Might be worth considering for next year's efforts. Please see if you can stop by today if you're in the area. If not, it can wait till next week. I received a complaint from a disgruntled employee that may be worth checking out. Apparently, his employer is sanding and painting the hull of his gondolas while in the water, and he consciously skirts watchful eyes by doing this in the early morning hours. Might be worth checking out. I also have a call into the property owner on PCH whom I know well. I'll be leaving at 8:30 and will return about 10-ish. Since vinegar would not harm the seal or damage their skin, I would think a mild solution of white vinegar (maybe a 100 solution) and water sprayed on the seals would be a possible deterrent. INSPECTION CHECKLIST FOR COMMERCIAL DOCK Dear Mr. Miller: Following please find our actions taken in regards to the inspection checklist for commercial docks provided by your offices for permit number HC2004-067 for the above referenced property: Multiple Berthing: Dock Manager has spoken to gondola owners and has resolved the blocking issue. Fire Extinguisher Requirement: Dock Manager will perform monthly inspections. We installed two new fire extinguishers in the fire hose cabinets that were missing extinguishers on May 11, 2004. Class H Standpipe Testing: We have contracted Certified Fire Extinguisher, Inc. (Lic# C-16 461825) who has performed the five year certification, which will take care of the semi- annual maintenance inspection (See Attached Invoice). Dock Maintenance: Dock Manager has spoken to the current slip tenants who are in violation of the 24" access on the dock and has spoken to the slip tenant with the spring lines impeding access. The Dock Manager will continuously check the dock to assure slip tenants are not obstructing the 24" access. Fire - Other: All flammable and combustible liquids found in the dock storage of Slip 18 were disposed of and the slip tenant in slips 1 and 2 were notified by Dock Manager not to store these type of items at their slips. Non -Conforming Condition: No future modifications to the dock are projected. Building -Other: All pedestal covers (4, 7, and 8) have been secured an covers have been installed for the pedestals that were missing covers. The electrician has secured the shore cord at eastern gangway. Harbor Resources -Other: Dock Manager has been apprised to monitor each individual slip and report or correct any violations being made by the slip tenants. Loading and unloading of all passengers shall occur at 3101 West Coast Highway unless Charter Memories is conducting, a charter under permit issued pursuant to Chapter 5.18 of the Newport Beach Municipal Code ("Marine Charter Permit"). 3. Any significant change in permitted operations shall require approval of an amendment to this permit pursuant to Chapter 17.41 of the Newport Beach Municipal Code. 4. Charter Memories shall use it's best efforts to require clients to transport passengers on private party charters to 3101 West Coast Highway using buses, shuttles or similar vehicles departing from locations remote from the boarding site. Charter Memories shall also use its best efforts to ensure that buses or shuttles used to transport private parties park off Pacific Coast Highway. 5. All vessels operated by Charter Memories pursuant to this permit may operate only between the hours of 8:00 a.m. to 12:00 a.m. 6. Vessels chartered by Charter Memories shall travel only in the main navigational channels within lower Newport Bay. 7. Food and liquor may be served on board vessels provided service is in full compliance with all applicable laws, statutes and ordinances. 8. All trash and litter generated by activities authorized by this permit shall be disposed of in appropriate receptacles which shall be emptied as often as necessary to maintain a neat and orderly appearance. 9. All human waste collected on board any vessel operated by Charter Memories shall be discharged solely in the City's sewer via a vessel pump out station. 10. Any amplified sound, whether limited to narration or music using either an amplification system, a radio/ stereo musical instrument or similar device, shall be audible no more than 50 feet from the hull of the vessel. 11. Charter Memories shall not increase the number of vessels or substitute vessels for those listed on Exhibit A without the prior written consent of the Marine Environmental Division which shall not be unreasonably withheld. 12. During the hours of 6:00 p.m. to 12:00 a.m. daily, Charter Memories maximum passenger count that can be under charter based on on-site parking shall be 375 passengers. In the event that they wish to exceed this 375 passengers during the hours mentioned above it would be necessary to apply for a Special Events Marine Charter Permit from the City's Revenue Division. In the event they wish to charter at hours other than those listed above it would also be necessary that a Special Marine Charter Permit be issued. 13. This permit incorporates by reference the findings and conditions listed on the Planning Commission Approval of March 6,1997 and attached to this Charter Permit. 14. Charter Memories shall comply with all of the provisions of the Newport Beach Municipal Code, and the Harbor Policies adopted by the Newport Beach City County. The City Council reserves the absolute right to amend the provisions of the Municipal Code or Harbor Policies relevant to commercial harbor activities. 