Regarding the Maintenance Permit for the reconstruction of the
docks bayward of 611 Lido Park Drive: as you are aware the Plans
and Specifications for this reconstruction have been reviewed by
the Public Works Department. _It will be necessary, prior to the
reconstruction of the docks, that an inspection schedule be set up
with the Public Works Department, in particular with Pat Dunigan.
It will be necessary that he inspect the docks sometime during
construction and before the final permit is issued.

Dear Ms. Young:
You have submitted permit requests for the rehabilitation of the
bulkhead wail and the rehabilitation of the dock structure bayward
of the above address. Based on your statements that the repair to
the wall is essentially a repair -in -place and the rebuilding of the
marina will not change the existing location or dimensions of the
marina, the City of Newport Beach Marine Department will be issuing
a Maintenance Permit.
The Maintenance Permit will require that a Building Permit be
pulled for the repair to the wall and the dock work must be Plan
Checked by the City of Newport Beach Public Works Department. Once
the Building Permit has been issued and the Plan Check has been
done, the Marine Department will issue the final permit and
construction can begin.

SUBJECT: HARBOR PERMIT APPLICATION 124-611 BY VISTA DEL LIDO
CORPORATION TO REVISE THE COMMERCIAL BULKHEAD
BAYWARD OF 611 LIDO PARK DRIVE
Recommendation:
If desired, approve the application subject to the following
conditions:
1. Approval by the City of Newport Beach Building Department
of the plans and specifications for the bulkhead.
2. Approval by the US Army Corps of Engineers,
3. Approval by the California Coastal Commission.
Discussion:
This application is before the City Council as required by
Section 5 .C.3 of the Council Harbor Permit Policies, which state:
5.3.C. "Prior approval of the. City Council will be required
before issuing a permit for shore -connected structures when the
upland abutting property is zoned commercial."
The existing bulkhead is bayward of a large condominium complex and
recently the applicant has noted signs of bulkhead failures in the
full length of the bulkhead. A portion of the bulkhead can be
repaired in place, and this repair is being handled by a
Maintenance Permit issued by the Marine Department with review of
the plans and specifications by the City Building Department. The
portion concerned in this application must be repaired by driving
steel sheet piles bayward of the existing bulkhead, which will
encroach into State Tidelands. This particular method appears to
be the only economically feasible method to repair the existing
bulkhead. The new coping and steel sheet pile will be at a minus
5 tide level below the existing sand line, and not visible from the
bay. There will be no additional encroachment of the upland
property within the State Tidelands and only those structures
needed to support the existing bulkhead will be in the state
tidelands area.
This method of repair has been used in a number of locations
throughout the bay where the nature of the bulkhead and its
proximity to the upland structure allows for no other economically
feasible method of strengthening the bulkhead.

The above referenced project has been completed as of 11 November 1993.
Monitoring of project construction was conducted by Samuel F. Kniss (RCE
17377) of our office. Conformance to the approved plans and
specifications, particularly dimensions, materials and workmanship, was
maintained and we affirm that structurally the project was constructed per
the plans.
Electrical, plumbing and fire protection was inspected and approved by the
appropriate departments of the City of Newport Beach.

This property, 611 Lido Park Drive, belongs to the Vista del Lido
Corp. and has not been transferred.
The white permit card 124-611 shows a transfer of the property from
Lido Construction Corp. to Lido Shore Hotel. This is not the case,
as noted above, it is still in the name of Vista del Lido Corp.
The green card for 124-611 has a stamped transfer from Vista del
Lido to Nelvoit 9-6-74. This has not happened.
