Dear Mr. Melum:
Reference is made to your letter dated June 5, 1993, in
which you notified the Corps of Engineers that Mr. John Webb
intends to maintenance dredge approximately 150 cubic yards of
material by hydraulic suction from 1020 West Bay Avenue and
dispose of the material on an adjacent beach, in the City of
Newport Beach, Orange County, California.
Based on the furnished information, we have determined that
your proposed activity complies with the terms and conditions of
Permit No. 89 -211 -GS provided Mr. Webb dots not exceed the
maximum dredging design depth of -5 feet MLLW with a maximum
allowable overdepth of -1 foot MLLW.

tion for the development described below, the Executive Director of the
Coastal Comission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13250(c) or Section 132S3(c), Title 14. California
Administrative Code. if, at a later date. this information Is found to be
incorrect or the plans revised, this decision will become invalid; and. any
development occurring must COASt until a coastal development permit is
obtained or any discrepancy is resolved in writing.

and piling to be located at 1020 West Bay Avenue in the city of Balboa.
The tide and submerged lands over which the proposed project will extend
are sovereign lands of the State of California that the Legislature granted in
trust to the City of Newport Beach. Therefore, you need not apply to the State
Lands Commission for project authorization. You should, however, apply to all
other agencies having approval authority.
This action does not constitute, nor shall it be construed as a waiver of
any right, title, or interest by the State of California in any lands under its
jurisdiction.

Dear Mr. MeLum:
Do to the fact that the present Mr. Titus wishes to bui Ld his
own pier structure adjacent to his property and that he wishes
us to remove the structure we buiLt at our cosy and then buiLd
a new waLk and ramp attachment areai with the 5 foot set back
adjcent to our property.
And in as much as we must repLace the piLLings and dry—rotted
dock we now havei to obtain new insurance coverage (the
PiLLings are beyond repair5 and the dock is fuLL of dry—roo as
the wood used in the days it was buiLt was not treated).
We formaLy request that a seperate pier permit be issued to us
as the owner of record of the waLk and appendant structures
Located on the tideLands adjacent to our property Located at
1020 W. Bay Avenuei Newport Beach5 CA. -
The present Mr. Titus feeLs that he can presure us into paying
aLL costs to make the changes he wantsi by not signing a reLease
to aLLow us to do the work we must do.
The attached Letters wiLL attest to the fact that we buiLt the
structuresi paid for them and own themi and that aLL of it was
agreed to by Mr. Titus Sr. prior to construction in September of
1937.
PLease note that before the construction or License to use the
faciLity —buiLt on our property was given to the Titus famiLY5
Mr. Bent checked with Mr. Patterson at City HaLL to make sure
that we wouLd not have to move the structure on our property in
the event the Titus famiLy soLd or the property changed titLe.
We have done aLL of the upkeep and maintance on the structure
for the Last 30 yearsi charging onLy the cost of paint to the
Titus famiQ5 with no offer of any additionaL heLp.
We can even show we payed the taxes on the Titus fLoat untiL
1956 when the records were chanled on that portion. it is aLso
noted that the eLder Mr. Titus did reimburse us for said taxes.