15. Charter Memories shall defend, indemnify, and hold harmless the City of Newport Beach, the County of Orange, the Orange County Harbor District and their respective officers, employees, agents and representatives, with respect to any claim or lawsuit alleging any loss, damage, injury or entitlement that is in any way related to the issuance of this Permit or the commercial harbor activities authorized by this Permit. The City Council reserves the right to retain legal counsel to defend its interests in the event of any litigation which Charter Memories is obligated to defend pursuant to this Permit. In the event the City Council retains special counsel to defend its interest, Charter Memories shall reimburse the City of Newport Beach for all reasonable expenses and costs incurred by it in defending the litigation, as well as paying and/or complying with any judgment resulting from the litigation. 16. There shall be no boarding of charter passengers within 200 feet of the west boundary of the marina. 17. City Council approval is required to transfer some or all of the commercial harbor activities authorized by this Permit to a location other than 3101 West Coast Highway. The City Council reserves the right, in its sole discretion, to require Charter Memories to comply with all provisions of the Newport Beach Municipal Code with respect to those commercial harbor activities transferred to a different location, including without limitation, the provisions of parking and other land -side support facilities. The City Council also reserves the discretion to waive some or all of the required parking or land -side support facilities upon a determination that the transfer will not adversely impact the health, safety or general welfare of those working or living in the area to which commercial harbor activities would be transferred. 18. The Fire and Marine Chief, or City Council on appeal or review, shall have the power to impose reasonable new conditions, or modify existing conditions, upon a determination, supported by substantial evidence, that the operations of Fun Zone are adversely impacting the health, safety, or general welfare of those who use, enjoy or own property near the waters of Newport Bay and will continue to do so in the absence of the new or modified conditions. Hereinafter referred to as Charter Memories. This permit is issued and authorizes only those activities specified in paragraph A and is subject to strict compliance with the terms and conditions specified in paragraph B. A. Charter Memories is authorized to conduct, as a principal component of their business,. harbor cruises and the nature of the cruises will include but are not limited to weddings, birthday parties, corporate events, etc. Charter Memories shall only use those vessels specified in exhibit A or substitute vessels approved by the Marine Environmental Division, subject to sub- paragraph B-11. The vessels listed as Charter Memories shall be designated by the United States Coast Guide for carrying passengers for hire. B. Terms and conditions. The commercial harbor activities authorized by this permit are subject to strict compliance with the following conditions: 1. All vessels operated by Charter Memories shall be berthed at 3101 West Coast Highway, Newport Beach, CA 92663. 2. Loading and unloading of all passengers shall occur at 3101 West Coast Highway unless Charter Memories is conducting a charter under permit issued pursuant to Chapter 5:18 of the Newport Beach Municipal Code ("Marine Charter Permit"). 3. Any significant change in permitted operations shall require approval of an amendment to this permit pursuant to Chapter 17.41 of the Newport Beach Municipal Code. 4. Charter Memories shall use it's best efforts to require clients to transport passengers on private party charters to 3101 West Coast Highway using buses, shuttles or similar vehicles departing from locations remote from the boarding site. Charter Memories shall also use its best efforts to ensure that buses or shuttles used to transport private parties park off Pacific Coast Highway. 5. All vessels operated by Charter Memories pursuant to this permit may operate only between the hours of 8:00 a.m. to 12:00 a.m. 6. Vessels chartered by Charter Memories shall travel only in the main navigational channels within lower Newport Bay. 7. Food and liquor may be served on board vessels provided service is in full compliance with all applicable laws, statutes and ordinances. 8. All trash and litter generated by activities authorized by this permit shall be disposed of in appropriate receptacles which shall be emptied as often as necessary to maintain a neat and orderly appearance. 9. All human waste collected on board any vessel operated by Charter Memories shall be discharged solely in the City's sewer via a vessel pump out station. 10. Any amplified sound, whether limited to narration or music using either an amplification system, a radio/ stereo musical instrument or similar device, shall be audible no more than 50 feet from the hull of the vessel. 11. Charter Memories shall not increase the number of vessels or substitute vessels for those listed on Exhibit A without the prior written consent of the Marine Environmental Division which shall not be unreasonably withheld. 