Lisa,
Please let the Newport Beach PD and the Harbor Patrol know that I'll be dredging outside of normal working hours on
Saturday morning and Sunday morning, November 2nd and 3rd, starting at 7 am.
The work will take place at 1132 and 1140 West Bay Avenue.
The need for exceptionally high tides to dredge these properties requires that the work be performed at these times.

Commission staff have reviewed the information submitted and determined that the above referenced dredging events conform with Consistency
Certifications CC -031-06 and the Special Conditions of Coastal Development Permit 5-06-117. Please note that the eelgrass and Caulerpa taxifolia
surveys completed are only valid for a limited time period and that additional surveys must be completed and submitted to Commission staff for
review if the dredging and beach nourishment events listed above do not commence prior to expiration of the initial survey. In addition, please note
that this authorization shall expire on March 31, 7014 and that all authorized work must be completed prior to that date.
Please be advised that only the projects described in the materials submitted for the sites listed above have been found to conform with Consistency
Certification CC -031-06 and/or conform with the terms and conditions of Coastal Development Permit 5-06-117. Any change in the projects may
cause them to lose their status as consistent with CC -031-06 and/or CDP 5-06-117. This certification is based on information provided by the
recipient of this letter. If, at a later date, this information is found to be incorrect or incomplete, this letter will become invalid, and any development
occurring at that time must cease until a new determination regarding conformance with CC -031-06 and/or CDP 5-06-117, is obtained.

Newport Boulevard, areas north of Dover Shores, portions of the Bayside Village Marina, Promontory Bay, and portions of the Balboa
Yacht Basin.

I will further hold the City of Newport Beach harmless from and indemnify the City against any claim for damages arising out of the
exercise of these permits. In addition, I shall reimburse the City of Newport Beach for all attorney's fees and other costs expended by
them in defending any claim, lawsuit, or judgment arising out of the activities of the applicant carried on under the authority of such
Permit.
I understand that any work authorized must be completed by March 31, 2014 after which a new authorization is required. I also
understand that the applicant will submit a Post Dredging Completion Report no later than 30 calendar days after completion of each
dredging project. All work scheduled to be completed before 7:00 AM or after 6:00 PM (Monday — Saturday) or on Sundays or holidays
must be approved by Harbor Resources.
Per the RGP Permit, all dredging applications will be processed by the various agencies through monthly batch submittals sent to them by
Harbor Resources, Therefore, all dredging applications must be submitted to and received by Harbor Resources by the Ist Monday of

Outline of sample collection and analysis:
COLLECTION
Samples collected by a hand coring device driven into a representative area of the dredge
site and receiving beach. Stored in plastic containers and immediately delivered to the lab.
SAMPLE PREPARATION
Entire sample transferred into I liter glass containers, deionized water added, and
mixed to desalt and disperse the sediment. The sediment is allowed to completely
settle and the clear water is removed by siphoning. The sample is placed in a drying
oven at 500C and occasionally stirred until the entire sample is completely dry. The dry
sample is transferred to a desiccator for cooling. The sample is disaggregated and a
Riffle sediment splitter is used to evenly split the sample to reduce the quantity of
material to be analyzed to an allowable retention weight for the sieves.
SAMPLE ANALYSIS
The dry split fraction is processed through a # 10 U.S. standard sieve to remove the
gravel/shell fraction of the sample. The material retained on the sieve is weighed and
value recorded. The material passing through the # 10 sieve is wet sieved through a
#230 sieve to remove the silt/clay fraction. The material retained on the sieve is
transferred back into the glass container and placed back into the drying oven at 500C.
The remaining sample is allowed to completely dry and the material is weighed and
recorded to yield the sand fraction. The silttclay fraction is calculated by subtracting
the gravel/shell and sand fractions from the total analysis weight.

