existing dock and construction of a new U.
shaped boat dock. The proposed dock will be 50 feet long and 28 feet wide and
will be within the pierhead line.
RATIONALE: The proposed development will have no adverse impacts on coastal
access or resources is consistent with the City's LUP, the Chapter 3 policies
of the Coastal Act and past Commissions actions.
This waiver will not become effective until reported to the Commission at their
December 11-14, 1990 , meeting and the site of the.proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to- the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

Dear Sirs:
I am enclosing a completed application for the dredging of
approximately 90 yards of materials from our dock in Newport
Beach, California.
As per our instructions from the Newport Marine Department and
the Intracoastal Dredging Company of Newport Beach, we are
requesting approval of this application as .soon as possible.
During the month of June 1988, after a severe storm in Newport
Beach our entire slip and our adjoining neighbor's was
completely demolished. We rebuilt it according to the approved
plans. During the months of December 1988 and January 1989, due
to abnormal low tides, the new pontoons on this slip have been
damaged. We fear that further tidal action will require
replacing and/or revamping the forward part of the dock.
Therefore, we are requesting, as soon as possible, that the
permit be approved so we may pump excess sand onto our own
property and alleviate this serious sitaal::.oa.

regarding the mooring of a vessel at your residential
float. The complaint states that a vessel, CF 6873 GB, is
currently moored in violation of the Newport Beach Harbor
Permit Policy Section 21A which states:
"Boats moored at private or public docks shall not
extend beyond the projection of the property lines of
the property to which the dock facility is connected
in accordance with Section 20-C."
The above mentioned vessel should be relocated to
avoid further action by the Marine Department. If you have