12. During the hours of 6:00 p.m. to 12:00 a.m. daily, Charter Memories maximum passenger count that can be under charter based on on-site parking shall be 375 passengers. In the event that they wish to exceed this 375 passengers during the hours mentioned above it would be necessary to apply for a Special Events Marine Charter Permit from the City's Revenue Division. In the event that wish to charter at hours other than those listed above it would also be necessary that a Special Marine Charter Permit be issued. 13. This permit incorporates by reference the findings and conditions listed on the Planning Commission Approval of March 6,1997 and attached to this Charter Permit. 14. Charter Memories shall comply with all of the provisions of the Newport Beach Municipal Code, and the Harbor Policies adopted by the Newport Beach City County. The City Council reserves the absolute right to amend the provisions of the Municipal Code or Harbor Policies relevant to commercial harbor activities. 15. Charter Memories shall defend, indemnify, and hold harmless the City of Newport Beach, the County of Orange, the Orange County Harbor District and their respective officers, employees, agents and representatives, with respect to any claim or lawsuit alleging any loss, damage, injury or entitlement that is in any way related to the issuance of this Permit or the commercial harbor activities authorized by this Permit. The City Council reserves the right to retain legal counsel to defend its interests in the event of any litigation which Charter Memories is obligated to defend pursuant to this Permit. In the event the City Council retains special counsel to defend its interest, Charter Memories shall reimburse the City of Newport Beach for all reasonable expenses and costs incurred by it in defending the litigation, as well as paying and/or complying with any judgment resulting from the litigation. 16. There shall be no boarding of charter passengers within 200 feet of the west boundary of the marina. 17. City Council approval is required to transfer some or all of the commercial harbor activities authorized by this Permit to a location other than 3101 West Coast Highway. The City Council reserves the right, in its sole discretion, to require Charter Memories to comply with all provisions of the Newport Beach Municipal Code with respect to those commercial harbor activities transferred to a different location, including without limitation, the provisions of parking and other land -side support facilities. The City Council also reserves the discretion to waive some or all of the required parking or land -side support facilities upon a determination that the transfer will not adversely impact the health, safety or general welfare of those working or living in the area to which commercial harbor activities would be transferred. 18. The Fire and Marine Chief, or City Council on appeal or review, shall have the power to impose reasonable new conditions, or modify existing conditions, upon a determination, supported by substantial evidence, that the operations of Fun Zone are adversely impacting the health, safety, or general welfare of those who use, enjoy or own property near the waters of Newport Bay and will continue to do so in the absence of the new or modified conditions. The proposed change will allow the vessel "Dream on" to access and dock in that slip without encroaching into the permit area of your neighbor. Until that is accomplished, there shall continue to be problems relative to the vessel being too large for that slip. You have submitted and have been approved plans to change the size of the slip. You have indicated that the delay in beginning this project is due to getting all the signatures required to authorize the work and that problem will soon be resolved and work begin within two weeks. The Marine Department is eager to solve the ongoing problem that has pertained to encroachments of vessels, and will support the two week delay providing that it doesn't take longer. Mr. Bedale's complaints, under the circumstances outlined below, seem unreasonable to us, as well as to his immediate neighbors. The owners and operators of the Rapture, a publicly operated vessel -for -hire, consistently show a deep sense of pride in ownership of this vessel. And, as is spelled out in their lease, there are no passengers allowed or passenger noise ever apparent. There has been a past track record of working diligently to accommodate the wishes the existing Towers tenants. The fact that we have successfully met that goal is evidenced by the comments of Mr. Walt Luithle, owner of three condos, and the one balcony -level tenant who's balcony is within 15 feet of the upper deck of the Rapture. Mr. Luithle, who is a memberof the governing board of the Homeowners'Association forth e Towers, states that he has no problem with the Rapture or her crew now, or in the past, and fully supports the Rapture and her crew remaining at our facility as a first class operation. One of his tenants, Mr. Bill Sliff, also has his balcony within approximately 10 to 15 feet of the upper deck of the Rapture. He has stated to us that he fully supports the day-to-day operation of the Rapture by her crew and feels that it is not only very professionally run but that, by its very presence, the Rapture is an asset to the Homeowners' Association of the Towers as well. Mr. Harry Cossman, is the president of the Towers HOA. I am setting up a meeting with him to obtain a letter which will reflect his view that the operation of the Rapture causes him no concern. Since all of the exterior construction is finished, the noise level from the construction is very minimal. B) The pleasure