This form is required to be submitted for any surveys conducted for the eelgrass, Zostera
marina, that are required to be conducted under federal or state permits and authorizations
issued by the U.S. Army Corps of Engineers and the Coastal Commission. The form has been
designed to assist in identifying eelgrass while ensuring that the required information is
consistently documented. Surveys required to be conducted for this species are subject to
modification through publication of revisions to the eelgrass survey policy. It is incumbent upon

limited time period and that additional surveys must be completed and submitted to Commission staff for review
if the dredging and beach nourishment events listed above do not commence prior to expiration of the initial
survey. In addition, please note that this authorization shall expire on October 23, 2011 and that all authorized
work must be completed prior to that date.
Please be advised that only the projects described in the materials submitted for the sites listed above have been
found to conform with Consistency Certification CC -031-06 and/or conform with the terms and conditions of
Coastal Development Permit 5-06-117. Any change in the projects may cause them to lose their status as
consistent with CC -031-06 and/or CDP 5-06-117. This certification is based on information provided by the
recipient of this letter. If, at a later date, this information is found to be incorrect or incomplete, this letter will
become invalid, and any development occurring at that time must cease until a new determination regarding
conformance with CC -031-06 and/or CDP 5-06-117, is obtained.

2010, for a Department of the Army Permit to discharge fill onto waters of the U.S., in
association with the RGP 54 Newport Harbor Dredging applications submitted on

Based on the information you have provided, the Corps of Engineers has
determined that your proposed activity complies with the terms and conditions of
Regional General Permit (RGP) No. 54 - Maintenance Dredging, Beach Nourishment,
and Dock Maintenance.
As long as you comply with the general permit conditions of RGP No. 54 -
Maintenance Dredging, Beach Nourishment, and Dock Maintenance, an individual
permit is not required.
Specifically, you are authorized to:
1. At 1200,1140,1136, and 1132 West Bay Avenue, hydraulic suction dredge 246
cubic yards (0.045 acre) of sediment (98% sand) in Newport Bay using a 6" plain
suction dredge and dispose on adjacent beaches (0.089 acre), (see attached
-2 -
figures);
2. At 1300 East Balboa Blvd, hydraulic suction dredge 85 cubic yards (0.014 acre) of
sediment (96% sand) in Newport Bay using a 6" plain suction dredge and
dispose on adjacent beach (0.047 acre), (see attached figures).
Furthermore, you must comply with the follow' ing non -discretionary Special Conditions:
1. Provide CZMA certification from the California Coastal Commission (CCC) P or
to initiating work.
A general permit does not grant any property rights or exclusive privileges. Also,
it does not authorize any injury to the property or rights of others or authorize
interference with any existing or proposed Federal project. Furthermore, it does not
obviate the need to obtain other Federal, State, or local authorizations required by law.

Outline of sample collection and analysis:
COLLECTION
Samples collected by a hand coring device driven into a representative area of the dredge
site and receiving beach. Stored in plastic containers and immediately delivered to the lab
SAMPLE PREPARATION
Entire sample transferred into I liter glass containers, deionized water added, and
mixed to desalt and disperse the sediment. The sediment is allowed to completely
settle and the clear water is removed by siphoning. The sample is placed in a drying
oven at 500C and occasionally stirred until the entire sample is completely dry. The dry
sample is transferred to a desiccator for cooling. The sample is disaggregated and a
Riffle sediment splitter is used to evenly split the sample to reduce.the quantity of
material to be analyzed to an allowable retention weight for the sieves.
SAMPLE ANALYSIS
The dry split fraction is processed through a # 10 U.S. standard sieve to remove the
gravel/shell fraction of the sample. The material retained on the sieve is weighed and
value recorded. The material passing through the # 10 sieve is wet sieved through a
#230 sieve to remove the silt/clay fraction. The material retained on the sieve is .
transferred back into the glass container and placed back into the drying oven at 500C.
The remaining sample is allowed to completely dry and the material is weighed and
recorded to yield the sand fraction. The silt/clay fraction is calculated by subtracting
the gravel/sheli and sand fractions from the total analysis weight.

SUBJECT: NOTICE TO PROCEED (No. 94 -915 -BH)
Dear Mr. Melum:
Reference is made to your letter dated July 21, 1994 in
which you submitted on behalf of the Mr. Earl Dexter at 1136 W.
Bay Avenue, a notification for the maintenance dredging of 306
cubic yards of sand and silt material by hydraulic suction and
disposal of the dredged material to an adjacent beach reclamation
area.
Based on the furnished information, we have determined that
the proposed maintenance dredging activity complies with the
terms and conditions of Permit No. 89 -211 -GS provided that Mr.
Dexter's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1
foot MLLW.

