As you pointed out, my facility is not a boat yard, it is never -the -less a commercial operation which has depended on being able to be berth vessels on the east side of the docks. Before I took possession of this property this complex had been in foreclosure for a long time. I have worked long and hard to bring this facility up to a high standard and I hope the City appreciates the hard work and expense that has gone into this endeavor. I need the revenue that comes from the vessel berthed in this questionable area. In conversations with the owners of the neighboring boat yards it appears there my be provisions for there to add a section of the City Street End to there commercial permit. What I seek, since my facility holds the same permit as there's, is to have my permit area increased as well to include a portion of the street end. I understand this would increase the annual permit fee. As far as the users at the street end, there are no beaches. The drop off is always 10 feet and since I have been here we have only had a handful of fisherman and I have never seen anyone access the bay from this location. It would be to dangerous since there is a large sewer control duct protruding out past the street end approximately 5 feet into the bay, therefore making it to dangerous for boats or swimmers. The facility was inspected on February 23, 1998. We cannot transfer the pier permit until the following deficiency has/have been corrected and WE HAVE BEEN NOTIFIED OF THE CORRECTION: The wet standpipe system needs to be serviced. All cabinets must be serviced with evidence that they are totally functional, and contain the required extinguishers, proper hoses, and glass panels. The Newport Beach City Council Harbor Permit Policies state: 10.D. "At the time of transfer, all harbor structures shall be inspected for compliance with the City's minimum plumbing, electrical and structural requirements, and the conditions of the existing permit. All deficiencies must be corrected prior to transfer of the permit." PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN CORRECTED. Please call 644-3044 to request a re -inspection. I Have also had a discussion with the City Attorney's Office relative to that section of the Municipal Code that was faxed to you. In the past, it has been the Marine Department's policy in dealing with other lending institutions, that should they acquire the upland property as a result of some kind of foreclosure or other mechanism, once they have established control of the property then we would either transfer the Harbor Permit to that entity or to a subsequent purchaser. Again, the operational concept here is that the lending institution acquires interest in the upland property, and then based on that interest we can transfer the Harbor Permit to them. We have never had a situation where the lending institution has just acquired the Harbor Permit and the docks independent of interest in the upland property. At the time of my inspection, the crane was still parked on the damaged slab and the damaged outrigger was positioned over the failed area. It is my opinion that the slab failed due to lack of subgrade support in the soils adjacent to the bulkhead. Similar conditions have been observed behind other bulkheads in Newport Bay where the soils behind the bulkhead migrated through the bulkhead due to tide -induced groundwater flow. It is not unusual for this condition to result in distress to slabs, foundations and other settlement -induced damage to improvements located in close proximity to the bulkhead. It is recommended that the area behind the subject bulkhead be carefully evaluated by a professional soils engineer retained by the owner prior to any further on site improvements or repairs to the damaged slab are considered. Failure of other slab areas at this Iocation may occur under future loading situations similar to that which resulted in the recent accident. The discha-rger shall have, and implement, an acceptable written quality assurance (QA) plan for laboratory analyses An annual report shall be submitted by January 30 of each year which sum- marizes the QA activities for the previous year. All monitoring instruments and devices used by the discharger to fulfill the prescribed monitoring program shall be properly main- tained and calibrated as necessary to ensure their continued: accuracy. g. The flow measurement system shall be calibrated at least once per year or more frequently, to ensure continuedaccuracy• C. General Reporting Requirements 1. The discharger shall submit to the Board on or before each compliance report date, a report detailing his compliance or noncompliance with the specific schedule date and task. i (7) 4. Discharge monitoring data shall be submitted to the extent possible on preprinted Discharge Monitoring Report forms to be.supplied by the Board and EPA. Other specific reporting formats which may include magnetic tape, punched cards or direct computer entry may be prescribed at a later date. Unless otherwise specified, discharge flows shall be reported in terms of the 30-day average and the daily maximum discharge flows. The resultsof all monito ing required by this order shall be reported to the Board, and shall be submitted in such a format as to allow direct comparison with the limitations and requirements of this order. 5. The discharger shall file with the Board a report of waste discharge at least 120 days before making any material` change or, proposed change in the character, location, or volume of -the discharge. 6. The results of any arralysi s of samples taken more frequently than required at the locations -specified -in the Monitoring and Reporting Program shall be reported to the Board. 7. The discharger shall file a written report with the Board within ninety (90) days after. the average dry-weather.waste flow for any month equals or exceeds 75 percent of the design capacity of his waste treatment and/or disposal facilities.. The discharger's senior admin- istrative officer shall sign a letter -which transmits that report and certifies that the" policy -making body is adequately informed about it. The report shall include: - a. Average daily flow for the :mo'nth, the date' on which the instantaneous peak flow occurred, the rate of that peak flow, and the total flow for the day: b. The discharger's best estimate of when the average daily dry -- weather flow rate trill equal or exceed the design capacity of � his: facilities.. c. The discharger"s intended schedule for studies, design, and other- .. , steps needed to provide additional capacity for his waste treat- ment and/or disposal facilities before the waste flow rate equals the capacity of present units. (Reference: Sections 13260, 13267(b), and 13268, California Water Code.) 8. The discharger shall notify the Board not later than 180 days in advance of implementation of any plans