boats and five-aboards which were once berthed beside the Towers, pleasure boats which were noisy by their very nature, have been replaced by the larger, professionally run vessels which are apparent today. G) The prior owners of this project were less than sympatheticto the plight of their neighbors and seemingly made no attempts to accommodate the residential status of the project next door. In contrast, we not only take immense pride in our project, but we have done many things to improve the neighborhood and to keep the needs of our neighbors in the forefront of our planning: 1) Our past track record, as the new owners of the project since November, 1992, show that we have done our best to be good neighbors, including the $133,265 we spent in upgrading of the commercial dock. That upgrade, including moving the ingress/egress passage to the farthest South end of our property, has been completed. If this ridiculous demand, counterproductive to Marine -Related -Use compliance, were to go to the City Council, and even if the Council decided in Mr. Bedale's favor on this issue, we would still have those spaces to lease out. In fact, if we were forced by the Council's actions today to break the existing lease with the Rapture and the Jetstar, we would then be able to rent those existing berths to three 65 foot long (or shorter) private boats. That would mean that, unlike the strict controls we have on the operation of the commercial vessels, we would have no such controls on cleaning, maintenance, noise, parties, loading and unloading of their friends, times of departures and arrivals, or even the early hours forfishing trips or late nights for band parties which can be typical of pleasure boats. If these problems occur at all, we would, as is our policy, try our best to Control these types of actions, but we would have no control over the departure and arrival times for these private boats. As spelled out in the Rapture's lease, we have full control of the operations of the vessel with regard to people -produced noise. And isn't this what we are talking about? Let's get real. We at Mariners Mile Professional Building and Newport Harbor Manna are more than willing to cooperate with the City and with our neighbors, and to go the extra mile as we have shown in the past, Le_ relocating all the commercial boats loading and unloading of passengers to the opposite end of our property at a cost of more than $133,265 - not allowing passengers to board, holding down the operation of the Rapture and the Jetstar, all at extra costs to Certified Yachting Adventures, the operators of the Rapture and the Jetstar since they must pay to board their passengers next door, 250 feet from their own slip. In frustration, and as a means to an end, I ask of you, the Newport Beach Marine Department, that you please provide guidance towards a mutual agreement on two very important matters - - - One, quiet enjoyment for all concerned and what we can do to better achieve this goal, if that can be done, in excess of what we are now practicing; and - - - Two, most important success of Mariners Mile, the Marine -Related -Use ordinance regarding public access and utilization of our beautiful Newport Harborto its maximum potential. Number twelve of that agreement stated "that should the reconfiguration not be completed by January 1, 1990, Lancer's Landing agrees not to permit the docking of any vessel in excess of sixty-five (65) feet in length within two hundred (200) feet of the Towers residences." Also, number 13, "that should the vessel "Regentsea" be removed from its current slip, Lancer's Landing agrees not to permit a vessel used in a charter capacity in excess of sixty-five (65) feet in length to be docked within two hundred (200) feet of the Towers." This agreement was never made a condition of the commercial permit for the property at Lancer's Landing and was essentially between the owners at the time and the City of Newport Beach. As you are probably aware, there are new owners of the property, and it is unclear whether this agreement is binding upon them or not. However, it is our understanding that, based on phone calls from yourself, that there continues to be nuisance problems at the site, relative to large boats berthed adjacent to the Towers Condominiums and operating in the charter business. If it becomes necessary for additional enforcement follow-up based on the berthing of these vessels, it would be necessary that the City Council place additional conditions on the Commercial Marina Permit for Lancer's Landing. As a result, it would require that the permit go back before the City Council with the recommendations for these conditions. This could place a considerable hardship on the new property owner at Lancer's Landing, and it's my understanding, at least in writing, that he has tried on several occasions to satisfy the problems that you have indicated are occurring. 