Your primary concern was fire access into the inner lagoon. You describe the new vessel to be 15' wide and the fairway to be a total of 35'-6 1/4 " wide. Harbor Resources does not see a conflict with this proposed configuration provided the following conditions are met: 1. Some boat manufactures refer to the beam of the vessel as the width at water line. However, vessels typically flare out and are much wider at the deck level than at the waterline. This width near the deck level is considered by the City of Newport Beach to be the overall width of the vessel. It is this definition that the City will refer to when making a width determination. 2. The minimum distance of a fairway will be either 13'6" to allow access by the Harbor Patrol's fire boat or the width of the largest vessel berthed in the lagoon, whichever is greater. This distance will need to be obtained at all times. All vessels in the lagoon must be able to exit safely without the need to move another vessel. 3. The cleats at side ties 25 and 26 must be removed to eliminate any temptation for vessels to side tie, if only momentarily, therefore blocking vessels in the lagoon from existing safely. The effective management of the docks is evaluated on an ongoing basis and one of the goals is to make sure that the slips and side -ties are utilized to generate sufficient financial income. The Board of Directors of the association has received a request to use spaces #39 & 40 (see attached map) as an additional slip for a Flybridge Motor Yacht. The vessel is 48' long and 15' wide. The additional slip will take up 15' of the entrance to the side -ties which is 35'- 6 1/4 "wide, which will leave 20' — 6 1/4 " for an entrance. Spaces #25 & 26 will be eliminated. The Board directed me to bring this matter to your attention and to inquire whether this will be acceptable to the Harbor Division and whether the 20' — 6 1/4 " entrance way will be sufficient for the Fire Department vessel in case of an emergency. As you and I discussed over the telephone, this letter shows that the above referenced pier is registered to "CAMS".,This is in error. "CAMS" was the previous management company for the 633 Lido Park Drive pier and has never had any other claim to this pier otherwise. I suspect the error originated as "CAMS" was a "CARE OF" mailing address for items related to the pier. Additionally, "GAMS" is no longer in business. This letter from the city also included an application for transfer of title and instructions for same. I as I discussed with you, I feel that a transferr application is not necessary for the above reasons. Additionally, I received back the billing statement for the annual permit fee as 1 well as the check for the fee. I called the Finance Department and was told that the payment and billing were sent back because they were received by the city after the delinquent date of April 1, 1984. As 1 explained to you and the Finance Department over the phone, we did not receive the billing until the last week of March.This is due to the fact that the mailing address available to the city is that of CAMS in Westminster. As I pointed out previously, CAMS went out of business the latter. part of February, 1964. As you can understand, mail forwarding has been somewhat hit and miss. I would like to ask for whatever assistance you can graciously provide in helping me in cleaning up this matter. I feel the penalty assessed is unfair and a hardship to the association. I am including the check originally sent by us as payment for. the annual fee. Also, I am including the letter signed by members of the Board of Directors of 621 Lido Park Drive informing the city.of the change of mailing address.