to alter production capacity of the product line of the manufacturing, producing, or processing faci- lity by more than 10 percent; Such notification shall include estima- tes of proposed production rate, the type of process, and projected effects on effluent quality. Notification shall include submittal of a new report, of waste discharge and appropriate filing fee. (g) 9. Page Two DISCUSSION The application is the result of Newport Beach Iduni cinal Code Section 17.32.015 Vessel Bolding Tank Requirements; liarina Put1p-oat Facilities, which became effective January 1, 1974. The ordinance requires all vessei.s with a dead to have a sewage holding ank. Also, the owner and operator of every commercial marina must provide a pump -out facility or equivalent service he proposed mobile sewage pump -out business is the offshoot of the "equivalent service" part of the above ordinance This application for a Commercial Harbor Activity Permit was forwarded by the City's Finance Department to the Marine Safety Department for disposition. Prior to issuance of this type of , permit the Newport Beach Municipal.Code requires that application shall be referred to the Police Department, Marine Safety DepartrLieiit, and other appropriate City depart- ments, As well as the Orange County Harbors, Beaches and Parks Department and Joint Harbor Committee for investigation and 'report. The Joint Harbor Committee at their January 8 meeting reviewed the subject application and recommended Approval of t11is permit. After consideration of relevant information at a public nearing, the City Council may decide whether to issue or deny the requested permit, based'on.the following factors as prescribed by Section 17.41.060 of the Municipal Code A. Permit from Other Agencies: The party or partite to whom this permit is issued shall, v7henever the same is re cuired b,, law, secure the written order or consent to any work hereunder from the VJar Department of the United States or any other public body having jury rydiction, and thf_c permit shall. be 'LJ' suspended in operation unless and until such order or consent is obtained, 3, Transferring Permit: This permit is not trans- ferable without the written consent of the City Council of Newport Beach. 4. Notice Prior to Starting Work: The Permittee shall notify the City Tngineer at least three (3) days in ad- vance of the date work is to begin and its completion. 5. Inspection: The work shall be subject to the supervision and a -or val of the City Engineer. On work which requires the presence of an employee of the City of Newport Beach as inspector, the salary and other incidental expense of such inspection during the work shall be paid by the Permittee upon presentation of a bill therefor. 6. Protection of Traffic.- Adequate provisions shall be made for the protection of the traveling public. Barricades shall be placed on streets, with red lights at night, also flagmen employed, all as may be required by the particular work in progress. The Permittee shall not attempt to forbid the full and free use by the public of all navigable waters at or adjacent to the work or structure. If the display'of lights and signals on any work hereby authorized is not otherwise provided by law, such lights and signals, as may be prescribed by Bureau of Light Houses, Department of Commerce, shall be installed and maintained at the expense of the Permittee. 7. Liability for Damages.- The Permittee is respon- sible for all liability for personal injury or property damage which may occur through work herein permitted, and in event any claim is made against the City of Newport Beach or any de- partment, officer or employee thereof, through, by reason of, or in connection with such work; Permittee shall defend, in- demnify and hold them and each -of them haritless from such claim. This permit shall not be effective for any purpose unless and until the above named Permittee files with the City of Newport Beach, a surety bond in the form and amount required by said city, ,unless specifically exempted on the face hereof. The City of Newport Beach shall never be held liable or obligated for any injury or damage resulting to either persons or property through the erection, use or possession.of commercial boat slipsi 2. Boat slips shall be so constructed as not to obstruct, Interfere with or prevent the free, use or passage of any sidewalks, street, alley,, public way Qr navigable channel. 3. The right given for the erection and maintenance of boat slips is permissive only and the Permittee shall upon revocation hereof, remove said boat slips and appurtenances thereto within thirty (30) days after date of mailing written notice of the revocation of this permit,- which notice may be mailed to the last known address of the Permittee. . 4. The City of Newport Beach reserves full right$ power and authority to revoke this.perralt and in the event the Permittee fails to remove said boat slips within the time specified, then the City Engineer shall have the right to immediately remove same at the cost and expense of the Permittee. '. 5. The Permittee shall keep the boat slips in good repair at all times. Failure to repair the boat slips, when written notice has been given by the City Engineer, shall be cause for revocation of the permit and removal of the boat slips. A -a 62P1114 0* 'M� aim k STANDARD SPECIFICATIONS FOR M} S TRUC TION OF C0.17T -i RC IAL PIERS AND BOAT SLIPS 1. PLANS. Detailed plans shall accompany all applications for permit to construct corrq,ercial piers, boat slips or other structures, 2. PILING. Piling shall be either reinforced cement concrete or creosoted treated wood. Concrete for concrete piles shall consist of one (1) part cement' two (2) parts sand, and three (3) parts rock. All reinforced steel shall be imbedded in the concrete at least 2ti". All wooden piling shall be pressure treated with. 16 pounds of creosote per cubic foot of wood. All piling shall be approved by the City Engineer before ?lacing. Piling shall be cut off at an even height and shall not extend higher than 12 feet above mean lower low water. The piling shall be driven to true line and grade. 3. FLOATS. Wooden floats shall be constructed to conform in general with the specifications for floats, as shown on Sheet 4 of Standard Plan No. 1055 for "Pier and Landing Float". Floats or -pontoons used in the construction of boat slips shall conform in general to said Plan No. 1055. The decking; shall be substantially constructed of common Oregon Pine. .fetal barrels to serve as pontoons may be used, pro- viding they are properly anchored to the decking of the boat slip and meet with the approval of the City Engineer. 4. PAINTING. All piers, floats, and railings shall be painted as specified by the City Engineer. 5. SPECIAL STRUCTURES . Detailed plans and specifications shall be submitted on all other structures not enumerated above.