In reviewing our files of,pier permits we note that on 4/10/90 a
request was made to transfer pier permit 116-1132 for the property
at 1132 West Bay, Newport Beach. -The pier permit at this addres s
was not transferred for the following reasons:
The signed transfer card has not been received by the Marine
Department. The current transfer fee is 300.00.
The Newport Beach Harbor Permit Policies require that the pier
permit be transferred upon the sale of the abutting upland
property. Failure to transfer will result in additional fees and
revocation of the pier permit.

OF THE CORRECTION:
1. A City approved anti -syphon device is required at the water
connection to the pier and float. A drawing and description of
the device approved by the City is enclosed.
The City Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requiremenmts, and
the conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."
A permit for plumbing or electrical work must be obtained from the
Building Department of the City.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again
be inspected and when the requirements have been met the pier
permit will be transferred. Included in requirements for transfer
of the pier permit is the $275 transfer fee and the signed transfer
card.

Recommendation:
If desired, approve the maintenance dredgingapplication, and the placing
of the dredged material on an adjacent beach.
Discussion:
The.application requires City Council approval under the conditions of
approval placed on the City of Newport Beach general permit for maintenance
dredging issued by the U.S. Army Corps of Engineers, on February 12, 1974,
and.subsequently amended on May 10, 1977, to allow beach restoration. The
location and applicant for the proposed dredging and beach restoration is:
116-1136 Earl Dexter 1136 West Bay Avenue
The staff has reviewed the project and has determined that the work will
be done within the parameters of the Corps of Engineers' permit. The dredging
contractor will place a filter screen around the dredge area to control turbid-
ity. There is.no known ee'l grass in the vicinity of the project.
All dredged material will be placed on a beach bayward of a private resi-
dence which will aide in the beach's restoration.

TO ALLOW CONSTRUCTION OF A JOINT OWNERSHIP SLIP FACILITY PRIOR TO
CONSTRUCTION OF AN ADJOINING UPLAND RESIDENCE
Recommendation
If desired approve the application subject to the following conditions:
1. The permittee construct a residence on the vacant lot at 1132
West Bay Avenue which adjoins the Harbor Permit zone prior to
January 1, 1980.
2. No vessel except the permittees shall be berthedbayward of the
vacant lot.
This application is being brought to the Council for review and action because
the applicants have requested that an exception to Section 19, Paragraph A of
the Harbor Permit Policies be approved. Section 19, paragraph A reads as follows:
"A. A permit for a pier, dock or float shall not be issued until the rough
plumbing for the dwelling unit or the required restrooms serving such
pier, dock or float, has been installed and approved by the City
Building Inspector. The use of a pier, dock or float will not be
allowed until restroom facilities are completed and in operation."
The applicants wish to install the slip facility prior to installation of,the
rough plumbing on the upland property.
On August 22, 1977, Mr. Dexter applied for a permit to revise an existing
structure at 1136 West Bay Avenue. The existing structure straddles a common
property line of two lots owned by Angela Ficker White. Mr. Dexter had pur-
chased the lot at 1132 West Bay Avenue which does not presently have a house
on it. The applicants desire to change the float from a single rectangular
configuration to a jointly owned two slip "U" shaped configuration as shown
on the attached drawing. At the time of the application Trautwein Brothers,
the applicants agent, was notified that a permit could not be issued until
such time as the rough plumbing for an upland structure was installed.

