Bay, an application for the maintenance dredging of 125 cubic yards of sand and silt material by hydraulic suction and disposal of the dredged material at the offshore LA-3 dredged material disposal site (latitude 33 31'42" north, longitude 117 54'48" west) in Newport Bay, City of"Newport Beach, Orange County, California. Based on the information you have provided, the Corps of Engineers has determined that your proposed activity complies with the terms and conditions of Permit No. 89-211-GS (Regional General Permit No. 18) provided that Mr. Fondren's contractor does not exceed the maximum dredging design depth of -5 feet MLLW with a maximum allowable overdepth of - 1 foot MLLW. This letter of verification is valid until August 29, 1999, when RGP No. 18 will expire. A general permit does not grant any property rights or exclusive privileges. Also, it does not authorize any injury to the property or rights of others or interference with any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain other Federal, State, or local authorizations required by law. Thank you for participating in our regulatory program. RATIONALE: The proposed dock is within limits regulated by the City's Marine Department and is consistent with the State Tideland agreements and the previous Commission's action and the Coastal Act. This waiver will not become effective until reported to the Commission at their Febraury 23-26, 1988 meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the Administrative Code.
