Dear Mr. Cantillon:
On April 4, 1979, the -Newport Beach Marine Department issued
a permit to you for the construction and relocation of a residential
pier and float. The site address of this permit was 1418 W. Bay,.the
permit number was 117-1418. A copy of this permit was also sent to
your contractor Gillis and Derby, Inc.
Upon the issuance of this new permit, your existing permit
was superceded and is no longer in effect. It was also understood, at
that time, that you would remove the pier that now encroaches upon the
common property line between 1418 W. Bay, and 1420 W. Bay once the
permit of April 4, 1979 was issued.
As of this date, that pier has not been moved. Since a new
permit has been issued, the current pier in its present location is
not covered by a valid permit. It is therefore in violation of the
Newport Beach Municipal Code Section 17.24.100 which states as follows:
"17.24.100 Structure Without Permit Declared a Nuisance -
Abatement. Every structure maintained in or over the waters
of Newport Harbor or the Pacific Ocean without a current
valid permit existing therefore when,required by this Chapter,
or maintained in a manner or for a purpose other than or
different from that provided in the permit, shall- constitute
a nuisance and shall be immediately abated and may be re-
moved. If upon written notice Ito remove any such structure
the owner thereof fails, refuses or neglects to do so within
a reasonable time specified in the notice, being not less
than five (5) or more than thirty (30) days after such notice,
the City shall abate or remove it and the cost thereof may
be. recovered from the owner of such structure in a civil.
action.. (Ord. 1090 (part); 1964: 1949 Code s 10404)."
You are hereby given notice that seven days from the date of
this letter the City shall begin procedures to remove the structure
existing without a permit as authorized by the above quoted Newport

Dear Mr. CantiIIon;
It is unfortunate that you were unaware a permit for your
new float had been issued. Attached please find a copy of the Harbor
Permit issued,on April 4,.1979. This permit is valid and all
governmental agencies having jurisdiction over this project have given
their approval.
In addition to this, as was pointed out to you in Mr. Glen
Welden's letter of August 29, 1979, the existing float was to be re-
moved and the pier that is on the property line with 1420 West Bay
was to be relocated.
This existing condition has created a nuisance and a safety
hazard, and is in violation of Section 4H of. the Newport Beach Harbor
Permit Policy which states in part:
"*H. Repairs: The Permittee shall keep the structures in
good repair at all times. Failure to repair, when written
notice has been given by the Marine Department, shall be
cause for the revocation of the permit."
Therefore, this structure must be removed within 30 days, or
it will be necessary for the Marine Department to recommend that the
permit be revoked and the structure be removed.

Dear Mr. Cantillon;
On August 2, 1979, you were informed by letter of a delinquency
in your annual Pier Administration Fee. This letter stated that because
of your failure to pay this fee the Marine Department would be recommending
to the City Council that your Harbor Permit be revoked. In addition,
the City Council will be informed that an existing pier platform astride
the common property line between your property at 1418 West Bay Avenue
and the adjacent property of 1420 West Bay Avenue has not been re-
moved as indicated on a Harbor Permit issued to you in April of this
year. Even though the float has been removed, the continued existance
of the pier platform has created a nuisance to the adjacent property ,
which has constructed a pier and float in accordance with a permit
issued for that property.
Therefore, you are hereby notified that the Marine Department
will recommend to the Newport Beach City Council at their meeting on
September 24, 1979, that your Harbor Permit for 1418 West Bay Avenue,
be'revoked in accordance with Chapter 17.24.090 of the Municipal Code
of the City of Newport Beach. Upon revocation of a Harbor Permit,
action may be taken to remove the structure in accordance with Chapter
17.24.100 of the Municipal Code. This section provides for the removal
of any structure should the owner refuse to do so. Additionally, the
collection of the cost incurred shall be recovered from the owner in
a Civil action.

