In the thirty-seven years that we have been part of the Newport Beach business community this space has become an integral part of our day to day business, the use of this space allows us keep to the boat yard operative. This space has never been of recreational or commercial value due to its bulkhead and large storm drain. In addition the change in the use of the area from commercial to residential has negatively impacted us. Further loss of space would jeopardize our operation and seriously impair our daily function and our ability to help in "Homeland Defense" as we are working with Government Departments to bring their various vessels to new standards. Therefore creating a loss of revenue to us and to the City of Newport Beach, it is our proposal that we be allowed the continued Grandfathered use of the space and the additional tax liability for use of this space be billed on our annual mooring tax bill. Box 1768 Newport Beach, California 92658-8915 As you are aware, we are getting ready to have some maintenance repairs made to the existing structures of our "weighs car system"., If you could please let me know what the City of Newport Beach will require for us to proceed with the maintenance. Our weighs car rolls on a railroad type rail. The rails lay on wooden bunks; with age these beams have suffered from typical environmental forces. These beams are supported by pilings. Underwater inspection by Shellmakers revealed that the pilings are all in good condition and that some of the wooden bunks need to be replaced. The facility was inspected on 4/28/92. We cannot transfer the pier permit until the following deficiency has/have been corrected and WE HAVE BEEN NOTIFIED OF THE CORRECTION: 1. A City -approved anti -syphon device is required at the water connection for the water supply tothe pier and float. A sketch showing the approved type of device and its installation is enclosed. The Newport Beach City Council Harbor Permit Policies state: 10.D. "At the time of transfer, all harbor structures shall be inspected for compliance with the City"s minimum plumbing, electrical and structural requirements, and the conditions of the existing permit. All structural deficiencies must be corrected prior to transfer of the permit." A permit for plumbing or electrical work may be obtained from the Building Department of the City. PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN CORRECTED. When we have been notified, the structure will again be inspected and when the requirements have been met the pier permit will be transferred. I have been advised by both parties that unless there is a condition established in the use permit that was granted to Blackie's Boat Yard on May 7, 1964 prohibiting the use of spray painting, or by the insertion of the wording in the use permit to the effect that should a condition exist that would be detrimental to the health, safety, ,or welfare of the public, then there is Little that the City can do in solving your apparent problem. You are more than welcome, at any time, to review the City's file on the use permit for the subject property. Should you find something in the file that we have over -looked we will be more than happy to reconsider our position at that time. We contacted. Paul and Vicki Michalczyk, owners of the'Balboa Boat Yard. They indicated that the overspray and dust from sandblasting on the weekend of April 7th and 8th were caused by"a contractor to whom they had leased space. The Michalcyzk.'s acknowledged responsibility for the paint overspray on your car (5/1/84) and have agreed to have the car detailed out. I understand you have agreed to this settlement. Our inspector did not observe the activities about which you complained.. We were also unable to contact other persons mentioned —in your letter who experienced similar damages. The Michalczyk's are responsible for'all activities at their boat yard, of course, and have agreed to submit permit,appli- cations for their two airless paint spray systems. The Michalczyk's have further agreed to enclose the the paint spray area with shrouding in the.future. For your information, bottom coat, a cuprous oxide algicide in a resin binder, and urethane type varnishes are the primary materials being sprayed. They own no sandblasting equipment. Sanding is done with a rotary disc sander and vibrater. The materials sprayed and sanded should not create a health hazard off -site if properly handled. There remains the potential for a public nuisance situation with any paint spraying operation. The Michalczyk's do appear to be making sincere efforts to control the problem. Report from the City Attorney regarding APPLICATION OF THE EMBSGENCY TANNING ORDINANCE TO Z-OTIC TAN SALON. The City Attorney advised that LJ%, Inc., using the trade name, "%-otic Tan," operates tanning salons which offer live modeling, and sales of lingerie. On November 25, 1991, and again on December 9, the Council adopted interim urgency ordinances prohibiting the establishment of such businesses in Newport Beach pending completion of a Planning Study. LJ% contends the ordinance does not apply to their proposed operation because they filed business license and live entertainment permit applications before the effective date of the emergency ordinance. Their office advised LJX that the ordinance did apply to them, but agreed to submit the matter to the Council for direction. The City Attorney stated that he has explained in his memorandums of January S and 13, 1992, why he felt the moratorium does apply to LJ%. WYNN: Mayor Sansone presented two flags to the City Manager, noting that the American flag was flown over the U.S. capitol on August 2, 1991, at the request of Congressional Representative Chris Cox, to commemoratethe twenty-year anniversary of Mr. Wynn's`tenure as City Manager of Newport Beach. The flag.was then flown over Newport Beach City Hall complex on December 30, 1991, Mr. Wynn's final full day as the City Manager of Newport Beach. Included with the American flag is a certificate signed by the architect of the Capitol Building certifying the authenticity of this flag and its testimony. The City of Newport Beach flag was flown with the American flag over City Hall on December 30, 1991. Meeting adjourned at 9:45 p.m. to 2:00 p.m., January 24, 1992 to meet in closed session.
