your proposed activity complies with the terms and conditions of Regional General Permit
(RGP) No. 54.
As long as you comply with the general permit conditions of RGP No. 54, an individual
permit is not required. This letter of verification is valid until July 24, 2005, when RGP No. 54
is scheduled to expire. A general permit does not grant any property rights exclusive
privileges. Additionally, a general permit does not authorize any injury to the property or
rights of others or authorize interference with any existing or proposed Federal project.
Furthermore, it does not obviate the need to obtain other Federal, State, or local authorizations
required by law.

Commission permit #5-99-282 for maintenance dredging in Newport Harbor and that I

harmless from and indemnify them against any claim for damages arising out of the

I received your October 23 letter regarding Mr. Felier's comp I laint. Unfortunately Mr.

inspection confirmed that his complaint was valid. At the time of the field inspection
there was only one vessel in the slip.
The warning letter sent to Donna Larson allowed ten (10) working days to correct this
violation. Therefore, unless the vessel in question is berthed correctly on November 4h a

Your letter to Lido Marina Village of October 21, 2002 has been forwarded to me,
since Olen Properties is the owner of the subject slip.
I wanted to let you know that I have spoken with Mr. David Feher and fully
understand his concern. 1. believe -the complaint more specifically arises out of an
additional barge/boat which is often tied to the side or the stem of Pacific Avalon's vessel
and blocks entry to Mr. Felier's slip. We have notified Pacific Avalon accordingly that
they must comply with regulations and cease the tying of additional vessels which extend
too far out into the bay. Judging by my last conversation with Mr. Felier, it appears that
the situation has now been resolved.

Dear Donna:
Your tenant, David Felier, complained to the City that the vessel adjoining his slip is out
too far beyond the end of the dock and pier hear line, in violation of the City's policy.
Notice of this violation was sent to you on October 18, 2002, and a period of ten working
days to correct this problem.
An inspection conducted today revealed that the vessel is still berthed in violation to the
policy. This office realizes that it is not easy to find an alternate berth for such a large
vessel, but must never the less enforce the policy. This being the case, an extension of the
deadline to re -locate the vessel in question is granted. Please do whatever is necessary to
come into compliance with the City Council Harbor Permit Policy. Failure to correct this
problem by November 15, 2002, will result in a citation.

Thank you for the preview. It appears from the draft that some of the current vessels will be displaced from the site. I am
especially interested in the charter vessel operators since one of them has applied to us for a Commercial Harbor Activities Permit
that requires a fixed base of operations and dedicated parking. They have reported to us to have a 12 year lease.
As for the plan, it appears that this would become an attractive gateway to the peninsula. You do not show vessels on the side
ties and very often large vessels end up on the side ties blocking access for the small vessel docks nested on the inside. This
becomes a fire code violation. I think a marina management and operations plan would help in reviewing the plan view schematic.
Also, a project of this size and importance will be reviewed by the Harbor Commission and providing them an opportunity for input
at an early stage in the process would be beneficial to the success of the project.

THE LAW REQUIRES
Administrative Citation
Newport Beach Municipal Code Section 1.05.020 provides for the issuance of administrative citations for Municipal Code
Violations. There are three levels of citations that can be issued progressively for a violation. The fines, as indicated on the front of
the citation, are $100.00 for the First Citation, $200.00 for the Second Citation and $500.00 for the Third and subsequent Citations for
violations of the same ordinance within one year. These fines are cumulative and citations may be issued each day the violation
exists. A warning, if issued, does not incur a fine and therefore, is not appealable.
Rights of Appeal
You have the right to appeal this administrative citation within fifteen (15) days from the correction date together with an
advanced deposit of the fine along with a Request for Hearing form. An appeal must be in writing to the address on the front of this

citation and to the attention of "Administrative Hearing Officer." A properly filed appeal will result in an administrative hearing.
Failurebf any person to properly file a written appeal within fifteen (15) business days shall constitute a waiver of his or her
right to an administrative hearing and adjudication of the administrative citation or any portion thereof and the total amount of the
fine.
How to Pay Fine
The amount of the fine is indicated on the front of this administrative citation. Prior to receiving an invoice from the
Revenue Division, you maypay by mail or in person at 3300 Newport Blvd., Revenue Division, Newport Beath City Hall. Payment
should be made by personal check, cashier's check, or money order, payable to the City of Newport Beach. Please write the citation
or account number on your check or money order.
If the citation is not paid or appealed within the statutory time, you will receive an invoice from the City's Revenue Division.
Please follow the instructions on the invoice to ensure pro per processing of your payment. Payment of the fine shall not
excuse the failure to correct the violation nor shall it bar further enforcement action by
the City of Newport Beach.
Consequences of Failure to Pay the Fin
The failure of any person to pay the fine assessed by the administrative citation within the time specified on the citation or on
the invoice from the Revenue Division may result in a claim with'the Small Claims Court or any legal remedy available to collect
such money. The City has the authority to collect all costs associated with the filing of such actions. Failure to pay fine requirements
may be found in Newport Beach Municipal Code Section 1.05. 100.
Conseguences of Failure to Correct Violations
There are numerous enforcement options that can be used to encourage the correction of violations. These options include,
but are not limited to: civil penalties, abatement, criminal prosecution, civil litigation, recording the violation with the County
Recorder and forfeiture of certain State tax benefits for substandard residential rental property. These options can empower the City
to collect fines up to $100,000.00, to demolish structures or make necessary repairs at the owner's expense, and to incarcerate
violators. Any of these options or others may be used if the administrative citations do not achieve compliance,

bayward of approximately 5001 of bay frontage and constructing slips
bayward of Imperial Savings & Loan, where none exist at -the present time.
SLIPS - Currently, within the subject tidelands zone,.there are
five separate harbor Permits, four of which are held by Mr. Koji
and one by Imperial Sa *
vings-& Loan., Combined within these permit
zones, are 26 slips, 15 side -ties, for a total of 41 docking spaces.
The proposed reconstructed marina, inclu
ding new slips bayward of
the Imperial Savings & Loan property, would accomodate slips for
55 tenants and spaces for 18 side -ties. The total increase in
docking spaces would be'22.
2. RESTROOMS - There are three (3) men and women restroom facilities
Plus one toilet and wash basin within t1ae proposed marina zone.
.To meet the requirements of the harbor permit Policies, the one
toilet and basin facility would need remodeling to accomodate
men and women separately.
3. PARKING - The existing' off-street parking is limited and*serves
both the slip tenants as well as the contiguous apartments and
commercial businesses abutting the tidelands. The staff was
unable to ascertain the number of off-street parking stalls alot-
ted to the existing harbor perml

conditions. Two of the conditions of approval indirectly
relate to the harbor permit. These are:
1. "That the appjicant�make an irrevocable offer to dedicate
a public easement adjacent to the bulkhead forthe entire
360 feet of bay troi�t'a'4ge, and at least one easement extend-
ing from Via Oporto to the bulkhead. Said easements shall
be designed and located in a manner meeting the approval
of the Director of Community Development. These offers
shall be exercised by the Cit -
remodeling or March 1, 9.74 y upon completion of the