Dear Steve:
In July of this year, the Marine Department was notified of a
pending transfer of the Harbor Permit for 1418 and 1420 West
Bay Avenue. An inspection made at that time revealed that
approximately 60% of the float was partially sunk and in a
hazardous -condition. The escrow company involved was notified
that this situation would have to be corrected prior to
completion of the transfer of the Harbor Permit. The Marine
Department was then told that the existing structure was going
to be removed and two new structures installed in the immed-
iate future by the owners. Based on this information, the
Marine Department agreed to transfer the Harbor Permit prior
to the correction of the hazardous conditions.
During the week of October 16, I visited the site at 1418 West
Bay and discussed the situation with the property owner. Mr. James
Cantillon. During a conversation with him, I was informed that
the "new" structure contemplated for his property consisted of some
repairs to the existing structure and then relocation to the center
of his property.
This letter is to inform you that any work performed under a permit
issued by the Marine Department will have to meet safety standards
in compliance with the City Council Harbor Permit Policies. This
could entail evaluation by a qualified Structural Engineer regarding
the materials used in the refurbishing of the pier, ramp and float
at 1418 West Bay Avenue.

On March 1 of this year, in accordance with Chapter 17 (Pier
Registration Fees) of the City of Newport Beach Municipal
Code, a statement was mailed to all bayfront property owners
who have a pier and float facility bayward of their property.
According to our records, payment of the subject fee has not
been received by the City's Finance Department.
Section 17.33.050 of the Municipal Code states:
PENALTY FOR FAILURE TO PAY FEES. Any owner or
permit holder who fails to pay any fee required by this
Chapter within thirty (30) days after the same is due
shall be subject to a penalty in the amount of temper
cent (10%) of the uncollected fee. Failure to pay the
fee plus any accrued penalty within sixty (60) days after
the fee was originally due shall constitute grounds for
revocation of the permit by the City Council:

SUBJECT: PIER PERMIT 117-1418, PERMITTEE JAfIES P. CANTILLON
The Marine Department's file on permit No. 117-1418 reflects the following
has occurred:
1. Prior to September 1, 1978, the properties at 1418 and 1420
shared a joint pier and float (see attached #1).
2. September 11, 1978, Mr. Cantillon, at 1418 W. Bay, makes
application for revision of a joint pier on the property line between
1418, and 1420 West Bay (see attached #2).
3. October 20, 1978, Dr. Wendt at 1420 W. Bay makes application
to revise joint structure on property line between 1418 and 1420 W.
Bay (see attached #3).
4. October 25, 1978, Glen wrote Gillis and Derby stating that if
Cantillon did not construct a new pier, the relocation and repairs to the
old one would have to meet City standards. Mr. Cantillon feels this
caused Gillis and Derby to break their contract with him (see attached
#4).
5. November 17, 1978, Marine Department corresponded with James
P. Cantillon indicating part of our agreement with him and Dr. Wendt.
to issue the new permits of September 11, 1978 and October 20, 1978
was that the old dock (which was in a poor state) be removed. As of
this writing, Mr. Cantillon's dock had not been removed. On November
30, 1978, Dr. Wendt's section had per Trautwein Bros. (see attached
#5).
6. November 17, 1978, Gillis and Derby wrote Glen telling him they
do not have a contract with Mr. Cantillon (see attached #6).
7. City permit is issued to Cantillon to do revision requested on
September 11, 1978 (see attached #7).
8. August 10, 1979, a letter from Gillis and Derby's attorney.
It appears that as of December 15, 1978, Gillis and Derby and Cantillon
had a contract, but Cantillon failed to post the required deposits,
therefore, Gillis and Derby backed away. (see attached #8).
9. August 29, 1979, Glen writes Cantillon indicating work under
permit issued in April still not done, and existing situation is creating
a nuisance (see attached #9).
10. September 19, 1979, in response to Mr. Cantillon's contention
City Attorney

that he never received a copy of the City permit, I sent him a copy (see
atta hed #10).
1. October 30, 1979, no work has begun at 1418, and Dave writes
to tell Cantillon that the existing structure has no permit and will
be removed (see attached #11).
12. November 7, 1979, Cantillon calls Dave and says he will get
something going next week and will call (handwritten note in file).
13. November 16, 1979, I spoke with Mr. Cantillon at his residence
by phone. He stated he had a contract with Ken Thompson, Marine Contractor,
to remove the pier. He will have Ken call me.
14. December 10, 1979, I called Ken Thompson's secretary, she dis-
cussed the situation with Ken and called me back. Ken has no agreement
.with Mr. Cantillon.
15. Copy of contract with Gillis and Derby to remove pier and float
(see attached #12).

