Sirs:
The City of Newport Beach Fire and Marine Department has received a request to
transfer pier permit 11902241 for the above -mentioned property. The facility was
inspected on March 1, 1998. We cannot transfer the pier permit until the following
deficiency has/have been corrected and we have been notified of the corrections:
A City -approved anti -syphon device is required at the water connection for the water
to the pier and float. A sketch showing the approved type of device and its installation
is enclosed. This requirement is in accordance with Title 17 of the California
Administrative Code. The State of California Department of Health no longer
accepts the device that is currently on the water line.
2. There are two electrical receptacles at the bottom of the ramp that are not twist lock or
GFI.
The Newport Beach City Council Harbor Permit Policies require that at the time of
transfer, all harbor structures shall be inspected for compliance with the City's minimum
standards, and the conditions of the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re -
inspection.

Dear Mr. Ensign:
The sections of the policies that you quote, 21A and 21C are still the
current sections of the Harbor Permit Policies and have not been
revised probably for 20 years. Enforcement of encroachments across
permit zones has been our policy in the past. If there has been an
encroachment between adjoining property owners and they each
acquiesce to the encroachment, we will not become involved.
However, if the encroachment is onto public property we become
involved and request that it be removed. it is my understanding that
we received a complaint regarding the encroachment and that
triggered our inspection of the site, wherein we noticed the
encroachment into the City street end.
Currently, there is no mechanism available to allow encroachment into
City street ends, therefore the encroaching vessel must be relocated
within the property lines. If you elect to move your dock one way or
another there is a mechanism for a revision permit. We would be glad
to assist you in that process. However, during the time required to get
the permit and do the construction, the encroachment must be abated.
If you have additional questions or wish to discuss this with me, please

Can you provide information as to the procedure to prevent strict
application of section 21-A under Section 20-C at 224 20th Street,
Newport Beach?
I have enclosed a copy of Section 20 and 21 that were mailed to me
in 1969 when we obtained the permit. Are my copies current? We
have owned this property for 30 years and over the years boats from
time to time have encroached into the street end without complaint.
Has there been a change in city policy? I have sketched out our
request on Attachment A.
If the policy is to be strictly enforced, I can move the pier to
the east 4 feet, but as is shown in Attachment B, the boat on the
easterly side of the pier will impact the side ties at 233 19th.
Street and the side tie will only be usable by very narrow boats.
I would appreciate hearing from you as Wes Armand has given me
until September llth to remedy the situation. I have requested an
extension from him to September 31st. See enclosed copy of my
letter to Wes Armand.

2. The name and address of the manufacturer of all pumping equipment;
3. A complete description of the materials and the pumping equipment to
be used;
4. An 8-1/2 x 11, or larger, sketch clearly showing the location of the
sewage discharge lines, the connection to the sewer system, and the
area to be served.
20. SET BACKS
A. All piers and floats for residential properties shall be set back a
minimum of 5 feet from the projection of the property line.
B. All piers and floats for commercial properties may extend to the projection
of the property line.
C. The projection of the property line bayward of the same bearing from the
bulkhead shall generally be used in determining the allowable set backs
for piers and floats. Because there are certain physical conditions which
preclude the strict application of this policy without prejudice to adjoin-
ing properties, Council approval will be required in areas where precise
projections of the property line have not been determined and the following
conditions exist:
1. Where property lines are not approximately perpendicular to the bulk-
head line.
2. Where curves or angles exist in the bulkhead line.
3. Where bridges, topography, street ends or publicly -owned facilities
adjoin the property.
21. MOORINGS
A. Boats moored at private or public docks shall not extend beyond the pro-
jection of the property lines of the property to which the dock facility
is connected in accordance with Section 20-C.
B. Any boat moored at a pier, dock, or float shall not extend bayward a dis-
tance of more than the width of its beam beyond the pier, dock or float.
22. BALBOA ISLAND
No new, non-commercial piers on Balboa Island shall be recommended unless it
is in the public interest or unless it is at such a location that it is not
usable for swimming or bathing.
Piers presently in use may be repaired but recommendations for any additions
or remodeling shall be restricted to such changes that do not lessen the use
of either the immediate water or land areas.

I am responding to your undated notice.
The vessel you refer to is moored by a tenant in my property at 224
20th`Street. The tenant is on a month -to -month tenancy and I cannot
-change the terms of his tenancy without giving him 30 days notice.
As a person I must abide by the laws of the Stateof ,California
regulating the relationship of landlord and tenant and what you are
asking me to do would violate the tenant's legal right to 30 days
notice. I trust you will not put me in the untenable position of
having to accede to your 10 day demand by compelling the tenant to
vacate the space on 10 days notice.
It would be most helpful if you could inform me in writing as to
the precise encroachment. If you will give me 30 days we should
have a solution to the encroachment in progress. So please advise

Dear Mr. Melum:
Reference is made to your letter (No. 94-242-BH) dated
December 22, 1993 in which you submitted on behalf of James
Ensign at 224 20th Street, a notification for the maintenance
dredging of 135 cubic yards of sand and silt material by
hydraulic suction and disposal of the dredged material on the
adjacent beach.
Based on the furnished information, we have determined that
the proposed maintenance dredging activity complies with the
terms and conditions of Permit No. 89-211-GS provided that Mr.
Ensign's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1
foot MLLW.

Dear Mr. Ensign:
The Marine Department received a complaint that the vessel Niki had
individuals living aboard the vessel in violation of the Harbor
Permit Policies that limit the length of time one may reside aboard
any vessel berthed at a residential dock. Generally that length of
time is three days. Living aboard a vessel in excess of three days
is a violation.
The Orange County Sheriff's Harbor Patrol investigation verified
that the vessel Niki did have a married couple living aboard
(Mr/Mrs Fields) and had been doing so for about one month at the
dock bayward from 224 20th Street. (report attached)
Information received by this department indicates that the Fields
have moved off the vessel and are using it on weekends only. If
that is the case then please accept this letter as information for
your consideration in future arrangements with persons renting
space at your docks.
