Dear Mr. Hedlund:
Thank you for your letter of September 1,1999. I have asked the Fire
and Marine Department to inspect the offshore moorings near your
residence. We found six moorings that were being used other than for
the berthing of boats. Of those six moorings, three are being used by
the mooring contractors and the other three are being used by marine
construction contractors.
As you may know as a waterfront resident, it is necessary for us to have
a marine construction element servicing the dock and mooring owners
in our harbor. Because of the cost of waterfront property it is very
difficult for them to find upland locations where they can mobilize their
construction activities and store the necessary construction materials.
As a result we have allowed them to use offshore moorings, that they
own, to do some of those activities as long as those moorings are
maintained.
We also in the past have tried to assist the mooring owners in moving
their moorings into locations where they are not so visible to adjoining
residences.
The Fire and Marine Department has contacted all of the mooring
owners mentioned above and have asked them to make sure that they
maintain their moorings in as neat of a condition as possible. However,
at this point to assist our bay front property owners and our offshore
mooring owners we see no alternative but to continue this practice as
we have in the past.
If in the future you find that the moorings are not being maintained
even though they do have construction materials on them please feel
free to contact Tony Melum, Deputy Chief Marine Environmental
Division.

I hereby affirm that I am exempt from the contractor's license law for the following reasons:
(Sec. 7031d. , Business and professions Code). Any City or County which requires a permit to
construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires
the applicant for such permit to file a signed statement that he is licensed pursuant to the
provision of the Contractors License Law (Chapter 9, commencing with Section 7000, of
Division 3 of the Business and Professions Code) or that he is exempt therefrom and the basis
for the alleged exemption. Any violation of Section 7031.5 by any applicant for a permit
subjects the applicant to a civil penalty for not more than five hundred dollars ($500).

will do the work, and the structure is not intended- or .offered for sale (Sec. 7044, Business and

Sirs:
The City of Newport Beach Marine Department has received a
request to transfer pier permit 0117-1350-1 for the property
located at 1350 West Bay Avenue, Newport Beach, California. The
facility was inspected by a representative of the Newport Beach
Marine Division on July 29, 1996.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. This requirement is in accordance with Title 17 of the
California Administrative Code.
2. All electrical receptacles on the pier and dock must be GFI or
twist lock. The outlets must have covers.
The Newport Beach City Council Harbor Permit Policies state:
10.D. ,At the time of transfer, all harbor structures
shall be inspected for compliance with the City's
minimum plumbing, electrical and structural
requirements, and the conditions of the existing
permit. All structural deficiencies must be corrected
prior to transfer of the
permit."
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE
BEEN CORRECTED. Please call 644-3044 to request a re -inspection.

On August 17, 1988 the City of Newport Beach corresponded
with you regarding a violation of the Harbor Permit Policies
at the above pier and float. An inspection of the premises
on October 3,1988 indicates that the'violation described
above still exists.
As a result of the continuing violation it will be necessary
for the Marine Department to turn this matter over to the
City Attorney's office for follow up.

The City of Newport Beach has received a complaint regarding
the use of your residential float at the above address.
Specifically, the complaint is that a vessel is being
berthed on the westerly side of your float in violation
of Section 21.A. of the Harbor Permit Policies, which state:
21.A."Boats moored at private or public docks shall not
extend beyond the projection of the property lines of
the property to which the dock facility is connected...".
On August 17, 1988 the vessel "Psalty V was observed
tied on the westerly side of your dock, encroaching across
your property line into the City street end.
.To preclude further action by the Marine Department, this
vessel must be relocated to bring it into conformance with
the above quoted policy. If you have questions in this