II. The South Coast Commission finds that:
A. The proposed development, or as conditioned;
1. The developments are in conformity with the provisions of Chap _er
3 of the California Coastal Act of 1976 and will not prejudice
the ability of the local government to prepare a local coastal
program that is in conformity with the provisions of Chapter 3 of
the California Coastal Act of 1976.
2, If located between the nearest public road and the sea or shcre-
line of any body of water located within the coastal zone, the
development is in conformity with the public access and public
recreation policies of Chapter 3 of the California Coastal Act of
1976.
3. There are no feasible alternatives, or feasible mitigation
measures, as provided in the California Environmental Qualit;T
Act, available for imposition by this Commission under the
power granted to it which would substantially lessen an,; signi-
ficant adverse impact that the development, as finally proposed
may have on the environment.
III, 1tihereas, at a public hearing, held on January 22, 1979 at
Huntington Beach by a unanimous tscs vote permit apalicatio
number A-78-4595 is approved.
IV. This permit may not be assigned to another person except as provided in
Section 13170, Coastal Commission Rules and Regulations.
V. This permit shall not become effective until a COPY of this perr:it has
been returned to the Regional Cow+ission, upon w'nich copy all per-;ittees
or,agent(s) authorized in the permit application have acknowledged tlinat
they have received a copy of the permit and have accepted its contents.
VI. Work authorized by this permit must commence within two years frcm the
date of the Regional Commission vote upon the application. Any extension
of time of said commencement date must be applied for prior to expiration
of the permit.

Dear Mr. Cantillon:
In July of this year, the Marine Department was notified of a
pending transfer of the Harbor Permit for 1418 and 1420 West
Bay Avenue. An inspection made at that time revealed that
approximately 60% of the float was partially sunk and in a
hazardous condition. The escrow company was notified that this
situation would have to be corrected prior to completion of the
transfer of the harbor permit. The Marine Department was then

to not require immediate correction of the situation.
During the week of October 16, I visited 1413 West Bay Avenue
and discussed the situation with you. You indicated at that
time that you had a contract with Gillis and Derby and would
have them remove -the sunken float immediately.
As of this date, this hazardous condition still exists. Addition-
ally, upon inquiry to Gillis and Derby, I have been informed that
they no longer have a contract with you for any type of work on
the pier or float. Consequently, it appears that the sunken float
may not be removed in the near future.
Therefore, in accordance with Chapter 17.24.090 of the Municipal
Code you are hereby notified that the Newport Beach City Council,
at a public hearing on December 20, 1978, will consider a report
from the Marine Department recommending that the Harbor Permit
for 1418 W. Bay Avenue issued to you be revoked.
Upon revocation of a Harbor Permit, action may be taken to remove
the structure in accordance with Chapter 17.24.100 of the Municipal
Code which reads as follows:

1117.24.100 Structure Without Permit Declared a Nuisance - Abatement.
Every structure maintained in or over the waters of Newport Harbor or
the Pacific Ocean without a current valid permit existing therefor when
required by this Chapter, or maintained in a,manner or for a purpose
other than or different from that provided in the permit, shall con-
stitute a nuisance and shall be immediately abated and may be removed.
If upon written notice to remove any such structure the owner thereof
fails, refuses or neglects to do so within a reasonable time specified
in the notice, being not less than five (5) or more than thirty (30)
days after such notice, the City shall abate or remove it and the cost
thereof may be recovered from the owner of such structure in a civil
action."
Should the facility in question be removed prior to the City Council
meeting, please let me know.

Dear Mr. Cantillon:
During the transfer inspection of the pier and float at 1418/1420
West Bay Avenue, it was noted that the electrical wiring was in a
deteriorated condition.
The Marine Department asked the City's Building Department to
inspect the wiring in detail. On September 11, 1978, it was
inspected and a correction tag posted on the facility.
It is my understanding that the facility will soon be rebuilt,
however, for the protection of those using the dock, the electri-
city should be turned off immediately. If you have any questions
in this regard, please contact me at 640-2156.