APPLICANT: DEXTER/WHITE
Mr. Dexter has submitted a letter requesting an exception to Section 19,
Paragraph A of the Policies. As is indicated in the letter, Mr. Dexter,
does intend to construct a residence on the upland property and will be
making that his permanent residence. In discussion with staff, Mr. Dexter
has stated that the only vessel to be berthed at this facility would be
his 34' sailboat. Mr. Dexter currently has his vessel moored at Lido Village;
however, his agreement there.has expired.
The joint owner of the pier and float, Angela Ficker White has indicated her
agreement with Mr. Dexter's request. The access to the pier and float is
through Mrs. White's property, therefore, some control of the use of the
facility is available.
Condition Number I is suggested to insure compliance with Section 19, Paragraph
A as well as Section 1, Paragraph E should a structure not be constructed.,
Section 1, Paragraph E reads as follows:
"E. In R-1 zones, only a single pier and float or slip shall be
permitted bayward of each parcel or lot."

I am writing this letter to ask the city to grant an exception
to Section 19, -Paragraph A. I am a plumbing contractor and have
lived in the city of Newport Beach since 1962. 1 am in the pro-
cess of working on plans for the lot and plan to build in the
next couple.of years.
There is no access to the dock from.the street. The lot is com-
pletely fenced and the only access is through the house next
door, owned by Angela.Ficker Whitel and located at 1132 West
Bay Avenue. We bought.the-lot from her and she is joint owner
of the slip. She has made her bathroom facilites available to
us and I have attached a letterfrom heri so stating. We have
a 341 sailboat and are most anxious to have this approved.

II. The South Coast Commission finds that:
A. The proposed development, or as conditioned, is:
1. The developments are in conformity with provisions of Chapter
3 of the California Coastal Act of 1976 and will not prejudice
the ability of the 1 ' ocal government to prepare a local coastal
program that is in conformity with the provisions of Chapter 3
of the California Coastal Act of 1976.
2. If located between the nearest public road and the sea or shore-
line of any body of water located within the coastal zone, the
development is in conformity with the public access and public
recreation policies of Chapter 3 of the California Coastal Act
of 1976.

3. There are no feasibie aiternatives, or feasible mitigation
measures, as provided in the California Environmental Quality
Act, available for imposition by this Commission under the power
granted to it which would substantially lessen any significant
�adverse impact that the development, as finally proposed may
have on the environment.
III. Whereas, at a public hearing, held on' October 24, 1977 at

IV. This permit may not be assigned to another person except as provided
in Section 13170, Coastal Commission Rules and Regulations.
V. This permit shall not become effective until a copy of this permit
has been returned to the Regional Commission, upon which copy all
permittees or agent(s) authorized in the permit application have
acknowledged that they have received a copy of the permit and have
accepted its contents.
VI. Work authorized by this permit must commence within two years from
the date of the Regional Commission vote upon the appl-1-cation. Any
extension of time of said commencement date must be applied for prior
to expiration of the permit.

Pursuant to order of the California Coastal Zone Conservation
Commission, notice of public hearing is hereby given. Said public
hearing is scheduled on the October 24, 1977 Agenda for
application for permit, number A-9-26-77-1961

Act of 1976 and that testimony relating solely to neighborhood and
local concerns is not relevant and will not be permitted by the
Chairperson. Any written correspondence regarding the application
should be directed to this office prior to the hearing date.

Construction Permits for these projects until such time as
the rough plumbing for the upland structures has been installed.
This action is in conformance with Section 19, Paragraph A of
the Harbor Permit Policies.
Should the applicant object to this procedure, an appeal to the
City Council may be made. This appeal should be made in writing.
It would be the staff recommendation to adhere to the Harbor
Permit Policies.

Code, a statement was mailed to all bayfront property owners
who have a pier and float facility bayw'ard of their property.
According to our records, payment of the subject fee has not
been received by the City's Finance Department.
Section 17.33.050 of the Municipal Code states:
PENALTY FOR FAILURE TO PAY FEES. Any owner or
permit holder who fails to pay any fee required by this
Chapter within thirty (30) days after the same is due
shall be subject to a penalty in the amount of ten per
cent (10%) of the uncollected fee. Failure to pay the
fee plus any accrued penalty within sixty (60) days after
the fee was originally due shall constitute grounds for
revocation of the permit by 1 --he City Council.
To avoid further action by the City on this matter, please
remit the following amount.
Pier Registration Fee: 10.00
Past Due Penalty: 4.00
TOTAL FEE 14.00
