At that time this property was in the ownership of Mr. Mickle and Mr. Briggs and zoned commercial. It was a small trailer park with a small marina out in front and they were given a commercial fee, which they paid from 1979 until approximately 1989 when it was transferred to Russ Fluter. Russ Fluter removed the trailer park and built a four unit condominium project and revised the slip arrangement to its current configuration. That request for revision went to the City Council on June 27,1989, at which time the docks were described as commercial docks and Mr. Fluter continued to pay the commercial fee for the tidelands bayward of the property during his ownership and subsequent transfer to the homeowner's association. Around the first week in March, I received a call Mr. Nott who indicated he was one of the residences in the condo association and would like to change from a commercial to a residential fee. He stated he did not realize they were paying a commercial fee and that the slips were not operating as commercial slips and the zoning on the property is multi -family residential. I told him that if he sent a letter stating these things we could make that change. He also indicated that he would like a refund from the time that they originally acquired the property. I told him we would not be able to make that refund because it was our understanding that all of the previous owners knew what the status of the tidelands permit was. Mr. Avery: The City Council has directed the Marine Department to respond to your letter of December 11, 1978 regarding a vessel at 711 Lido Park Drive. As you may recall, this particular situation was the subject of an inquiry some three or four months ago. As a result of the previous inquiry, this department contacted the owner of the vessel and informed him of the City's require- ments for mooring vessels at piers. A line was subsequently dropped from the end of the plank to the water and the distance from the line to the pier was measured. The measured distance complied with,the mooring requirement that no vessel extend beyond the dock a distance greater than the beam of the vessel. You.indicated in your letter that the Harbor Department does not feel this particular situation creates a hazard to navigation. l Based upon the above, it appears that the vessel complies with City regulation and cannot be Forced to change its position. However, City staff is of the opinion that some type of flag- ging suspended from the plank of this vessel would be desirable. Therefore, we are contacting the vessel's owner and requesting that he provide flagging. Additionally, we are requesting the Harbor Department to continue to monitor the situation. This plank extends past the dock approximately 20 feet, is hard to see in the day time and very difficult to see at night. We have brought this matter to the attention of Dave Harshbarger's office and, while Mr. Harshbarger agrees abcvt the hazard involved, he states:.they cannot enforce removal of the hazard, that enforcement is up to the Harbor Department. In a past conversation with the Harbor Department Mr. Ray Graham, head of the department, sees little or no hazard in the plank extending out from the dock some 20 feet. It was suggested to Mr. Graham that if the boat involved was not goin.� to be required to remove the plank or be turned around so as to have the plank over the private property of.the Lido Yacht Anchorage, at least a drop line with flags and lights be hung from th-e plank..