3300 Newport Boulevard, Newport Beach For us to take the next step, and proceed to the City Council to alter the Commercial Permit, it is necessary that we have in writing from yourself, a delineation of the problems that are occurring at the commercial site and are causing a nuisance situation. Other than the few days that the Rapture was out at sea, Mr. Bedale has called on an almost daily basis to protest "the use of that noisy equipment". His calls are always within the hours of operation which we both agreed were reasonable, and his attitude is that any noise coming from the marina must be eliminated. I have had several long discussions with Mr. Bedale, as well as talks with the Rapture's owners at Certified Yachting Adventures (CYA). The results are hardly what I would have hoped. I repeatedly pointed out to Mr. Bedale that the CYA people are adhering to the time schedule outlined in the order to which Mr. Bedale keeps referring, that they are not breaking any of the rules laid down by the City Marine Department or the Harbor Master (i.e. they do not board charters from the berth, etc.), and that, as a direct response to Mr. Bedale's complaints, they have even added additional equipment to dampen the noise generated by their ship cleaning machinery. Mr. Bedale merely continues to talk over me, insisting that the noise is "against the rules and I'll be at the next City Council meeting and then you'll have to get rid of them (CYA)." I even offered to enclose his patio with sound -dampening, dual -glaze glass so that he would not have to hear anything from the outside, but again he ignored my offer in favor of repeating his intension to go to the City with his complaints "and get them out of there." I am at a loss as to how I can work out an equitable solution with Mr. Bedale. He isn't even using my personal pager number, which I gave to him when he first called, where he could reach me 24 hours per day. Instead, he continues to call my office staff to complain, insisting that our answering service put his calls through to my secretary's home on weekends. When I return his calls, he merely insists that "those boats must go, it's in the rules, and I don't have to put up with this." From what I have been able to determine, there are no other tenants in the Towers which are disturbed by CYA's operations; I think if there were, we would be facing a committee rather than this one individual. It is my understanding that the original order was issued against the prior owners of this building and against a specific vessel. Since the property has changed hands several times (and sold to us in November, 1992) and the offending vessel is gone, this particular order does not seem to apply in this case. I have been advised that we are in compliance with the laws in this case when we do not create unnecessary noise. A certain amount of noise is, of course, unavoidable within this commercial district of Newport Beach. It is a pity that the Towers was erected in the middle of the commercial district and that Mr. Bedale's demands for silence at all times cannot reasonable be met. As I have indicated before, we are most anxious to be good neighbors, to run a professional operation, always considerate of the needs and wishes of those around us. I still hope that there is some way I can come to terms with Mr. Bedale's demands without putting the marina out of business and leaving this property vacant, but I suspect that anything less than abandonment of my property will not satisfy Mr. Bedale. Last July, after receiving complaints about noise created by charters, this office negotiated with yourself and representatives of the Towers Condominium Association over the operation of the vessel "Regentsea" from the marina at Lancer Landing. A copy of the written agreement that resulted from our negotiations is attached. This agreement addressed not only the operation of the vessel "Regentsea", but the docking of any vessel in excess of sixty-five feet (65').. Item twelve (12) on page two (2) states that should reconfiguration of the docks not occur by January 1, 1990, Lancer Landing agrees not to permit the docking of any vessel in excess of sixty-five feet (651) within two hundred feet (2001) of the Tower's property. Residents of the Towers are again complaining about noise created by the operation of charter vessels from Lancer Landing. I have also been advised that the vessel "Dulcinea", which is ninety-six feet long, is being docked and operated in the slip at the west end of the marina adjacent to the Towers. This correspondence is to advise you that no charter permits shall be issued by this office for charters boarding from the Lancer Landing marina within two hundred feet (2001) of the Towers condominiums. The proposed concrete sheet pile bulkhead shall be constructed in the same location as the existing wooden bulkhead or landward of same. 2. At the eastern end of the proposed project, where no bulkhead now exists, any new bulkhead shall be constructed landward of the mean higher thigh (MHHW) tideline. 3. Discharge of dredge material tailwaters shall not be permitted and a silt curtain shall be deployed around the dredging site if drag -line equipment is used. 4. Dredging shall not be allowed closer- than 50 feet from the easternmost project boundary (as shown on the public notice drawing as the mitigation area). 5. Runoff from the parking area shall be directed away from the.mitigation area. 6. New docks should not be permitted landward of the existing docks, about 50 feet from the MHWW line, and no closer than 50 feet of the easternmost property line (as approximated by the mitigation area shown on the public notice drawing). 7. You must contact the U.S. Coast Guard, Aids to Navigation Branch (213) 590-2222, at least two weeks (2 weeks) prior to any construction. 8. That if any findings of potential archaeological, scientific, prehistoric or historic significance occur during contstruction, work shall be immediately suspended and the District Engineer shall be notified.
