The tide and submerged lands over which the proposed project will extend are sovereign lands of the State of California that the Legislature granted in trust to the City of Newport Beach. Therefore, you need not apply to the State Lands Commission for project authorization. You should, however, apply to all other agencies having approval authority. This action does not constitute, nor shall it be construed as a waiver of any right, title, or interest by the State of California in any lands under its jurisdiction. It is my understanding tl £at I am to pay all e.dditional .expense over and above, the cost of the pier that you had intended to ulld for your own exclusive use. I of course also pay for my own float and ramp. It is further understood that we will jointly shate the expense of the upkeep of the pier proper, but both panties will individtially maintain their respcct�.ve floats. Titus In connection with joint ownership of pier facilities at Newport 7each2 in vievr of. .possible change of ownership, and for various other reasons I came to the conclusion that it would be inadvisable to have joint ownership of a float. After your telling me at�ol.at Mrs. Titus's suggestion ths- t we might have a common pier and serarate floats, I talked with Tyr. Neville and vie made various layouts in order to see just what mooring space would b.e available under such an arrangement. After working out what seemed to me the most logical plan, I went down to see TYr, Patterson at the City Hall. to make sure just what the City's attitude would be and whether or not in his opinion the City would ever require the pier to be moved in the event that a future owner of your property for instance should not be satisfied with the existing layout. yr. Patterson said if any arrangement between you and me was m,-de, the City would issue a joint permit covering the whole situation and his opinion was that when the pier was once built no one could require its removal except the pity and he 'did net think they would take any such action. When I shevreci ?.Zr. Patterson the sketch that I had in mind, he pointed out various objections to it, some of which I had already recognized, and some which I had not thought of. He' suggested aui to a different setup and. I could see m«ny advantages in his olan. I talked to 1vr. 1\?eville about it and he saw no difficulties from a construction point. of view, so T am surmitt;ing herewith a sketch which shows what Mr. Patterson suggested. I have assumed that you would build the same size float that I have in mind, but of course that is entirely '.ap to you. The princi.nal difference between what we would have sand what is ordinarily involved. in such matters would be that the platform from which the ramps tale off, would have to be a t least 24 fe e long in order to Five a 14 foot space between the two floats. In fact Mr. Neville thou`ht it might have to ba 2C feet long in order to have the ramps entirely clear the corner piers which anchor the floats.
