Villa Nova Restaurant Site, 3131 West Coast Highway Dear Mr. Bunter: The following list of comments need to be addressed and resolved prior to our ability to issue a seawall repair permit and prior to granting any foundation permit. 1. Drawings and specifications for the wall repair and the list of repair recommendations must be on a drawing matching the building drawing size (18" x 24" minimum) to enable contractor to build and inspector to inspect this work.. 2. "Six foot wall" a. Minimum top of bulkhead elevation to be 6.27' msl. Alternate: show grade elevation on adjacent property to verify that water cannot go over this wall and onto adjoining property. b. Specify the total horizontal dimension of Rip -Rap in the bay. C. Maine Division approval is required. Call Tony Melum at (714)644- 3044. Tony informed me that placement of Rip Rap in the Fbay requires city council approval. 3. "West Wall" a. On Page Three of the report it states, "The wall is not plumb. It appears to be leaning back." specify the amount (distance) this wall is out of plumb (leaning). 3300 Newport Boulevard, Newport Beach Mr. Ergun Kunter February 5, 1996 Page Two b. The report further speculates, on Page 3, whether the slab on grade is the tie back for the wall or if tie backs are under the slab connected to a deadman. The report also speculates that the 24" high masonry block wall at the toe of the sea wall may have been placed to "stabilize the wall or to prevent sand seepage". The structural integrity of this wall is important because the back fill supports hardscape and/or pavement. Also, any leakage of sand back fill in this location will result in migration of sand from the adjoining property onto this property which may cause damage to the existing improvements at the adjacent property. Therefore, the structural condition of this wall must be investigated and the necessary repairs be made as foIlows: i. Investigate the adequacy of the masonry block wall at the base of the wall for shoring the base of this curtain wall and preventing sand leaks from under the wall. Add Rip -Rap in front of this wall if necessary. ii. Remove slab behind the wall to determine the tie back mechanism and its structural condition and make recommendations for the necessary repairs. According to our records, payment of the subject fee has not been received by the City°s Finance Department. Section 17.33.050 of the Municipal Code states: PENALTY FOR FAILURE TO PAY FEES. Any owner or permit holder who fails to pay any fee required by this Chapter within thirty (30) days after the same is due shall be subject to a penalty in the amount of ten per cent (10%) of the uncollected fee. Failure to pay the fee plug any accrued penalty within sixty (60) days after the fee was originally due shall constitute grounds for revocation of the permit by the City Council.
